HomeMy WebLinkAboutResolution 1864 ~ - A Resolution t~I APPROVING THE REPLACEMENT HOUSING PLAN OF THE HOUSING AUTHORITY OF THE CITY OF FORT WORTH, TEXAS WHEREAS, the Housing Authority of the City of Fort Worth, Texas ~~ (the "Housing Authority ), and the State Department of Highways and Public Transportation (the "Highway Department") entered into that certain Memorandum of Agreement for Purchase and Sale dated February 1, 1991, and amendment thereto dated May 5, 1992 (the "Contract"), concerning the sale of 10 units at Butler Place Addition and 72 units at Butler Place Apartments, in exchange for sufficient funds to allow the Housing Authority to meet its statutory requirement for one-for-one replacement of the 82 dwelling units by the purchase and rehabilitation of existing single-family residences; and WHEREAS, the Contract was entered in lieu of condemnation by the Highway Department necessary to facilitate construction of the U.S. interstate I-35 W and I-30 interchange; and WHEREAS, in order for the Housing Authority to sell the 82 units per terms of the Contract, it is required by federal regulations to submit to the United States Department of Housing and Urban Development ("HUD") an Application for Disposition of the 82 units; and WHEREAS, the Housing Authority has submitted to HUD the Application for Disposition of Butler Place Apartments and Butler Place Addition Apartments, Projects TX004-002 and TX004-004B, Revised 9-9-92 (the "Application"); and WHEREAS, the Apglication contains the Fort Worth Housing Authority's Replacement Housing Plan (the "Plan"), which details the census tracts where the Housing Authority will purchase the replacement housing units; and WHEREAS, 24 C.F.R. §970.8(f) requires a statement from the unit of local government in which the units are located, indi- cating approval of the Replacement Housing Plan; and -`',. _~ WHEREAS, the Housing Authority recognizes that the availability, location and condition of housing for all citizens of Fort Worth is a matter of utmost interest to the Fort Worth City Council; and CITY OF FORT WORTH v ..v=:M • ~" - , WHEREAS, the Fort Worth City Council supports the Fort Worth Housing Authority's concept of single-family home acquisition in non-impacted areas of the City; and WHEREAS, the Fort Worth Housing Authority recognizes, supports and will comply with the City of Fort Worth Policy of wide Geographic Dispersal of Replacement Housing throughout all quadrants and Council districts of the City; and WHEREAS, the Housing Authority has agreed to work closely with, solicit input from and provide information on a regular basis to City staff and Councilmembers and, where appro- priate, seek Council approval of major aspects of the implementation of the Replacement Housing Plan; and WHEREAS, the City staff and City Council have reviewed the Fort Worth Housing Authority's Replacement Housing Plan and approve that Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: that the Fort Worth City Council does hereby approve the Fort Worth Housing Authority's Replacement Housing Plan, which provides for 82 replacement units and appears in the Application, a true and cor- rect copy of which is attached hereto, and finds that such Plan is consistent with the City of Fort Worth's Housing Assistance Plan. CITY OF FUKT WUKTri ~• „~,~ , .. • ~`. • CITY SECRETARY CONTRACT NO ----~~ MEMORANDUM OF AGREEMENT BETWEEN THE FORT WORTH HOUSING AUTHORITY AND THE CITY OF FORT WORTH CONCERNING THE REPLACEME1~fT HOUSING PLAN This writing evidences the understanding and agreement arrived at between the City of Fort Worth ("City"} and the Fort Worth Housing Authority ("FWHA^), concerning the FWHA's Replacement Housing Plan for relocating persons displaced by highway expansion from the Butler Place Apartments and Butler Place Addition, and is entered into specifically with reference to the Resolution of the Fort Worth City Council approving the Replacement Housing Plan, adopted at the City Council session of November 10, 1992. The Fort Worth Housing Authority, acting through Barbara Holston, its Interim Executive Director, recognizes the City's profound interest in the availability, location and condition of appropriate housing for all of its citizens, including those displaced by the Texas Department of Highways and Public Transportation's planned expansion of the interstate highway system in Fort Worth. FWHA agrees to work closely with the staff of the City Housing and Human Services Department and members of the City Council Housing Programs Committee with the objective of helping the Housing Replacement Plan implementation go as smoothly as pos- sible. To that end, FWHA will provide ongoing progress reports on the plan to the Housing and Human Services Department and the Housing Programs Committee on at least a quarterly basis and will use its best efforts to answer any specific requests for information from either the Housing and Human Services Department or the Council ;~s~ ~ ;'~ ..~y o J.~ ~ r. • Housing Programs Committee. FWHA will also seek City input from Housing and Human Services and the Housing Programs Committee on a ' regular basis and will submit the major implementative aspects, or any changes in same, to the Fort Worth City Council for their ' agproval on a timely basis. Major implementative aspects of the plan shall include but not necessarily be limited to census tracts chosen for relocation of the displaced individuals, numbers of displaced individuals to be relocated within the chosen tracts and any alteration or modification of the Housing Replacement Plan's single-family home acquisition concept. City supports P'47fiA and the Housing Replacement Plan and recognizes the need for flexibility and timely cooperation with FWHA to achieve successful implementation. City covenants to use best efforts to facilitate the plan, to work closely with FWHA and to take timely and reasonable action with respect to ensuring the success of the plan and the achievement of its goals.
