HomeMy WebLinkAboutOrdinance 23135-03-2018 Ordinance No. 23135-03-2018 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL FUND IN THE AMOUNT OF$1,108,252.00, FROM AVAILABLE FUNDS, FOR THE COMBINED KIMBO ROAD IMPROVEMENTS PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Fund in the amount of $1,108,252.00, from available funds, for the combined Kimbo Road improvements project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. MON V, 0 0 0 City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 3/612018 Ordinance Nos. 23135-03-2018 & 2313—03- 2018 DATE: Tuesday, March 6, 2018 REFERENCE NO.: C-28615 LOG NAME: 20KIMBO ROAD IMPROVEMENTS CONATSER CONSTRUCTION SUBJECT: Authorize Execution of Contract with Conatser Construction TX, LP, in the Amount of$4,982,326.00 for Kimbo Road, Combined Street Paving Improvements, Water/Sanitary Sewer Main and Storm Water Improvements and Adopt Appropriation Ordinances (2014 Bond Program) (COUNCIL DISTRICT 4) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinances increasing estimated receipts and appropriations in the Water Capital Fund in the amount of$1,108,252.00 from available funds and in the Sewer Capital Fund - Legacy in the amount of$1,189,407.00 from available funds; 2. Authorize the transfer in the amount of$1,090,814.00 from City Project No. C01871 Kimbo Court Drainage Improvements to City Project No. CO2661 Kimbo Road project for construction, contingency, material testing and staff related charges of which $ 53,874.70 is coming from Stormwater Capital Projects Bond Fund and $1,036,939.30 is coming from Stormwater Capital Projects Fund; and 3. Authorize execution of a contract with Conatser Construction TX, LP, in the amount of$4,982,326.00 for Kimbo Road, Combined Street Paving Improvements, Water/Sanitary Sewer Main and Storm Water Improvements (City Project No. 02661). DISCUSSION: This Mayor and Council Communication (M&C) is to authorize a construction contract on Kimbo Road from N. Sylvania to Mesquite Road for street reconstruction, water and sanitary sewer main replacement, stormwater improvements and appropriate project funds. The Transportation and Public Works Department's share of this contract will be $3,115,278.00 of which $300,000.00 is available in the 2008 Bond Program Residuals Fund, $1,915,823.00 in the 2014 Bond Program Funds and $899,455.00 in the Stormwater Capital Projects Fund upon approval of the recommendations in this M&C. The Water Department's share on this contract will be $1,687,048.00 of which is $921,815.00 will be available in the Water Capital Fund and $945,233.00 in the Sewer Capital Fund - Legacy upon approval of the recommendations in this M&C. The project was advertised for bid on November 2, 2017 and November 9, 2017 in the Fort Worth Star-Telegram. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund, in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 21241-05-2014) and subsequent actions taken by the Mayor and Council. In addition to the contract amount, $760,179.00 (Water: $140,346.00; Sewer: $196,912.00; Paving: $276,535.00; Storm Water: $146,386.00) is required for real property acquisitions project management, engineering, material testing and inspection and $226,959.00 (Water: $46,091.00; Sewer: $47,262.00; Paving: $88,633.00; Storm Water: $44,973.00) is provided for project contingencies. The sanitary sewer component of this project is part of the Water Department's Sanitary Sewer Overflow Initiative Program. This project will have no impact on the Transportation and Public Works' annual operation budget nor on the Water Department's operating budget when completed. Construction is expected to start in April 2018 and be completed by October 2019. M/WBE OFFICE— Conatser Construction TX, LP, is in compliance with the City's BDE Ordinance by committing to seven percent MBE participation and documenting good faith effort. Conatser Construction TX, LP, identified several subcontracting and supplier opportunities. However, the MBE's contacted in the areas identified did not submit the lowest bids. The City's MBE goal on this project is 17 percent. The project is located in COUNCIL DISTRICT 4. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget as appropriated of the 2008 Bond Program Residuals and the 2014 Bond Program Funds. In addition, upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, of the Stormwater Capital Projects Fund, Water Capital Fund and Sewer Capital Fund-Legacy. The Fiscal Year 2018 Water Operating Budget includes appropriations of$29,069,236.00 for the purpose of providing Pay-As—You-Go funding for Water Capital Projects. After this transfer for Fiscal Year 2018, the balance will be $15,794,486.00. The Fiscal Year 2018 Water Operating Budget includes appropriations of$29,022,689.00 for the purpose of providing Pay-As-You-Go funding for Sewer Capital Projects. After this transfer for Fiscal Year 2018, the balance will be $13,922,295.00.
