HomeMy WebLinkAboutContract 47353-A3 AMENDMENT NO. 3 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES 5, COMMUNITY CENTERS EXPANSION PROJECT �p (Eugene McCray &Handley-Meadowbrook Community Centers Expansion) 2 STATE OF TEXAS _ CITY SECRETARY CONTRACT NO. - A3 COUNTY OF TARRANT WHEREAS, The City of Fort Worth ("City") and GSBS Batenh'orst, Inc. ("Architect") made and entered into City Secretary Contract No. 47353 (the Contract) which was authorized by the City Council by M&C C-27564, the 15th day of December, 2015, for Eugene McCray Community Center Expansion & Handley-Meadowbrook Community Center Expansion; and Amendments No. 1 & 2 were administratively executed in the total amount of $64,823.00 to perform the Hand ley-Meadowbrook plat submittal's iSWM report & to revise approved schematic design plans, respectively; and WHEREAS, further amendment is necessary to reimburse the Architect as part of the design services agreement for additional design services for both the Eugene McCray & Hand ley-Meadowbrook Community Centers to modify previously approved civil, landscaping, irrigation, electrical and architectural construction plans as a result of parking lot downsizing at both Centers. NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, (6) - Scope of Services, a paragraph shall be added to read as follows: Provide additional design services to revise the currently approved construction plans for the Eugene McCray & Handley-Meadowbrook Community Centers Expansion. The cost of this additional service is $5,855.00 and $5,805.00, respectively, with no additional reimbursable expenses. The scope of services is described more fully in GSBS's letter, Attachment "F" dated February 12, 2018(Rev.3/15/18), subject: "Re: Parking revisions at Hand ley-Meadowbrook and Eugene McCray Community Centers"; and in addition, PARD `s email with special instruction, Attachment "G" dated March 12, 2018, subject: "Re: Eugene McCray and Hand ley/Mead owbrook Parking Changes". 2. Article II, (1) - Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "F". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "F". However the total fee paid by the City shall not exceed a total of $254,183.00 which includes $10,000.00 for reimbursable expenses, unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this AgreemEFT.W0RT7H,TX D Amendment No.3 Y Page 1 of 2 Eugene McCray&Hand ley-Meadowbrook Community Centers Expansion March 2018 3. From the time that we had our DRC meeting with the city of Fort Worth, we have complied with the codes and ordinances of the City of Fort Worth. It was unusual that after receiving the first building permit review, the city was questioning the parking counts provided on the drawings. At first, their concentration was on the whole building while they were requesting the assembly areas and needing a count of the occupancies of such spaces. This was a direct reference of the city off-street parking requirements (Article 6.201) stating place of public assembly requiring the 1 space for 4 seats plus 5 spaces per 1,000 SF addition plus 1 space per 4 employees. GSBS complied with Article 6.201 for the parking requirements on both sites. Subsequently, the Parks Board decided to contest Article 6.201 and won on the ruling and from our meeting with on February 7, 2018 the City of Fort Worth will enforce more strictly, Article 6.201 in the future. GSBS complied this way with Article 6.201. We have the following items to address to proceed with the required design for the change. Handley/Meadowbrook Community Center 1. The new sidewalk leading from the existing curb cut at the intersection of Haynie and Beaty streets must be at least accessible to the building (may require switchback to meet required accessible slopes). The previous design along Haynie Street followed the curb and was not required to be accessible when connected to the roadway curb but was accessible once it left the curb face. 2. Presume that the alternate sidewalk along Beaty Street will not be built. Likewise, it followed the curb and was not required to be accessible when connected to the roadway curb but was accessible once it left the curb. 3. Dumpster screen: The new location shown on the attached plan will not allow appropriate maneuvering for the truck to service this facility. We propose another location for consideration: Location one; The dumpster enclosure will most likely be relocated at.he end of the parking aisle one the east side of the building. This location will conflict with the fire-line water and domestic water 4. Urban Forestry: Urban Forestry will be required to be recalculated based on revised parking areas and existing canopy retained.. S. Landscape: Planting arrangements will be modified according to new layout of paved areas.. 6. Irrigation: At least temporary Irrigation will be required for establishment of disturbed areas and required plantings. A revision of the irrigation plan will be required for the newly established areas of modification. 7. Civil: A new parking layout and grading plan will be developed utilizing the new sidewalk and parking layout and calculations of grading for accessibility. Site utilities will be modified to accommodate the new dumpster screen. Changes to the following sheets are required: Demo plan, Paving plan, Grading plan, Proposed Drainage Area Map, Utility plan, Erosion Control plan, Private Details 11. Changes are included for the final iSWIM, 8. Electrical: The site lighting plan will be modified for the new parking layout. Eugene McCray Community Center 1. Original design held the parking away from the original building plan for any future additions. Per the conversation yesterday, it was decided to move the parking to the west face of the building and relocate parking if expansion happens in the future. 2. Dumpster screen: The new location shown on the attached plan will not allow appropriate maneuvering for the truck to service this facility. We propose 1 other location for consideration: The dumpster enclosure will most likely be relocated at the end of the parking aisle one the west side of the building. I believe this location will not conflict with the existing building set back line. we will need to adjust the parking layout for an appropriate turning radius into the parking aisle. 3. Urban Forestry: Urban Forestry will be required to be recalculated based on revised parking areas. 4. Landscape: Planting arrangements will be modified according to new layout of paved areas. 5. Irrigation: At least temporary irrigation will be required for establishment of disturbed areas and required plantings. A revision of the irrigation performance plan will be required for the newly established areas of modification. 6. Civil: A new parking layout and grading plan will be developed utilizing the new sidewalk and parking layout and calculations of grading for accessibility. Site utilities will be modified to accommodate the new dumpster screen. Changes to the following sheets are required: Demo plan, Paving plan, Grading plan, Utility plan, Erosion Control plan. GSBS feels we complied completely with the requirements of Article 6.201 in the design of the facilities and seek compensation for the changes in the documents to meet the Parks Board requirements of reducing the parking counts. GSBS has limited capabilities in the evaluations of Urban Forestry during the time period of 3/12 thru 3/15 so this could delay slightly. If given the approval to proceed we would provide you the documents in Change Order format for the project so the Work change could be incorporated for the contractor.
