WHEREAS in TARRANT COUNTY on STATE HIGHWAY SPUR 303, from Interstate
Highway (IH) 820 to Fielder Road, a distance of approximately 5 7 miles, the Texas
Transportation Commission (commission) adopted Minute Order 84037 (Exhibit A) dated January
30 1986 requiring the Cities of Arlington, Dalwortliington Gardens, Fort Worth and Pantego to
provide for the construction of continuous curb and gutter storm sewers, etc. as may be
necessary for a complete project; and

WHEREAS provisions in Minute Order 84037 were in accordance with 43 Texas
Administrative Code (TAC) Section 19 41 and 43 TAC Section 11 41 requiring local govennents
to provide curb and gutter and storm sewer and
WHEREAS on May 28 1987 43 TAC Section 19 41 was repealed and 43 TAC Section
11..41 was amended to allow the State to provide for curb and ,gutter and storm sewer on all State
numbered routes; and
WHEREAS during the public comment period for :adoption of the proposed rules, the
issue of retroactive application was raised by local governments and the commission determined
that it would be inappropriate to change the funding responsibility for local governments who had
entered agreements prior to the effective date of the proposed rules, and
WHEREAS the North Central Texas Council of Governments (NCTCOG) has selected
this project, on Spur 303 from IH 820 to Fielder Road, in their Surface Transportation Program
Metropolitan Mobility Category (STP-MM) for a total of $11 044 000- and
WHEREAS the City of Fort Worth has requested that the section of Spur 303 from IH
820 to 2.6 miles east of IH 820 (near Green Oaks Boulevard) be removed from the project limits,
since this portion of the existing four lane facility is adequate to handle current and projected
traffic volumes, and
WHEREAS the $11 044 000 approved by NCTCOG for Spur 303 from IH 820 to
Fielder Road, within the STP-MM category is sufficient to finance the remaining project on Spur
303 from 2 6 miles east of IH 820 to Fielder Road, and
WHEREAS the Cities of Arlington, Dalworthington Gardens and Paniego have been
working together to provide for the construction of Arkansas Lane and Bowen Road in the
vicinity of Spur 303 and

WHEREAS these cities are providing $8,500 000 of the $12,300 000 construction cost
for these projects with the remaining $3 800 000 being funded through the STP-MM category•
and
WHEREAS the $8,500 000 funding by these cities for these adjacent projects exceeds the
cost for the construction of continuous curb and gutter storm sewer etc. on the Spur 303
project, and
WHEREAS the Cities of Dalworthington Gardens and Pantego are unable to honor their
commitment for the construction of continuous curb and gutter storm sewer etc. on Spur 303
and
WHEREAS all these projects are vital transportation routes which are needed to meet this
area s air quality attainment goals; and L
WHEREAS recognizing the Cities of Arlington, Dalworthington Gardens and Pantego
are willing to provide $8,500 000 for the construction of the adjacent critical projects,
NOW THEREFORE, IT IS ORDERED that the Texas Department of Transportation
~ (department) will provide for curb and gutter storm sewer etc. for the project on Spur 303
from 2 6 miles east of IH 820 to Fielder Road provided the project is selected by NCTCOG for
inclusion in the STP-MM program, and
IT IS FURTHER ORDERED that the executive director ~s directed to tender the
following proposal to the Cities of Arlington, Dalworthington Gardens, Fort Worth and Pantego
Provided the Cities of Arlington, Dalworthington Gardens and Pantego will.
Agree to all the prov~stons of Minute Order 84037 dated January 30 1986
except Item i under the provisions of the Cities which states, Provide for the
construction of continuous curb and gutter where none now exist, storm sewers,
etc all necessary for a complete project with the exception of pavement and its
support. which will be deleted.

Provided the Cities of Fort Worth and Arlington will.
Agree to shorten the project limits by 2 6 miles and cancel their commitments
under Minute Order 84037 The new limits are from 2 6 miles east of IH 820 io
Fielder Road.
The department will
1 Agree to all the provisions of Minute Order; 84037 dated January 30 1986
except Item 3 under the provisions of the department, Provide for the
construction at an estimated cost of $8 677 709 which shall be revised to
Provide for construction at an estimated cdst of $9,525 000 as authorized to
Category 4C, Surface Transportation Program Metropolitan Mobility
2 Agree to add Item 5 under the provisions ~f the department which will state.

under Minute Order 84037 The new limits are from 2.6 miles east of IH 820 to
Fielder Road.
IT IS FURTHER ORDERED that upon acceptance of the provisions of this Minute Order
by the Cities of Arlington, Dalworthtngton Gardens, Fort Worth and Pantego that Minute Order
84037 dated January 30 1986 is amended as outlined above.
This order shall become operative upon acceptance by the Cities of Arlington,
Dalworthington Gardens, Fort Worth and Pantego, and if not accepted within 90 days of the~date
hereof the action herein contained shall be automatically cancelled

by the Texas Transportation Commission on September 28 1995
for the improvement by the Texas Department of Transportation of
the project described below
