Home My WebLink AboutContract 49449-A1 AMENDMENT NO. 1 TO RECOMMUNITY FACILITIES AGREEMENT CENE� OF FORT WORTH CITY S RETARY HE S E OF TEXAS § CITY SECRETARY CONTRACT NO. 49449-A1 4 C TY OF TARRANT § WHEREAS, the City of Fort Worth ("City") and Quail Valley Devco 1, LLC ("Developer") entered into a Community Facilities Agreement, City Secretary Contract No. 48422 ("CFA"), wherein Developer is to make certain improvements related to a project generally described as Walsh Ranch Quail Valley Phase 1C On-Site ("Project"); and WHEREAS,the Project includes the construction of water, sewer, paving, storm drain, street light and sign improvements; and WHEREAS, the Developer requested and the City agreed to authorize the removal of a portion of the paving and all of the street lights from the CFA in order to construct those improvements pursuant to a separate Community Facilities Agreement and to make changes to the remaining public improvements to be construction under City Secretary Contract No.48422 through the execution of City Secretary Contract No. 48422-A1; and WHEREAS, the Developer and the City executed City Secretary Contract No. 49449 for the construction of the paving and street light improvements that were removed from City Secretary Contract No. 48422; and WHEREAS, the Developer has requested a revision to the improvements that will be constructed under City Secretary Contract No.49449 and City staff has verified that the changes to the improvements are in accordance with the City's Policy for the Installation of Community Facilities; and WHEREAS,Developer will deliver to the City an additional financial guarantee for the increased cost of the improvements being constructed pursuant to this Amendment. NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends City Secretary Contract No. 49449: 1.
