AUTHORIZING THE ADVERTISEMENT FOR SALE OF
A 2.437 ACRE TRACT OF LAND NEAR DALLAS
FORT WORTH INTERNATIONAL AIRPORT.
WHEREAS, the City of Dallas and City of Fort Worth are owners o£
a tract of land containing approximately 2.437 acres,
more particularly described in Exhibit A, attached
hereto, located near Dallas/Fort Worth International
Airport ("D/FW Airport")- within the city limits of
Irving, Texas, which tract is no longer needed for
municipal use; and
WHEREAS, the Purvis and York Companies of Fort Worth have
contacted the D/FW Airport staff and expressed an
interest in acquiring a 2.437 acre parcel of D/FW Airport
land in exchange for, an adjacent 2.437 parcel owned by
Purvis and York; and
WHEREAS, Such an exchange would square up the boundaries of both
the D/FW Airport property and the Purvis and York
property and would make both more usable; and
WHEREAS, the City Council has previously authorized the sale or
exchange of the 2.437 acre parcel and has been requested
to re-affirm such authorization; and
WHEREAS, the D/FW Airport staff also request that, if the parcel
is sold for cash, the proceeds be deposited in the
capital improvement fund of the Airport, or, if the
parcel is exchanged, the land which is received be
designated for use of the D/FW Airport Board, and
WHEREAS,. by Resolution Number 87-238 on October 6, 1988, the D/FW
Airport Board recommended the property be declared
surplus; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:

SECTION 1. That the tract of real property owned by the City
of Dallas and the City of Fort Worth, containing approximately
2.437 acres located near D/FW Airport within the city limits of
Irving, Texas, is declared unneeded by the City Council and should
be advertised for sale by sealed bids at the indicated minimum
price of $957,000.00.
SECTION 2. That said property shall be conveyed subject to
the reservation of an avigation easement for free and unobstructed
passage of all aircraft with an elevation to be determined by D/FW
Airport Board, Engineering Division.
SECTION 3. That the advertisement of this property shall
state that:

a) 'the City of Dallas and the City of Fort Worth each
reserves the right to reject any and all bids;
b) this property shall be subject to the reservation of an
•avigation easement and all easements and other
instruments of record;
c) the conveyance shall be by special warranty deed; and
d) this property will be sold in "as is" condition, and it
is the bidder's responsibility to determine that the
property can be utilized for its intended purposes and to
determine access to the property.
SECTION 4. That the Property Management Administrator is
authorized to advertise said property for sale or exchange.
SECTION 5. That the City Council hereby reaffirms its
previous authorization to sell or exchange said parcel.
SECTION 6. That if said parcel is sold for cash, the net
proceeds shall be deposited in the capital improvement fund of the
Airport, or if the parcel is exchanged, the land which is received
shall be designated for use of the DFW Airport Board.
SECTION 7 . That this resolution shall take effect immediately
from and after its passage, and it is accordingly so resolved.
