HomeMy WebLinkAboutContract 40633-R4 CITY SECRETARY CONTRACT NO. nY" CITY SECRETARY CONTRACT NO �gA"TH RENEWAL OF AND SECOND AMENDMENT TO FORT WORTH CITY �Py ETARY CONTRACT NO. 40633—PROFESSIONAL SERVICES AGREEMENT This Fourth Renewal of and Second Amendment to Fort Worth City Secretary Contract No, 40633 ("Fourth Renewal") is entered into by and between the City of Fort Worth (hereafter"City"), a home rule municipal corporation of the State of Texas, acting by and through Susan Alanis, its duly authorized Assistant City Manager, and LINEBARGER GOGGAN BLAIR & SAMPSON, LLP (hereafter "Attorney"), a Texas limited liability partnership, acting by and through Stephen T. Meeks, its duly authorized partner. WHEREAS, City and Attorney are currently parties to a professional services agreement, pursuant to which Attorney performs certain collection, reporting, and related services for delinquent taxes and other revenues owed to the City, that agreement being Fort Worth City Secretary Contract No. 40633 (the "Agreement"); and WHEREAS, the Agreement provides for an initial five-year term and five, one-year renewal options; and WHEREAS, the parties previously amended the Agreement to revise the form and substance of certain required reporting, that amendment being Fort Worth City Secretary Contract No. 40633-A1; and WHEREAS, the current renewal term expires June 30, 2018; and WHEREAS, City and Attorney wish to amend the Agreement's terms to reflect recently enacted state law and to renew and extend the Agreement for an additional one-year period. NOW, THEREFORE, City and Attorney do hereby covenant and agree as follows: 1. Attorney acknowledges that in accordance with Chapter 2270 of the Texas Government Code, City is prohibited from entering into a contract with a company for goods or services unless the contract contains a written verification from the company that it: (1) does not boycott Israel; and (2) will not boycott Israel during the term of the contract. The terms "boycott Israel" and "company" shall have the meanings ascribed to those terms in Section 808.001 of the Texas Government Code. By signing this Amendment, Attorney certifies that Attorney's signature provides written verification to the City that Attorney and any wholly owned subsidiary, majority-owned subsidiary, parent company, or affiliate of the Attorney (1) do not boycott Israel; and (2) will not boycott Israel during the term of the Agreement, as amended and extended. 2. Fort Worth City Secretary Contract 40633, as previously amended and further amended herein, is hereby renewed and extended for an additional one year term commencing on July 1, 2018 and ending June 30, 2019. All other terms and conditions of Fort Worth City Secretary Contract No. 40633, as amended by Fort Worth City Secretary Contract 40633-A1, that are not amended herein shall remain in full force and effect throughout the fourth renewal term. RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute a five year contract with the law firm of Linebarger Goggan Blair& Sampson, LLP, ("Linebarger')for the collection of delinquent property taxes and other miscellaneous delinquent revenues and liens. DISCUSSION: The City currently has a contract with Linebarger for the collection of delinquent property taxes and other miscellaneous delinquent revenues. This contract will expire on June 30, 2010. Anticipating the upcoming contract expiration, staff issued a Request for Proposals on March 4, 2010 for attorneys and/or law firms to collect delinquent property taxes for the City of Fort Worth and to assist as requested in the collection of delinquent hotel/motel taxes, bankruptcy claims and other miscellaneous delinquent accounts. The City received proposals from two firms; (1)the Joint Venture of Perdue, Brackett, Flores, Utt and Burns (Perdue JV); and (2) Linebarger. An evaluation team composed of staff from the City Attorney's Office, Financial Management Services, and Housing and Economic Development Departments reviewed the submissions and conducted interviews with both firms. Evaluation criteria included collection rates, qualifications and experience, completeness and quality of the response, M/WBE compliance as well as staff and technology resources. Based on the evaluations and interviews, staff recommends executing a five year contract with Linebarger based on the following: 1. Linebarger has extensive qualifications and experience collecting for clients similar to the City of Fort Worth and currently collects for the largest taxing entities in Texas. 2. Linebarger has a Fort Worth Office of experienced professional with impressive credentials and proposes to have a dedicated Fort Worth Collection Team of almost 80 employees to enhance collection efforts. 3. Linebarger's Fort Worth office has strong technology resources and is online with the County Tax Office, County District Clerk and various bankruptcy courts throughout the nation. 4. Linebarger's Fort Worth office collects for 45 taxing jurisdictions in Tarrant County and having the City's collections with the same firm should enhance collection efforts. M/WBE - Linebarger Goggan Blair&Sampson, LLP, is in compliance with the City's M/WBE Ordiance by committing to twenty percent (20 percent) M/WBE participation. The City's goal on this project is 20 percent. TERM - Following Council approval,the contract will begin July 1, 2010 and expire June 30, 2015. RENEWAL OPTIONS -This contract may be renewed for up to five successive one-year terms at the City's option. Exercising these options does not require specific City Council approval.
