AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
TRANSPORTATION IMPACT FEE CAPITAL LEGACY FUND, IN THE AMOUNT OF
$155,000.00, FOR THE OLD DECATUR ROAD RECONSTRUCTION PROJECT;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Transportation Impact Fee Capital Legacy Fund, in the amount of $155,000.00, for the Old Decatur Road
Reconstruction Project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Adopt Appropriation Ordinance Increasing Estimated Receipts and Appropriations in the Old Decatur Road
Reconstruction Project (Phase 2) of the Transportation Impact Fee Capital Legacy Fund (39008) in the
Amount of$155,000.00, Authorize Execution of Change Order No. 2 to City Secretary Contract No. 49291
with Jackson Construction, Ltd, in the Amount of$60,397.09 and an Additional 45 Calendar Days to the
Original Contract Time for Old Decatur Road Reconstruction Project (Phase 2) (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Old
Decatur Road Reconstruction Project (Phase 2) of the Transportation Impact Fee Capital Legacy Fund
(39008) in the amount of$155,000.00 and reduce the fund balance in the Service Area G Project
(UN9917) by that same amount; and
2. Authorize the execution of Change Order No. 2 to City Secretary Contract No. 49291 with Jackson
Construction, Ltd, in the amount of$60,397.09 and an additional 45 calendar days for the Old Decatur
Road Reconstruction Project (Phase 2), thereby increasing the contract to an amount up to $4,447,442.74
(City Project No. 02014) and contract time to 345 calendar days, subject to incentives earned.
DISCUSSION:
On May 16, 2017, Old Decatur Road from IH-820 to Angle Avenue (Phase 2)was awarded to Jackson
Construction, Ltd in the amount up to $4,319,628 to construct one new travel lane in each direction on Old
Decatur Road from Angle Avenue to Loop 820, with a continuous left-turn lane (M&C C-28244).
Change Order No. 2 in the amount of$60,397.09 includes reconciliation of additional quantities and costs
associated with changes in site conditions during construction and adds 45 calendar days to the contract
time. Change Order No. 1 was approved administratively in the amount of$67,417.65 to address
contractually-permitted pricing adjustments at the start of construction. The revised contract amount,
which includes performance incentives is $4,447,442.74. The revised contract time will be 345 calendar
days.
Staff is requesting the appropriation of$155,000.00 from Service Area G (Project UN9917) of the
Transportation Impact Fee Capital Legacy Fund to provide funding to complete the construction of Phase
2.

The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget as appropriated, of
the Transportation Impact Fee Capital Legacy Fund.
