AN ORDINANCE VACATING AND EXTINGUISHING TWO PORTIONS
OF SOUTH JENNINGS AVENUE, LYING BETWEEN BLOCKS 1 AND 2,
S.O. MOODIE'S SUBDIVISION OF BLOCK 22 FIELD-WELCH
ADDITION,AN ADDITION TO THE CITY OF FORT WORTH,TARRANT
COUNTY, TEXAS, AS SHOWN IN THE PLAT THEREOF RECORDED IN
VOLUME 35, PAGE 162 OF THE PLAT RECORDS OF TARRANT
COUNTY, TEXAS, CONTAINING APPROXIMATELY 487.5 SQUARE
FEET OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE
IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL
EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That two portions of South Jennings Avenue, an eighty (80) foot right-of-way, lying
between Blocks 1 and 2, S.O. Moodie's Subdivision of Block 22, Fields-Welch Addition, an
addition to the City of Fort Worth, Tarrant County, Texas, as shown in the plat thereof recorded
in Volume 35, Page162 of the Plat Records of Tarrant County, and containing 487.5 square feet
or 0.011 acre of land more or less, and as more specifically described in Exhibits "A" and "B"
attached hereto and incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

DESCRIPTION OF PROPOSED STREET VACATION PARCELS
SITUATED in the City of Fort Worth, Tarrant County, Texas, and being two portions of South Jennings Avenue,
an 80 foot wide right-of-way lying between BLOCKS 1 and 2, S. O. MOODIE'S SUBDIVISION of Block 22,
Fields-Welch Addition, as shown on plat thereof recorded in Volume 35, Page 162, of the Tarrant County Plat
Records, and said portions being more fully described as follows:
South Parcel
BEGINNING at the southwest corner of Lot 24, in said Block 1, in the east line of said South Jennings Avenue,
said point being also the northwest corner of Lot 23, in said Block 1;
THENCE West into said South Jennings Avenue, 10.0 feet;
THENCE North and parallel with said east line of South Jennings Avenue, 45.0 feet;
THENCE North 45 degrees East, 7.07 feet;
THENCE East, 5.0 feet to the northwest corner of said Lot 24 at the point of intersection of said east line of
South Jennings Avenue with the south line of West Morphy Street(a 26 foot wide public right-of-way);
THENCE South with the west line of said Lot 24 and said east line of South Jennings Avenue, 50.0 feet to the
PLACE OF BEGINNING, and containing 0.011 acre(487.5 square feet).
North Parcel
BEGINNING at the southwest corner of Lot 25, in said Block 1, in the east line of said South Jennings Avenue,
said point being the point of intersection of said east line of South Jennings Avenue with the south line of West
Morphy Street(a 26 foot wide public right-of-way);
THENCE West into said South Jennings Avenue, 5.0 feet;
THENCE North 45 degrees West, 7.07 feet;
THENCE North and parallel with said east line of South Jennings Avenue, 45.0 feet;
THENCE East, 5.0 feet to the northwest corner of said Lot 25 and the southwest corner of Lot 26 in said Block 1;
THENCE South with the west line of said Lot 25 and the east line of South Jennings Avenue, 50.0 feet to the
PLACE OF BEGINNING, and containing 0.011 acre(487.5 square feet).

Adopt Ordinance Vacating Portions of Excess Right-of-Way Along South Jennings Avenue at the
Intersection of West Morphy Street and South Jennings Avenue for a New Townhome Development in the
Near Southside (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended by the City Plan Commission that the City Council:
1. Adopt the attached ordinance vacating portions of excess right-of-way along South Jennings Avenue at
the intersection of West Morphy Street and South Jennings Avenue for a new townhome development in
the Near Southside; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
G. Curtis Surveyors, LLC., on behalf of Neat Project Group, LLC, has requested vacation of these portions
of excess right-of-way to be replatted with the adjoining property for a townhome development in the Near
Southside. The City Plan Commission recommended approval of this request at its meeting on December
15, 2017. An acceptable final plat (FP-18-009) has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through platting
process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007, (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of this right-of-way easement for the alley.
This project is located in COUNCIL DISTRICT 9.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
