HomeMy WebLinkAboutOrdinance 23127-03-2018 Ordinance No. 23127-03-2018 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $275,408.42 IN THE GRANTS OPERATING STATE FUND, FROM GRANT RECEIPTS, FOR A GRANT AGREEMENT WITH THE STATE OF TEXAS,OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION FOR THE RIFLE-RESISTANT BODY ARMOR GRANTS PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the amount of$275,408.42 in the Grants Operating State Fund, from grant receipts, for a grant agreement with the State of Texas,Office of the Governor,Criminal Justice Division for the Rifle-Resistant Body Armor Grants Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22927-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Ratify the application for and authorize the acceptance of, if awarded, the State of Texas, Office of the Governor, Criminal Justice Division, Rifle-Resistant Body Armor Grant Program in an amount up to $275,408.42; 2. Authorize the execution of a Grant Agreement with the State of Texas, Office of the Governor, Criminal Justice Division for the Rifle-Resistant Body Armor Grant Program; 3. Adopt the attached resolution for acceptance of grant funds and to make assurances as required by the State of Texas, Office of the Governor, Criminal Justice Division; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating State Fund in the amount of$275,408.42 upon receipt of the grant. DISCUSSION: In response to the July 7, 2016 shooting of police officers in Dallas, Texas, the Criminal Justice Division (CJD) of the Governor's Office created a grant program to assist agencies in the purchase of rifle-resistant body armor. The Fort Worth Police Department, in conjunction with the Fort Worth Marshal Division, submitted an application in the amount of$275,408.42 for 585 Type III and 67 Type IV vests. The overall goal of this project is to increase the safety of Texas law enforcement officers and prevent further loss of life in active shooter situations. This grant does not require a grant match from City funds. Indirect costs are not allowable expenses under this grant. This grant serves ALL COUNCIL DISTRICTS. This contract will be with a governmental entity, state agency or public institution of higher education: State of Texas, Office of the Governor, Criminal Justice Division.
