HomeMy WebLinkAboutContract 27058 1 , • CITY SECRETARY CONTRACT NO. .22f2 THE STATE OF TEXAS KNOW ALL BY THESE PRESENTS COUNTY OF TARRANT INTERLOCAL AGREEMENT BETWEEN THE CITY OF FORT WORTH, TEXAS AND COUNTY OF TARRANT, TEXAS LOCAL LAW ENFORCEMENT BLOCK GRANT FUND This Agreement is made and entered into this day of , 2001, by and between the COUNTY OF TARRANT, acting herein by and through its governing body, the Commissioners Court, hereinafter referred to as COUNTY and the CITY OF FORT WORTH, acting herein by and through its governing body, the City Council, hereinafter referred to as CITY, both of Tarrant County, State of Texas, witnesseth: WHEREAS, this Agreement is made under the authority of Sections 791.001 - 791.029, Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the performance of this Agreement is in the common interest of both parties, that the undertaking will benefit the public and that the division of costs fairly compensates the performing party for the services or functions under this agreement; and WHEREAS, the CITY agrees to provide Tarrant County $162,804.00 from the Local Law Enforcement Block Grant Fund and grant matching funds for the Tarrant County Adult Drug Court: and WHEREAS, the CITY agrees to provide Tarrant County $40,000 from "other sources" for the Tarrant County Mental Health Liaison Program; and WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate the Local Law Enforcement Block Grant funds; NOW THEREFORE, the COUNTY and CITY agree as follows: Section 1. CITY agrees to pay COUNTY $202,804.00 with $162,804.00 coming from the Local Law Enforcement Block Grant Fund and grant matching funds and $40,000.00 coming from "other sources." Section 2. COUNTY agrees to use $162,804.00 for the Tarrant County Adult Drug Court until September 30, 2003 and $40,000 for the continued operation of the Tarrant County Mental Health Liaison Pro-ram. _ �v��II ylM�r�r�uM'L5W7fUlh`Y Page 1 R Section 3. Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY other than claims for which liability may be imposed by the Texas Tort Claims Act. Section 4. Nothing in the performance of this Agreement shall impose any liability for claims against CITY other than claims for which liability may be imposed by the Texas Tort Claims Act. Section 5. Each party to this agreement will be responsible for its own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing of those services by the other party. Section 6 The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement Section 7. By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. Authorize the City Manager to enter into a funding agreement with Tarrant County on the 2001 Local Law Enforcement Block Grant; and 2. Approve contracts with Tarrant County in the amount of $162,804 for support of the Adult Drug Treatment Court and for continuation of the Mental Health Liaison Program for $40,000. DISCUSSION: During the FY2001 Local Law Enforcement Block Grant application process, Texas Attorney General John Cornyn sent a letter to the U.S. Department of Justice certifying that there was a funding disparity between a number of counties and cities within Texas. The cities of Fort Worth and Arlington were certified due to the fact that more than 50% of the cost of prosecution and incarceration of violent Part I crime offenders is borne by Tarrant County, and Fort Worth and Arlington both receive 200% more Local Law Enforcement Block Grant Funds than Tarrant County. Legislation governing disparity requires certified agencies to aggregate their funds and develop a joint application. The legislation does not speak to the contents of the joint application, or how the funds should be divided. To this end, representatives of Fort Worth, Tarrant County, and Arlington met to develop a plan acceptable to all parties. The plan contains the following: a) Tarrant County has agreed to waive the classification as a "disparate jurisdiction" for the current year funding, thus negating the certification process; and b) Each entity will submit separate grant applications; and c) Each entity will contribute the cash match independently; and d) Arlington will contract with Tarrant County to provide $74,897 from Local Law Enforcement Block Grant funds for the Tarrant County Adult Drug Treatment Court ($40,897), and the Mental Health Liaison Program ($34,000); and e) Fort Worth will contract with Tarrant County to provide $162,804 from Local Law Enforcement Block Grant funds for the Tarrant County Adult Drug Treatment Court, and $40,000 from Federal Awarded Assets for the Mental Health Liaison Program. Fort Worth has provided funds to Tarrant County for the adult and juvenile drug treatment courts in previous grants. FY2001, funding of the Local Law Enforcement Block Grant Program for Fort Worth includes $1,138,517 in federal funds with a required $126,502 in cash match, for a total of $1,265,019. The remaining funds will be primarily for the Comin' Up Program. The application period is June 22, 2001, through July 25, 2001, with grant awards estimated to be awarded in the latter part of October 2001. Transfer of funds to Tarrant County is subject to a grant award from the U.S. Department of Justice. Santonastasso Director of State and Local Assistance Bureau of Justice Assistance 8107"' St.NW Washington, D.C. 20531 Dear Ms. Santonastasso: On May 14, 2001, the State Attorney General certified Tarrant County as a "disparate jurisdiction" under the Local Law Enforcement Block Grant (LLEBG) program. The Attorney General limited the funding disparity issue to the cities of Fort Worth and Arlington and excluded the remaining Tarrant County cities from the certification process. As a result of this certification, the County and the cities of Fort Worth and Arlington discussed strategies for a collaborative effort to share the LLEBG funds. Tarrant County Government, the City of Arlington and the City of Fort Worth are eligible for $1,734,429. Fort Worth is eligible to receive$1,138,517,Arlington $564,579 and Tarrant County$31,333. Tarrant County and the cities of Fort Worth and Arlington have agreed to follow the same process as 2000 with program changes. Therefore,Tarrant County has agreed to-waive the classification as a "disparate jurisdiction" for the current funding year negating the certification process based on the following terms: • Each entity will submit separate grant applications (excluding cash match): Fort Worth—$1,138,517; Arlington—$564,579;and Tarrant County-$31,333. • Each entity will contribute the cash match associated with the allotment amount independently; • An interlocal agreement will be developed between Tarrant County and the City of Arlington for$74,897 of the LLEBG funds(including cash match); and • An interlocal agreement will be developed between Tarrant County and the City of Fort Worth for $162,804 of the LLEBG funds (including cash match) and $40,000 from other sources. Tart"ant.,County js eligible for$31,333 of LLEBG funds with a cash match of$3,481 that equates `to $34,814. These funds will be earmarked for the Tarrant County Adult Drug Court Program. The negotiated LLEBG funding from the cities of Fort Worth and Arlington will also support the Adult Drug','Court program in the amount of $203,701 (cash match included). The City of Fort Worth provides $40,000 from other sources to support the Mental Health Liaison Program. Please refer to the attached program overview for further clarification.
