HomeMy WebLinkAboutContract 26821 CITY SECRETARY CONTRACT NO. 6 STATE OF TEXAS § COUNTY OF TEXAS § CITY SECRETARY CONTRACT NO. 22579 WHEREAS, the City of Fort Worth ("City") and Carter & Burgess, Inc. ("Consultant") made and entered into City of Fort Worth City Secretary Contract No. 22579, ("Contract"); and WHEREAS, the Contract involves professional services for the following project: Trinity River Trail Extension—Scope Modification/Phase I Development; and WHEREAS, it has become necessary to amend the Contract to include an increased scope of work and/or revised maximum fee. NOW, THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the contract: 1. Article 1, Section A of the Contract is amended to include the additional engineering services specified in a letter dated May 17, 2001, a copy of which is attached hereto and incorporated herein. 2. Article II of the Contract is amended to provide for an increase in the maximum fee in the amount of$ 13,575.00, which is to be paid to Consultant for all work and services under the Contract, as amended, so that the total fee to be paid by City for all work and services shall not exceed the sum of $ 557,236.00. 3. The intent of the change is to divide the current construction document package into (3) phases. The following is a breakdown of additional services fees and estimated completion schedule for the 1 st Phase only: 1St Phase—Trail sections not requirinq plan revisions 1. Path `A' (Gateway Park)—Sta. 400+00 to Sta. 429+34.60/Sht. 44-47. 2. Path `A' (E. 1 St Street ballfield parking lot to Randol Mill Road)—Sta. 450+00 to Sta. 535+27.32/Sht. 48-55. 3. Path `B' (Bertha Collins Community Center/pedestrian —on street access) - Sta. 14+06.79 to Sta. 26+58.95/Sht. 58. 4. Path `C' (Bertha Collins Community Center/pedestrian—on street access)— Sta. 2+98.38 to Sta. 26+58.95/Sht. 58. 5. Path `C1' (Cypress, Vine St. on street access to Vickery Blvd.)—Sta 0+00 to Sta. 32+01.89 Sht. 58-61. 6. Path `C1' (Sycamore Creek Corridor)—Sta. 85+59.73 to Sta. 287+80.43/Sht. 66-81. A redline set of documents to use as a guide for the 1St Phase was provided by you on May 11, 2001. This expanded work will include the manipulation of an estimated (91) ninety-one sheets. Sheets include title, index, estimated summary, project layout, horizontal control, typical sections, plan and profile Path `C-1', tree removal list and small sign summary. These Phases will be submitted at a later date after further review. If you wish to meet and discuss this issue, a meeting with FWPACS, Garcia & Associates and C&B can be scheduled. Project funding was obtained under the Statewide Transportation Enhancement Program of the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA)in the amount of$3,494,000.This project was approved by the Texas Department of Transportation(TxDOT) in April 1994 with a local share of twenty one percent(21%)being supplied by Streams and Valleys,Inc.,a private non-profit organization. On February 18, 1997 (M&C C-15916 attached), the City Council approved award of contract to Carter and Burgess, Inc. to provide professional services for the design and construction document preparation for trail development along the Trinity River corridor.TxDOT is requiring that we obtain easements under four railroad crossings. Due to the time required to obtain these easements we have decided to proceed with phased construction of trail sections not impacted by the access easement issues. Subsequently, construction documents required modification as per TxDOT requirements in order to proceed with the first phase of trail development. The total fee to be paid for all work and services shall not exceed the sum of $ 13,575. Since the amount of professional services is less than$15,000,this amendment does not require City Council action or M/WBE participation. It is my understanding from Randle that Carter and Burgess agreed to this lower amount of$557,236.00, but no formal document was executed. The present contract is to indicate the increase in the maximum fee and to also lock in C&B to the agreed upon lower total. Sarah Fullenwider 7619
