ARTICLES OF AGREEMENT
THIS AGREEMENT, ("Agreement") is entered into by and between the City of Fort
Worth, a home-rule municipal corporation situated in Tarrant, Denton and Wise counties, Texas,
located at 1000 Throckmorton Street, Fort Worth, Texas, hereinafter referred to as the"City;"
AND
MAXIMUS, Justice Solutions Division, a Virginia corporation with its principal offices located at
5399 Lauby Road, Suite 200, North Canton, Ohio, hereinafter referred to as "Company."
RECITALS
WHEREAS, Company is experienced in the implementation and support of data processing
systems and CourtView®application software, hereinafter referred to as "Systems;" and
WHEREAS, pursuant to City Secretary Contract ("CSC") No. 29707, Company has provided the
City with Systems as described in Schedule A of this Agreement; and
WHEREAS, Company offers ongoing support services to the City; and
WHEREAS,the City desires to utilize said services; and
NOW,THEREFORE,the parties agree as follows:
DEFINITIONS
City shall mean all employees, officials, agents, representatives, or servants of the City of Fort
Worth.
Company shall mean all employees, officers, directors, agents, representatives, contractors, and
subcontractors that provide services to the City pursuant to this Agreement.
System shall mean all software and hardware created by or for the City to be utilized under this
Agreement.
1. SERVICES TO BE PROVIDED
Company shall provide application software support services to the City more specifically
described in Schedule B of this Agreement.
2. TERM
This Agreement shall commence on January 1, 2007 and expire on December 31, 2011
("Initial Term"), for the following software application systems:

2) Judicial Management Module
3) Financial Management Module
4) Accounts Receivable Module
5) Web-based Public Access Module
Both parties understand, acknowledge and agree that Imaging and workflow are a part of the
Case Management Product. The product also includes the interfaces to the DAISI IVR;
however, MAXIMUS is not responsible for the operation or function of that third party
software product that is provided by City.
This agreement may be renewed, as provided in Section 25 herein.
3. COMPENSATION
In consideration of the performance of support services as set forth in this Agreement,
Company shall receive an annual fee for a total amount not to exceed Ninety Three
Thousand Three Hundred and 001100 dollars ($93,300.00) each year. City will make
quarterly payments as listed below due forty-five(45) days after the invoice.
Quarterly Payment $ 23,325.00
MAXIMUS shall, after the initial term of this Agreement, have the right to increase the Annual
Software Support Fees for any subsequent Renewal Periods, subject to the condition that
MAXIMUS shall provide the City with at least sixty (60) days' prior written notice of any such
increase. Further, in no event shall any subsequent annual increases exceed the lesser of:
(i) five percent (5%) of the Annual Software Support Fees for the then current support period;
or (ii) the cumulative percentage increase, if any, based on the local Consumer Price Index
as published by the Bureau of Labor Statistics, United States Department of Labor, for the
preceding twelve (12) month period.
Additional services requested by the City shall be provided under the provisions of and
invoiced in accordance with the time and materials rates contained in Schedule C of this
Agreement.
Payment of invoices is due within forty-five (45) days of the date of each billing. Failure of the
City to make payment when due, providing there is no dispute with regard to the amount of
billing or service(s) provided, shall entitle Company to suspend further performance of this
Agreement without liability. Company shall provide the City with thirty (30) days notice of its
intent to suspend performance for failure to make payment, and the City shall have an
opportunity to cure within said time. When payment of invoices is current, performance of
this agreement for software support shall be restored.
4. CONTRACT DOCUMENTS

All documents as outlined in this Section 4 are attached hereto and incorporated into this
Agreement for all purposes. If there is a conflict between any of the attachments and this
Agreement, this Agreement controls. If there is any conflict between this Agreement and CSC
No. 29707, then CSC No. 29707 controls.
5. ENTIRE AGREEMENT
This Agreement, together with all documents referenced herein, comprise the complete and
entire agreement between the parties and may not be altered or amended except as agreed
to in writing by both parties, making specific references to the provision to be altered or
amended. Any such writing altering or amending the agreement between parties must be
executed by a duly authorized official of the City and by a duly authorized officer of Company.
6. CITY RESPONSIBILITIES
The City shall support and assist Company in identifying and clarifying problems encountered
by the City and shall make available source documents or data files as may be necessary to
isolate or replicate a problem condition.
The City shall provide Company with access to City facilities and the computer equipment as
required in the performance of these tasks described herein, including access after normal
working hours and on weekends. The City shall provide City personnel as necessary to
provide such access or to maintain security of the facility as deemed appropriate by the City.
The City shall, within thirty (30) days of the execution of this Agreement, at its own expense,
grant remote telephone access to the City's computer system through a 56kb or T1 phone
line. Such access shall be subject to and governed by the City's security policy on outside
connections and access to the City's systems as agreed to in the Limited Access Agreement
(LMA) executed on May 24, 2004 and styled as CSC No. 29991.
7. COMPANY RESPONSIBILITIES
Company shall perform in a professional manner in providing services to the City and shall
provide knowledgeable personnel experienced with the software installed at the City's site.
City shall not be required to compensate Company for services provided to the City by
employees or subcontractors of Company, which fail to satisfy the standards set forth herein.
The City reserves the right of rejection on any project personnel provided by Company.
Replacement personnel shall be provided in a timely fashion.
Company shall safeguard any materials provided by the City in the performance of this
Agreement in a manner as prescribed by the City. In lieu of specific guidance from the City,
Company shall take reasonable care as to prevent unauthorized disclosure of the City's
information.

8. INDEPENDENT CONTRACTOR
The relationship of Company to the City shall be that of an independent contractor, and no
principal-agent or employer-employee relationship is created by this Agreement.
9. SUBCONTRACTS
Company reserves the right to subcontract work, as necessary, in the performance of this
Agreement. Company agrees to be responsible for the accuracy, timeliness, and
confidentiality of all work submitted in the fulfillment of its responsibilities under this
Agreement. All the terms of this Agreement shall apply equally to any subcontractors
employed by Company such that use of the term "Company" in this Agreement when
describing a duty of Company to the City shall also mean a duty of "Subcontractors of
Company."
10. OWNERSHIP OF DATA
Data collected is the property of the City. Data used by Company in the services
contemplated herein shall remain the property of the City, and no use shall be made thereof
beyond that listed in this Agreement without the written permission of the City. Company
further agrees that it shall treat all information provided to it by the City as confidential and
shall not disclose any such information to a third party without the prior written approval of
the City. Company shall store and maintain City Information in a secure manner and shall
not allow unauthorized users to access, modify, delete or otherwise corrupt City Information
in any way. Company shall notify the City immediately if the security or integrity of any City
information has been compromised or is believed to have been compromised.
11. OWNERSHIP OF COURTVIEW SOFTWARE AND DESIGNS
All software development, design, documentation, and programs necessary to operate and
maintain the Systems described herein that were produced by Company shall remain the
proprietary property of Company. Restriction of this proprietary property does not limit City
from making such copies of programs, documentation, and Systems-related materials for
internal use. Unless otherwise required by law, rule, regulation, or court order, the City will
not disclose such materials to third parties or other contractors without the express written
consent of Company.
Company Systems are designed as standard products and not as customized systems.
Company recognizes the need for some City customization; however, Company reserves the
right to control the design, performance, and integration of City products and, as a result, may
reject City requests for modifications or enhancements that are inconsistent with Company's
product strategy. However, if such modification or enhancement is, in the City's opinion,
necessary to provide proper functionality of the system, then Company shall work with City to
provide such appropriate enhancement or modification for the City in accordance with the
rates set forth in Schedule C of this Agreement. Any enhancements or modifications that are
necessary under this Agreement shall be covered by all applicable warranties set forth
herein. Rejection of any such request for modification or enhancements by Company does
not forbid or prevent the City from making the requested modification or enhancement with its
own forces or other contractors, bearing in mind the potential loss of warranty, which may
result under Section 12 (C) of this Agreement.

12. WARRANTIES
A. SERVICES
Company warrants that Company shall provide such support services as shall permit
the software to perform in accordance with industry standards and Company
published documentation, and Company further warrants that it shall provide qualified
personnel to perform the support services.
B. SOFTWARE
Company shall only be responsible to correct software defects in or resulting from
software supported during this Agreement as listed in Schedule A which are
submitted to it in writing during the Agreement period. Oral notification or generalized
complaints shall not constitute notice under this Agreement. Company warrants that
it will correct software defects. Software defects shall be defined as failure of the
software to perform functions as identified in documentation supplied by Company.
C. CITY MODIFICATIONS
City shall inform Company in writing of any change to or modification of any of
Company's software which it desires to make or has made. Company is not
responsible for any errors or defects caused by modifications made to Company's
software by the City. Correction of such errors or defects by Company shall be at the
time and materials rates specified in Schedule C.
Company does not guarantee that new releases or versions shall operate as
designed if City has altered Company software.
D. CITY NEGLIGENCE
Company shall not, at any time during the period of this Agreement, be required to
correct any defects in any Company software caused by City's negligence, improper
installation or operation of Company's software.
13. LIABILITY I INDEMNIFICATION
COMPANY COVENANTS AND AGREES HEREBY TO BE LIABLE TO THE CITY AND TO
DEFEND, INDEMNIFY AND HOLD THE CITY, ITS OFFICERS, AGENTS, SERVANTS
AND EMPLOYEES HARMLESS AGAINST ANY CLAIMS, LAWSUITS, OR ACTIONS BY
THIRD PARTIES ARISING UNDER THIS AGREEMENT FOR PROPERTY LOSS,
PROPERTY DAMAGE AND OR PERSONAL INJURY, INCLUDING DEATH, TO ANY
PERSON, TO THE EXENT CAUSED BY THE NEGLIGENT ACT(S), OMISSION(S),
MALFEASANCE OR INTENTIONAL MISCONDUCT OF COMPANY, ITS OFFICERS,
AGENTS, SERVANTS, EMPLOYEES,OR SUBCONTRACTORS.
CITY AGREES THAT COMPANY'S TOTAL LIABILITY TO CITY FOR ANY AND ALL
DAMAGES WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO THIS
AGREEMENT FOR ANY CAUSE, INCLUDING BUT NOT LIMITED TO CONTRACT
LIABILITY OR COMPANY NEGLIGENCE, ERRORS, OMISSIONS, STRICT LIABILITY,
BREACH OF CONTRACT OR BREACH OF WARRANTY SHALL NOT, IN THE
AGGREGATE, EXCEED THE TOTAL AMOUNT OF FEES PAID TO COMPANY UNDER
THIS AGREEMENT.

IN NO EVENT WILL COMPANY BE LIABLE TO THE CITY OR ANY THIRD PARTY FOR
LOSS OF BUSINESS OR PROFITS OR OTHER ECONOMIC LOSS OR FOR ANY
INCIDENTIAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, UNLESS SUCH
DAMAGE IS CAUSED BY THE GROSS NEGLIGENCE, INTENTIONAL OR WILLFUL
MISCONDUCT OR MALFEASANCE OF THE CONTRACTOR, ITS EMPLOYEES,
OFFICERS, AGENTS, OR SUBCONTRACTORS.
14. INSURANCE
(1) Insurance Coverage and Limits:
Company shall provide the City with certificate(s) of insurance documenting policies of
the following coverage at minimum limits that are to be in effect prior to commencement
of work under this Agreement:
Commercial General Liability
$1,000,000 each occurrence
$1,000,000 aggregate
Automobile Liability
$1,000,000 each accident (or reasonably equivalent limits of coverage if
written on a split limits basis). Coverage shall be on any vehicle used by
the Company, its employees, agents, or representatives in the course of
the work performed under this Agreement.
Worker's Compensation
Coverage A: Statutory limits
Coverage B: $100,000 each accident
$500,000 disease—policy limit
$100,000 disease—each employee
Professional Liability
$1,000,000 each claim/annual aggregate
Technology Liability (E&O)
$1,000,000 Each Claim Limit
$1,000,000 Aggregate Limit
Technology coverage may be provided through an endorsement to the
Commercial General Liability(CGL) policy, or a separate policy specific
to Technology E&O. Either is acceptable if coverage meets all other
requirements. Coverage shall be claims-made, and maintained for the
duration of the contractual agreement and for two(2) years following
completion of services provided. An annual certificate of insurance shall
be submitted to the City to evidence coverage.
(2) Certificates of insurance evidencing that the Company has obtained all required insurance
shall be delivered to the City prior to Company proceeding with the work under this
Agreement.
(a) With the exception of Worker's Compensation and Professional Liability, policies
shall be endorsed to name the City as an Additional Primary Insured thereon, as its
interests may appear. The term City shall include its employees, officers, officials,
agents, and volunteers in respect to the contracted services.

(b) Any failure on part of the City to request required insurance documentation shall not
constitute a waiver of the insurance requirements.
(c) A minimum of thirty(30)days notice of cancellation or reduction in limits of coverage
shall be provided to the City. Ten (10) days notice shall be acceptable in the event
of non-payment of premium. Such terms shall be endorsed onto Company's
insurance policies. Notice shall be sent to the Risk Manager, City of Fort Worth,
1000 Throckmorton, Fort Worth, Texas 76102, copy to the City Attorney at the
same address.
(d) Insurers for all policies must be authorized to do business in the state of Texas or be
otherwise approved by the City; and, such insurers shall be acceptable to the City in
terms of their financial strength and solvency.
(e) In lieu of disclosure of Company's deductibles, the City reserves the right to request
a copy of Company's latest audited financial statement or a letter of credit in order to
determine Company's financial capacity. Such financial statements or letters of
credit must be acceptable to the City.
(f) The general liability, automobile liability and worker's compensation policies shall
each be endorsed with a waiver of subrogation in favor of the City as respects the
work performed under this Agreement.
(g) The City shall be entitled, upon its request and without incurring expense, to review
the Company's insurance declaration page(s) including endorsements thereto and,
at the City's discretion, the Company may be required to provide proof of insurance
premium payments.
(h) The Commercial General Liability insurance policy shall have no exclusions by
endorsement that would otherwise change the City's insurable interest or coverage.
(i) In lieu of tail coverage, should a malfunction, system failure, or an incident that may
give rise to a claim occur, the Company shall report the incident to their insurance
carrier during the policy period.
(�) The City shall not be responsible for the direct payment of any insurance premiums
required by this Agreement. It is understood that insurance cost is an allowable
component of Company's overhead.
(k) Subcontractors to the Company shall be required to maintain the same insurance
as is maintained by Company or a reasonable equivalent. Company shall provide
City with documentation thereof on a certificate of insurance. Notwithstanding
anything to the contrary contained herein, in the event a subcontractor's insurance
coverage is canceled or terminated, such cancellation or termination shall not
constitute a breach by Company of the Agreement.
15. EMPLOYMENT LAWS I NON-DISCRIMINATION
Company shall comply with all applicable provisions of Federal, State, and local laws, rules,
and regulations regarding employment. If the City notifies Company of any violation of such
laws, ordinances, rules or regulations, Company shall immediately desist from and correct
the violation. Company, for itself, its personal representatives, assigns, subcontractors and
successors in interest, as part of the consideration herein, agrees that in the performance of

Company's duties and obligations hereunder, it shall not discriminate in the treatment or
employment of any individual or group of individuals on any basis prohibited by law. If any
claim arises from an alleged violation of this non-discrimination covenant by Company, its
personal representatives, assigns, subcontractors or successors in interest, Company agrees
to assume such liability and to indemnify and defend the City and hold the City harmless from
such claim.
16. CONFLICT OF INTEREST
Company shall not employ as a director, officer, employee, agent, contractor, or
subcontractor, directly or indirectly in any capacity as relates to this Agreement, any elected
or appointed official of the City or any member of his or her immediate family.
17. OFFICE SPACE, FACILITIES,AND RECORDS
The City shall provide office space, office equipment and machines, computers, and other
equipment or records as may be needed in the performance of this Agreement.
18. ASSIGNMENT OF AGREEMENT
Company agrees not to assign, transfer, convey, or otherwise dispose of this Agreement or
its rights, title, or interest in this Agreement without previous consent and written approval of
the City.
19. CHANGES IN AGREEMENT
This Agreement may be changed only upon the written agreement of City and Company.
20. GOVERNING LAW/VENUE
This Agreement shall be construed in accordance with the laws of the State of Texas. If any
action, whether real or asserted, at law or in equity, is brought on the basis of this Agreement,
venue for such action shall lie in state courts located in Tarrant County, Texas or the United
States District Court for the Northern District of Texas, Fort Worth Division.
21. SOLICITATION OF EMPLOYEES
Neither the City nor Company shall, during the term of this Agreement, any renewal periods,
and additionally a period of two years after its termination, solicit for employment or employ,
whether as employee or independent contractor, any person who is or has been employed by
the other during the term of this agreement, without the prior written consent of the person's
employer.
22. SEVERABILITY
If any provision of this Agreement shall be declared invalid or unenforceable, such invalidity
or unenforceability shall not affect the balance of this Agreement, but the balance of this
Agreement shall be construed as if not containing the provision, and the rights and
obligations of the parties shall be construed and enforced accordingly, provided that the
provision declared invalid or unenforceable is not of a material nature and does not
substantially affect the work or the associated cost.

23. NOTICES
Except as otherwise expressly provided herein, any notice required or authorized to be given
shall be deemed to be given when mailed by certified or registered mail, postage prepaid,
and received as evidenced by a delivery receipt, addressed as follows:

24. TERMINATION
City shall have the right to terminate this Agreement upon thirty (30) days written notice to
Company. Thirty (30) days after receipt of such notice by Company, this Agreement shall be
considered terminated without further obligation of the parties, except for payment by the City
for all services rendered and materials furnished up to the effective date of termination. The
Company may terminate on thirty (30) days notice for nonpayment, if payment is not cured
within thirty days from the date of the notice. After the initial term, Company may terminate
on thirty (30)days written notice.
If for any reason, at any time during any term of this Agreement, or during any renewal term,
the City Council fails to appropriate funds sufficient for the City to fulfill its obligations under this
Agreement, the City may terminate this Agreement without penalty to be effective upon (i)
expiration of thirty (30) days following delivery by the City to Company of written notice of the
City's intention to terminate or (ii) the last date for which funding has been appropriated by the
City Council for the purposes set forth in this Agreement, whichever occurs first.
Upon termination, the City shall have the right to obtain the source code(s) from Company
necessary to operate the system in accordance with the terms of the escrow agreement. City
shall retain the right to reload and operate all software created by the City for this system or
created by Company for use on this system pursuant to this Agreement or to CSC No. 29707.
25. RENEWAL
After the expiration of the initial term, this Agreement may renew annually for a period of
twelve (12) months provided that funds have been properly appropriated for such renewal.
Should City not wish to renew this Agreement, City shall notify Company in writing at least
thirty (30) days prior to the expiration of the current renewal term. If in any renewal period
Company upgrades its current system to a system that the City does not wish to upgrade,
City shall have the option to continue running its current system, and Company agrees to
provide continued maintenance and support services for the City's current system for the life
of this Agreement.
26. WAIVER
The failure of the City or Company to insist upon the performance of any term or provision of
this Agreement or to exercise any right granted herein shall not constitute a waiver of the
City's or Company's respective right to insist upon appropriate performance or to assert any
such right on any future occasion. i

27. DISPUTES
If either party has a claim, dispute, or other matter in question for breach of duty, obligations or
services rendered that arises under this Agreement, that party shall promptly notify the other
party in writing as to the nature of the dispute and list its reasons for such dispute. Both parties
agree to make a good faith effort to resolve any claim, dispute or other matter in question that
may arise out of, or in connection with this Agreement. In the event the dispute is specifically
related to services rendered by the Company, the City shall determine a reasonable time in
which the Company shall successfully resolve the issue(s) raised by the dispute to the
satisfaction of the City.
If the City does not accept the Company's resolution, the City shall have the right to withhold
payment of any amounts due until such dispute has been resolved to the satisfaction of the City.
No interest shall accrue on any amount due if the dispute is not resolved. The Company agrees
to continue to perform all other services under the Agreement not related to the dispute.
However, if the dispute is related to a service that would cause serious impairment or total failure
of the system if Company ceased to perform such service, then Company agrees to continue
such service under the Agreement.
28. FORCE MAJEURE
The City and Company shall exercise their best efforts to meet their respective duties and
obligations as set forth in this Agreement, but shall not be held liable for any delay or
omission in performance due to force majeure or other causes beyond their reasonable
control (force majeure), including, but not limited to, compliance with any government law,
ordinance or regulation, acts of God, acts of the public enemy, fires, strikes, lockouts, natural
disasters, wars, riots, material or labor restrictions by any governmental authority,
transportation problems and/or any other similar causes.

SCHEDULE B
SERVICES UNDER THIS AGREEMENT
1. SUPPORT SERVICES
Company shall furnish City with the following services:
A. Application software support services for the Products identified in Schedule A. Services
available include procedural and technical assistance in troubleshooting and resolving
problems/questions associated with the application(s).
B. Application software warranty is extended as part of this Agreement to include the
correction of software defects. Software defects shall be defined as failure of the
software to perform functions as identified in documentation supplied by Company.
C. City may desire to have additional modifications or minor enhancements performed; the
fees for these services shall be in accordance with the time and materials rates contained
in Schedule C of this Software Support Agreement. Specific services include
requirements analysis, preparation of functional and programming specifications,
software development, testing, documentation, installation, file conversion, training, and
help desk support. Company shall provide an estimate of cost prior to performing any of
the above services. Company is available to perform these modifications within the
scope of this Agreement or under a separate agreement.
D. Product enhancements developed by Company shall be made available to City as an
update to the current Product version. Should City desire to implement these updates,
City would not be charged for additional license fees and release documentation and
remote installation of said updates, but would be charged for the on-site installation and
training of City personnel on the update. Company shall provide an estimate of cost prior
to performing any of the above services.
E. New releases of the Product are made available periodically which include major and
significant technical updates and functional improvements. These new Product releases
shall be made available to City. New Product releases will be provided without any
additional application software license fees or charges for documentation. There may be
implementation charges for time incurred in on-site installation, training of City personnel,
and file conversion of City's database, hardware and third party software. Company shall
provide an estimate of cost prior to performing any of the above services.
F. Legislative Updates which require modifications to the Software in order to maintain the
existing functionality of the Software listed in Schedule A and which result from changes
to the laws, regulations or rules of the State of Texas, or of the Texas State Rules of
Court, will be provided in accordance with the terms and conditions set forth below.
Modifications required by changes to local court rules will be provided to the City at no
additional cost.
The City shall timely notify Company in writing of all required Legislative Updates. The
notice shall contain a summary of the modification identifying the application(s) and
function(s) to be modified as well as detailed specifications of the required change(s).
City shall also provide a complete text, including effective date, of the legislation and/or
order mandating the modification(s).

Company shall then prepare a detailed functional specification for written approval by
City. Following receipt of City's approval, Company will undertake all reasonable efforts
to complete the modifications.
Legislative Updates shall only be provided for the latest release of the Company's
product. There is no additional license fee for associated documentation or remote
installation of said updates. Fees for on-site installation and training for Legislative
Updates shall be billed to City at the time and materials rates listed in Schedule C. The
City may contract with Company for Legislative Updates for old releases of Company's
products under separate agreement.
G. Additional technical support or consulting services outside the scope of the support
services described in this Agreement may be available to City upon request. These
services shall be performed on a time and materials basis as specified in Schedule C.
Examples may include setting up user accounts, setting up printer queues, performing file
conversions, system maintenance (defragmenting the disk, system fine-tuning, etc.), and
operating system training.
2. RESPONSE TIMES AND AVAILABILITY
A. Definition. The help desk is the means of communication between the City and
Company regarding all hardware and software issues itemized in Schedule A. The help
desk provides the most efficient means to track, manage, and resolve all hardware and
software issues itemized in Schedule A.
B. Procedures. A toll-free number is provided to the City for help desk access. Calls are
received and logged in the Hotline Call Tracking System and reviewed to determine
priority. Necessary resources are then allocated to resolve each reported issue. The
City shall be kept informed as to the status of the issue until resolution. Company has a
comprehensive escalation procedure in place to ensure that all calls are handled in an
expeditious manner. Response times should be timely and availability (on-site or remote)
should meet the City's operational schedule.
Support shall be provided off-site and includes remote diagnostic capability, which
provides the most responsive on-line problem identification and resolution.
C. Response Time. Company shall respond to the City's request for assistance via the
help desk within two (2) hours of receipt. Response time is defined as the time it takes
Company to assign and deploy resources to work towards resolving the problem.
Company shall adhere to the following schedule in responding to City requests for
assistance:
• Priority 1 = Total system failure—2 hours
• Priority 2 = Serious impairment to function of the system—4 hours
• Priority 3 = Minor system malfunction—7-10 business days
D. Hours of Operation. Company shall be available for support services Monday through
Friday, 7:45 A.M. to 9:00 P.M. Eastern Standard Time, except for Company observed
holidays as specified in Schedule D. On-site support may also be requested by the City
as time and materials services as specified in Schedule C.

A. Payments of the fees specified in the invoices shall be made by the City in accordance
with the provision of Section 3 of this Agreement.
B. Invoices for additional services that have been requested by the City shall also be
submitted to the City for payment. These additional services shall be billed at Company's
prevailing time and materials rates as specified in Schedule C unless otherwise specified.

$466,500.00 in the Special Trust Fund from available funds for the annual support and maintenance of the
Municipal Court Case Management and Document Management System;
2. Authorize the City Manager to execute a five-year application software support and maintenance service
agreement with MAXIMUS Justice Solutions Division, Inc., for the Municipal Court Integrated Case
Management and Electronic Document Management System for amount not to exceed $93,300.00 annually
and $466,500 in total; and
3. Authorize the City Manager to enter into subsequent annual renewals of the service agreement for
application software support and maintenance services, subject to funds being appropriated for such
renewal periods.
DISCUSSION:
In January of 2003, the City Council authorized the execution of an agreement with MAXIMUS Justice
Solutions Division, Inc. (MAXIMUS), for the purchase of a case management and electronic document
management system for the Municipal Court Department Integrated Management System (M&C C-19450).
MAXIMUS is experienced in the implementation and support of the MAXIMUS application software and the
MAXIMUS software has been customized for use specifically with Municipal Court's Integrated
Management System.
MAXIMUS was selected by Municipal Court, through a Request for Proposal (RFP) to implement the new
case management and electronic document management system. The project has been successfully
implemented and on-going support and maintenance of the new system by MAXIMUS will ensure efficient
procedural and technical support and maintenance services of the case management product, including
application software support and maintenance of the imaging and workflow modules.
The initial warranty period for the system expired in December of 2006. The fixed price contract for the
maintenance agreement is structured not to exceed $93,300 annually. The initial term will be five years.
Subsequent renewals shall not require further Council approval provided that sufficient funds are properly
appropriated for each renewal period.

A. Business Needs
The State of Texas has added reporting requirements to the Municipal Courts. The reports are
submitted to the State each month to provide information to make decisions regarding the jurisdiction,
structure and needs of the court system.
• A report must be submitted each month even if there is no activity.
• Only activity during the month will be reported.
There are Four separate reports that will be generated and sent to the State. An XML file will be created
to include all four reports. The Criminal Section, The Civil/Administrative Section, the Juvenile/Minor
Activity and the Additional Activity reports where included in one report on the original OCA Municipal
report. The new requirements have added reporting rows to each section and have defined four separate
reports.
A new spreadsheet will be created to include all four reports (identified as sections on the SCR set up
screen). The functionality from the original Municipal report specification will be utilized to minimize user
set up. The original Municipal report will remain and a new report will be developed for the 2011
changes. Some of the docket groups may be used for both reports while other docket groups will need to
be created and added to the set up. The termination codes used for reporting will need to be updated
with the new report SCR form, SCR Section and SCR row.
The original Texas municipal report created the screens to enter the office code and cashbook codes to
determine the financial disbursements to be reported. The current set up will be utilized in the New
Municipal Report. (Issue 81898)
The financial disbursement requirement is separating the total amount collected into two separate rows
on the new report(kept by City and Remitted to State). This enhancement will require the set up of 3 new
SYSPARS that will be used in conjunction with the current financial disbursement functionality to obtain
the financial statistics required.
The business logic to create the report will be executed for the report and the build transmission file. This
replaces the current functionality that executes 2 different business processes, one for the report and the
other for the build transmission file.
The functionality from the original Municipal report will be used to create these reports when developed in
Uniface. If the report is developed in Crystal reports then only the UNIFACE set up screens will be
utilized for the reporting.

Enter the setup for the Columns and Sections as indicated in the matrix below(Required Setup):
a. Report each case in the appropriate column where the SCR_FORM.DSPSCR= 'TXMN'
and obtain the column information from SCR_COL.DSP for A,B,C,D,E,F,G.,H, I , J, K
b. SCR Section and Time GDLN will be used to designate the order that the descriptions
will be added to the XML file. The SCR column is in ascending Alpha order therefore the
Time Gdln will be used to designate the actual row that is used in the XML file.
c. All setup must be exactly as shown below
d. Note: COLUMN B will now report on the Civil report and not be included on the Criminal
report per Ft. Worth instructions.
e. Note: COLUMN K is new for the Non-Traffic Penal Code Filed case types. The new
case type will be set up for this column. The column of K will be set up on the action
code.
f. Note: The Juvenile case types JV and JVI report both in the Criminal section A and in
the Juvenile Section C of the report.

9. Modify the SCR Row/Section Screen CRTS9581 to allow the entry of the Transmission Line.
a. Change the Transmission Code label to Trans Code.
b. Add the column Trans Line next to the Trans Code.
c. Allow the entry of Alpha and numeric values.
d. The Trans Line field is required.
e. The Trans Line entry will be stored in the rs_trans_line.ROW—SECT field. The
rs_trans_line field is being added to the table as defined in Data Model Changes B at the
end of the document.
f. The new column will appear for all users. The Texas users will be entering the line
numbers to correspond to the XML transmission file that is sent to the state of OCA for
the new Municipal reporting requirements. No other report will be using this column at
this time.

10. Complete the Texas Municipal Court Report SCR form Row/Section using the existing
functionality available from CRTS9581 SCR Row/Section maintenance screen.

a. The row and section set up defines the process that will be executed for each row of the
report.
General Row code definitions:
i. If the Row Code is null then the most recent disposition record within the reporting
period for the case will be used to determine if the case will be reported. The case will
be reported based on the set up on the termination code associated to the disposition
record.
ii. If the Row Code is NOT null then a defined process will be executed to determine if the
case will be reported.
iii. If the Row Code is Null and the docket group is NOT null then the dockets within the
docket group will be used to determine if the case will be reported.
iv. If the Row Code is NOT null and the docket group is NOT null then the most recent
disposition record within the reporting period and the docket group is used to determine
if the case will be reported.
b. The docket groups can be defined by the Court and set up. The Docket Groups defined
in the Matrix are a representation of rows where docket groups must be set up for
reporting.
c. The Trans line is a new column that must match the line defined in the XML schema.
d. The following is the required Set Up for the Report.
e. Note: Each criminal case can only have one charge. Multiple cases are created for each
charge associated to the party.
f. The Trans Code field will be used as the LINENUMBER tag in the XML file.
g. The Trans Line field will be used as the LINE tag in the XML file.
h. TRMDSP or DKTTOT can be used for rows A8 thru A22 and 68 thru
614. The court will decide whether to use dockets or to use the
terminations to count in the rows.
• The TRMDSP function will count the case when the termination row on the
case disposition record equals the SCR Row defined in the SCR set up. Using
this Row Code the user must set up new termination codes to be used for
the first reporting period.
• The DKTTOT function will count the dockets on the case that match the
dockets in the docket group where the docket date is greater than or equal to
the reporting begin date and less than or equal to the reporting end date. If
there are multiple dockets between the reporting dates then all dockets will be
counted. A case may be opened, closed and reopened within the same period
and all dockets would need to be counted. Using this Row Code of DKTTOT,
the user will need to set up Docket groups for the new reporting. The docket
group must include all of the dockets that should report on the case. Existing
Docket groups may be used if the dockets within the group are valid for the
row.

Either the Row Code or the Docket group will be entered, NOT BOTH.

have been modified to report and count cases once based on the case filed date within
