HomeMy WebLinkAboutResolution 1894~'. r ::y ~.; ;~ C _.i .. .~ . + "" 17 JOINT RESOLUTION AND AGREEMENT NO. ~~ ~~ ,~' ~ STATE OF TEXAS § ~soLU:toN rto./;~ § KNOW ALL MEN~BY THESE PRESENTS COUNTY OF TARRANT § WHEREAS, the City of Fort Worth is a home-rule city lying and being situated within the Counties of Tarrant and Denton, State of Texas; and WHEREAS, the Town of Flower Mound is a home-rule city lying and being situated within the County of Denton, State of Texas; and WHEREAS, the City of Fort Worth and the Town of Flower Mound desire to adjust their extraterritorial jurisdiction boundary lines, whereby the City of Fort Worth will release from the area described herein whatever extraterritorial jurisdiction it has or may have in the said described area; NOW, THEREFORE, BE IT RESOLVED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH AND THE TOWN COUNCIL OF THE TOWN OF FLOWER MOUND: SECTION 1. THAT the following extraterritorial jurisdiction boundary realignment between the City of Fort Worth and the Town of Flower Mound, as hereby described., is in the best interests of the property owners and inhabitants of both cities. SECTION 2. THAT the City of Fort Worth does hereby relinquish all extraterritorial jurisdictional rights it has or may have in that territory reflected on Map Exhibit "A", attached hereto and made a part hereof, and described by metes and bounds as follows: LEGAL DESCRIPTION . Being all that certain lot, tract or parcel of land situated in the P. W. Casparry Survey, Abstract No. 277; the BBB & CRR Survey, Abstract No. 154; the B. Wheeler Survey, Abstract No. 1605; and the MEP & PRR Survey, Abstract No. 922 in Denton County, Texas and being a one thousand (1,000') foot wide strip, said strip being five hundred (500') feet, at right angles, ~- either side of the centerline of F.M. 1171 and the centerline of U. S. M. 1171 CENTERLINE BEGINNING at a point in the centerline of F. M. 1171 at the existing Corporate Limits of the Town of Flower Mound, Texas, said point being located at centerline Station 77 + 29 on F. M. 1171; Thence North 73 degrees 27 minutes 54 seconds West, 1985 feet, along the centerline of F. M. 1171 to a point in the centerline of U. S. Highway 377; THENCE North 73 degrees 65 minutes 63 seconds West, 186.23 feet along the centerline of F. M. 1171 to the beginning..of a curve to the right; THENCE along said curve to the right and said centerline, said curve having central angle of 24 degrees 44 minutes 20 seconds, a tangent of 314.13 feet and an arc length of 618.47 feet, to the end of said curve; THENCE North 48 degrees 41 minutes 03 seconds West, 927.63 feet along the centerline of F. M. 1171 to the beginning of a curve to the left; THENCE along the centerline of F. M. 1171 and along • said curve to the left having a central angle of 21 degrees 46 minutes 59 seconds, a tangent of 275.61 feet and an arc length of 544.58 feet to a point for the end of said curve; THENCE North 70 degrees 28 minutes 08 seconds West, 165.88 .feet along the centerline of F. M. 1171 to a point on said centerline at the centerline of the existing Texas & Pacific Railway Company railroad, and containing approximately 101.65 acres of land within the above described 1,000 foot-wide strip. TRACT 2 U. S. 377 CENTERLINE BEGINNING at a point in the centerline of U. S . Highway 377, said point being approximately North 16 degrees 34 minutes East, 500 feet from the centerline of F. M. 1171; • THENCE northerly along the centerline of U. S. Highway 377, 2687.0 feet to the approximate centerline station of 608 + 82 to the point of ending of the centerline description of a 1,000 foot-wide strip and containing approximately 61.7 acres of land. 2 C SECTION 3. THAT the City of Fort Worth and the Town of Flower Mound agree that nothing herein shall constitute a warranty or guarantee-by the City of Fort Worth as to its extraterritorial jurisdictional rights in the area released hereunder; specifically, the City of Fort Worth is releasing whatever jurisdictional rights it has or may have in the described area, and does not warrant or guarantee the jurisdictional rights released hereunder as against any claim by any other governmental entity, whether such claim is founded or unfounded. SECTION 4. THAT the City of Fort Worth and Town of Flower Mound hereby agree that upon the release by the City of Fort Worth of the extraterritorial jurisdiction described herein, the Town of Flower Mound may initiate the annexation of said area; and the Town of Flower Mound agrees to assume the rights and obligations appurtenant to said property upon completion of said annexation. SECTION 5. THAT the Town of Flower Mound agrees that at such time as it annexes territory within the extraterritorial jurisdiction released hereunder, the extraterritorial jurisdiction of the Town of Flower • Mound will not be expanded by reason.of such annexation. SECTION 6. THAT THIS JOINT RESOLUTION AND AGREEMENT shall become effective and shall become a binding agreement upon the City of Fort Worth and the Town of Flower Mound by the adoption of same in regular open City Council meeting of the City of Fort Worth and the Town of Flower Mound. SECTION 7.
