HomeMy WebLinkAboutResolution 2004A Resolution a vo • URGING THE TEXAS MUNICIPAL LEAGUE TO SUPPORT PASSAGE OF LEGISLATION TO ALLOW FOR SHARING OF HOTEL OCCUPANCY TAX INFORMATION BETWEEN STATE AND MUNICIPAL AUDITORS WHEREAS the City of Fort Worth Internal Audit Department performs audits of hotel occupancy tax revenues in Fort Worth, and WHEREAS the State Comptroller's office also performs audits of hotel occupancy tax revenues in Fort Worth, and WHEREAS the City's Internal Audit Department must review the exact same records that are reviewed by the Comptroller's Office to perform an audit of hotel occupancy taxes, and WHEREAS Section 111 006 of the Texas Tax Code currently prohibits the Comptroller's office from sharing audited hotel financial information with municipalities, and WHEREAS the taxpayers of Fort Worth will be provided economies of scale by sharing of information between the State Comptroller's office and the City's internal Audit Department; and WHEREAS hotels will not be required to open their records twice for the same purpose, and WHEREAS it is recognized that the confidential nature of the financial records of a hotel should not be interfered with unnecessarily and that provisions should be made to protect hotel records which come into the hands of state and local auditors, NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Fort Worth, Texas That the Texas Municipal League is urged to support the passage of a bill amending Texas Tax Code Section 111 006 to allow State and local auditors to share hotel financial information for the purposes of ascertaining compliance with the taxes imposed under Chapter 156 of the Tax Code Adopted this ~~ day of August, 1994 APPROVED ciT~ caun~co~.
