STATE OF TEXAS § CITY SECRETARY CONTRACT NO. 24832 COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Camp Dresser &McKee Inc., (Engineer)made and entered into City Secretary Contract No. 24832, (the Contract) which was authorized by the City Council by M&C C-18275 on the l Och day of October, 2000; and WHEREAS, the Contract involves engineering services for the following project: Cantrell-Sansom Pump Station and Associated Pipelines and Northside/Ground Storage Reservoir Project, Project Number PW77- 060770160160. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, Attachment"A" of the Contract is amended to include the following additional engineering services: Modify Attachment"A-I"to include the following new paragraph. 5. CERTIFICATE OF CONVENIENCE AND NECESSITY 5.1 Engineer will provide professional engineering services in support of the City's application to the Texas Natural Resource Conservation Commission(TNRCC)to amend its Certificate of Convenience and Necessity (CCN) for the provision of water service. Engineer will consult with and support the City in the development of cost- competitive water service strategies, will provide water distribution system modeling analysis to evaluate improvements to serve the area, will provide expert witness testimony before the TNRCC in support of the CCN application, and will provide general consulting assistance in support of the City's initiative. s G���0RD 2. Article 11,Attachment "B" of the Contract is amended to provide for an increase in the maximum fee to be paid to the Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$850,415. The cost to City for these additional services to be performed by Engineer total seventy five thousand dollars ($75,000.00). The attached "Amendment No. 1: Exhibit `B-3A""replaces "Exhibit "B-3"in the original agreement. The attached "Amendment No. 1:Exhibit `B-4A"" supplements Exhibit `B-4" in the original agreement. 3. This contract amendment provides for services that are unique to the qualifications and experiences of the Engineer and, as such,no additional Minority and Woman Business Enterprise (M/WBE) Participation goals are established for this work. 4. All other provisions of the contract, which are not expressly amended herein, shall remain in full force and effect. FOR THE CANTRELL-SANSOM PUMP STATION AND ASSOCIATED PIPELINES AND THE NORTHSIDE GROUND STORAGE RESERVOIR RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to the engineering agreement with Camp Dresser & McKee, Inc. (City Secretary Contract No. 24832) for the Cantrell-Sansom Pump Station and Associated Pipelines, and the Northside Ground Storage Reservoir, increasing the total fee by $75,000 from $775,415 to $850,415. DISCUSSION: On March 16, 1999 (M&C C-17322), the City Council authorized the execution of an agreement with Camp Dresser & McKee, Inc. for engineering services for the Cantrell-Sansom Pump Station and Associated Pipelines, and the Northside Ground Storage Reservoir. This agreement included a study of the transfer of water from other pressure planes into the Northside II/III pressure planes to meet future demands. The project required distribution system modeling, developing required water transmission main sizing, alignment and pump station improvements, and preparing construction plans and specifications for the recommended improvements. Amendment No. 1 will provide for the development of competitive water service strategies, water distribution system modeling and consultant support for a City annexation task team to enable the Water Department to competitively deliver water service to land development projects within the City's extraterritorial jurisdiction. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the Commercial Paper-Water Fund.
