(25 STATE STATE OF TEXAS § COUNTY OF TEXAS § CITY SECRETARY CONTRACT NO. 26491 WHEREAS, the City of Fort Worth ("City") and Huitt-Zollars, Inc. ("Consultant") made and entered into City of Fort Worth City Secretary Contract No. 26491 , ("Contract"); and WHEREAS, the Contract involves professional services for the following project: West Community Park Development Phase One and WHEREAS, it has become necessary to amend the Contract to include an increased scope of work and/or revised maximum fee. NOW, THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the contract: 1. Article I , Section A of the Contract is amended to include the additional engineering services specified in a letter dated May 9, 2001, a copy of which is attached hereto and incorporated herein. 2. Article II of the Contract is amended to provide for an increase in the maximum fee in the amount of$ 9,517.20, which is to be paid to Consultant for all work and services under the Contract, as amended, so that the total fee to be paid by City for all work and services shall not exceed the sum of$ $127,017.20. 3. As you requested, this letter outlines the additional fees required to complete the project in two stages. The first stage is to develop the drawings in the park area proper, and second for the area within the R.O.W. associated with the proposed entry drive. 1. Wendy Lopez& Associates, our Survey consultant for the topography portion of the work, has indicated that they will need an additional $800.00 of labor to re- establish control points and schedule two separate surveying efforts to provide surveying of the site in two stages. Terra-Mar, Inc.,the Geotechnical consultant, has indicated that it will require an additional $795.00 of labor to drill on two separate occasions and to produce two separate reports to complete their scope of work. 2. Huitt-Zollars, Inc., will provide field staking of the approximate location of the centerline of the proposed entry drive utilizing a GPS system. We require an additional $360.00 to perform this service. 3. Huitt-Zollars, Inc., will prepare a R.O.W. dedication Plat for the dedication of the R.O.W. for the proposed entry road from Loop 820 service road to the proposed parking area adjacent to the proposed soccer fields. Expenses include such items as all known and customary review and permit fees, reproduction costs, mileage, fax, Xerox copies, photographic costs, deliveries, plotting, etc. Reimbursable expenses will be paid for at cost. FOR IMPROVEMENTS AT WEST COMMUNITY PARK RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute a professional services agreement with Huitt-Zollars, Inc. in the amount of $117,500 for the design and preparation of construction documents for 4 soccer fields, an entry road, utilities, and a 120-car parking lot at West Community Park. DISCUSSION: On July 6, 1999 (M&C G-12601), the City Council authorized the reprogramming of $500,000 from the 1986 Capital Improvement Program (CIP) designated for acquisition of a large community park in the western area of Fort Worth for use as development funds for the West Community Park. Additionally, the 1998 CIP appropriated $200,000 toward the development of the West Community Park. It was determined that the old Rifle and Pistol Club site on Silver Creek Road was suitable for recreational development as the West Community Park. In order to determine the actual configuration and recreational opportunities, on December 21, 1999 (M&C C-17799), the City Council authorized the execution of a professional services agreement with Huitt-Zollars, Inc. in the amount of $45,000 for the West Community Park master plan development. Public meetings were held on January 24, May 15, and May 25, 2000 to receive public input and review the master plan development. On September 19, 2000, the final master plan concept was endorsed by the Parks and Community Services Park Board. Huitt-Zollars, Inc. has proposed to perform the design work for a lump sum of $117,500. Huitt-Zollars, Inc. will prepare construction documents based on the master plan they have previously prepared. Staff considers this fee to be fair and reasonable for the scope of services proposed. Huitt-Zollars, Inc. is in compliance with the City's M/WBE Ordinance by committing to 20% M/WBE participation. The City's goal on this project is 18%. This project is located in COUNCIL DISTRICT 7.
