COUNTY OF TARRANT $
WHEREAS, the City of Fort Worth (City) and Wade & Associates,
(Engineer) made and entered into City Secretary Contract No. 22266,
(the Contract) which was authorized by the City Council by M&C
15708 on the 15th day of October 1996; and subsequently revised by
three previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Sanitary Sewer Main
C1C4B Drainage Area Sanitary Sewer Evaluation Study and
Improvements (Group 6, Contract 2) .
WHEREAS, it has become necessary to execute Amendment No. 4 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated March 13,
2001 , a copy of which is attached hereto and incorporated herein.
The cost to City for the additional design services to be performed
by Engineer total $10,163.27 .
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $1,228,237.77.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Sanitary Sewer System Rehabilitation and Improvements Project, Group 6,

Dear Mr. Boyer:
We are submitting this contract amendment for your immediate consideration and
approval. This amendment reflects a number of extra services provided on the above-
referenced design projects.
More specifically, we are seeking to recover costs for the removal of M-CIC413, Part 8,
Unit 3, from the original set of Part 8 bid documents, so that Units 1 and 2 could be bid
separately. The information below also includes costs incurred in the initial production of
a Part 14, set of contract documents. Part 14 was comprised of Part 8, Unit 3, and Part 12,
Unit 3 as a set of bid documents. Due to easement acquisition delays, we were asked to
split up Part 14 so that Part 12, Unit 3 could be advertised separately which was done late
last year. Please see the cost-related information in the table below:

In addition, we have incorporated an amendment request to recover costs associated with
resolving the 8`h Ave. sanitary sewer problem in late January. As a reminder, this situation
arose during the construction of M-32 in 8`h Ave. on the section that we designed located
south of Arlington and 8h Ave. This design segment was incorporated into the Halff &
Associates project because Halff s project replaced M-32 upstream of our project area.

Mr. Domenech requested us to get involved in solving this construction problem in late
January. Essentially the problem was defined by excess subsurface water entering the
trench and preventing trench compaction from meeting specifications. We developed a
viable solution to this problem after reviewing other options presented by a geotechnical
engineer, CMJ Engineering, Inc., who was retained by either the City or by Halff. On
January 25, 2001, we delivered a letter report and plan sheet addressing the sub-surface
drainage problem to Mr. Domenech. This solution has been implemented by the
contractor. We were asked by Mr. Domenech to incorporate CiV1J's costs into our contract
invoice. Therefore, their time-sensitive costs are incorporated in this amendment request
described in the following table:

In summary, WADE is seeking to only reco6er actual expenses that have been incurred for
this project. Therefore, we are requesting Contract Amendment No. 4 for the M-C1C4B
Agreement in the amount of $ 10,14337. This amendment would increase the total
contract less than one percent from an amount of $1,218,074.40 to 1,228,237.77. Please
advise us immediately if there is a problem with this request. Thank you for your time and
