KNOW ALL MEN BY THESE PRESENTS §
COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth is a home-rule city lying and
being situated within the Counties of Tarrant and Denton, State of
Texas; and
WHEREAS, the City of Keller is a home-rule city lying and
being situated within the County of Tarrant, State of.Texas; and
WHEREAS, the City of Fort Worth and the City of Keller desire
to adjust their extraterritorial jurisdiction boundary lines
whereby the City of Fort Worth will release from its exclusive
extraterritorial jurisdiction certain land to be annexed by the
City of Keller.
NOW, THEREFORE, BE IT RESOLVED AND MUTUALLY AGREED BY THE
CITY COUNCIL OF THE CITY OF FORT WORTH AND THE CITY COUNCIL OF THE
CZTY OF KELLER:
SECTION 1.
THAT the following extraterritorial jurisdiction boundary
• realignment between the City of Fort Worth and the City of Keller,
as hereby described, is in the best interests of the property
owners and inhabitants of both cities.
SECTION 2.
THAT the City of Fort Worth does hereby relinquish to the
City of Keller all extraterritorial jurisdictional rights it may
have in that territory reflected on Map Exhibit "A", attached
hereto and made a part hereof, and described by metes and bounds as
follows:
LEGAL DESCRIPTION
Being a 109.171 acre tract of land out of the Jessie Billingsley
Survey, Abstract 70 and the Samuel Needham Survey, Abstract 1171,
in Tarrant County, Texas, and being more particularly described by
metes and bounds as follows:
BEGINNING at a 1/2" iron rod found in the west line of the T.&P.
Railroad Company right-of-way, said iron rod being the northeast
• corner of a tract of land described as Tract Two in deed recorded
in Volume 7591, Page 1748, Deed Records, Tarrant County, Texas,
said point also being by deed called South 78 degrees 58 minutes 54
seconds West, 13.54 feet from the southeast corner of said
Billingsley Survey;
THENCE North 89 degrees 44 minutes 27 seconds West, along the north
line of said Tract Two, 200.41 feet to a 1/2" iron rod found at the
northwest corner of said Tract Two and at the northeast corner of
a 10.38 acre tract described by deed recorded in Volume 5432, Page
221, Deed Records, Tarrant County, Texas;
THENCE South 89 degrees 49 minutes 53 seconds West, along the north
line of said 10.38 acre tract, 1646.46 feet to a 1/2" iron rod
found for a corner at the southeast corner of a 100.0 foot wide
T.P. and L. easement and right-of-way described in Volume 6205,
Page 796, Deed Records, Tarrant County, Texas;
THENCE North 89 degrees 49 minutes 06 seconds West, 0.80 feet, to
a 1/2" iron rod found for a corner;
• THENCE North 89 degrees 57 minutes 45 seconds West, along the south
line of said easement and right-of-way, 98.2 feet to a 1/2" iron
rod found being the southwest corner of said easement, and the
southeast corner of Lot 26, Block 7, Hickory Park, an addition in
Tarrant County, Texas, according to the plat recorded in Volume
2

388-217, Pages 20 -and 21, Plat Records, Tarrant County, Texas,
continuing along the south line of said Block 7, in all 1449.03
feet, to a 5/8" iron rod found for a corner at the southeast corner
of a 305.340 acre tract described by deed recorded in Volume 10484,
Page 1367, Deed Records, Tarrant County, Texas;
THENCE North 0 degrees 45 minutes 59 seconds East, generally along
a fence and along the west line of Blocks 7, 4 and 1 in said
Hickory Park, and along the east line of said 305.340 acre tract,
1446.43 feet, to a 5/8" iron rod found for a corner at the
northwest corner of Block 1 of said Hickory and the southwest
corner of Tract Two, described by deed recorded in Volume 9506,
Page 2012, Deed Records, Tarrant County, Texas;
THENCE North 89 degrees 54 minutes 15 seconds East, along th south
line of said Tract Two, at 1369.22 feet a 5/8" iron rod found at
the northeast corner of Block 9 of said Hickory Park and the
northwest corner of said T.P. and L. easement and right-of-way, at
1469.22 feet a 5/8" iron rod found, continuing in all 2177.73 feet,
to a 1/2" iron rod found for a corner at the southeast corner of
said Tract Two and the southwest corner of a 2.4668 acre tract
described as Tract Three in Volume 8772, Page 1947, Deed Records,
Tarrant County, Texas;
THENCE 89 degrees 44 minutes 52 seconds East, 127.21 feet, to a
1/2" iron rod set for a corner in the west line of Pecan Park
Drive;
THENCE North 02 degrees 12 minutes 40 seconds East, along said west
line 564.23 feet, to a 1/2" iron rod found for a corner in the
south line of Golden Triangle Boulevard;
THENCE South 87 degrees 43 minutes 00 seconds East, along said
south line, 68.0 feet, to a 1/2" iron rod found for a corner;
THENCE South 02 degrees 12 minutes 40 seconds West, along the east
line of said Pecan Park Drive, 561.22 feet, to a 1/2" iron rod set
for a corner;
THENCE North 89 degrees 44 minutes 52 seconds East, 546.03 feet, to
a 1/2" iron rod set for a corner;
THENCE South O1 degree 23 minutes 41 seconds West, 105.08 feet, to
a 1/2" iron rod found for a corner;
THENCE North 89 degrees 55 minutes 52 seconds East, 208.38 feet, to
a post for a corner in the west line of a tract of land conveyed to
• the T.&P. Railroad Company by deed recorded in Volume Y, Page 219,
Deed Records, Tarrant County, Texas;

THENCE South 02 degrees 22 minutes 21 seconds West, along said west
line 202.72 feet, to a 1/2" iron rod set for a corner at the
southwest corner of said T.&P. Railroad Company tract;
THENCE South 88 degrees 22 minutes 12 seconds East, along the south
line of said T.&P. Railroad Company tract, 205.0 feet, to a 1/2"
iron rod found for a corner in the west line of the T.&P. .Railroad
Company right-of-way;
THENCE South 02 degrees 13 minutes 06 seconds West, along said west
line, 1137.63 feet, to the point of beginning, and containing
109.171 acres of land, more or less.
SECTION 3.
THAT the City of Keller hereby agrees to annex the property
released from the extraterritorial jurisdiction of the City of Fort
Worth as described herein and shown on Map Exhibit "A", and the
City of Keller agrees to assume the rights and obligations
appurtenant to said property.
SECTION 4.
THAT the City of Fort Worth and the City of Keller do hereby
covenant and agree to protect, preserve and defend the hereinabove
described boundary realignment and apportionment of extraterritori-
al jurisdiction.
SECTION 5.
THAT the City of Keller resolves and agrees, as a condition
to the release by the City of Fort Worth of the above described
territory, that the City of Keller will use said territory for the
• construction of a City-owned sports complex and park for the use
and benefit of the general public; that in the event the City of

Keller or its non-profit designee fails to use said land for said
purpose within five (5) years from the date of the mutual approval
and execution of this Joint Resolution and Agreement, or in the
• event the City of Keller ceases to use said land for said purposes,
then the City of Keller will initiate and carryout to conclusion
those actions which are necessary to remove the said territory from
within its corporate limits and to release it from its
extraterritorial jurisdiction and to cause it to be included within
the extraterritorial jurisdiction of the City of Fort Worth.
SECTION 6.
THAT the City of Fort Worth and the City of Keller agree and
resolve that the adoption by both cities of this Joint Resolution
and Agreement, and the release of the above described territory by
the City of Fort Worth, and the annexation thereof by the City of
Keller, does not mitigate, diminish or lessen in any way the rights
that either party may have, at law or in equity, to challenge or
contest any other annexations or attempted annexations made by the
other party.
SECTION 7.
THAT this Joint Resolution and Agreement shall become
effective and shall become a binding agreement upon the City of
• Fort Worth and the City of Keller by the adoption of same in
regular open City Council Meeting of the City of Fort Worth and the
City of Keller.

SECTION 8.
THAT the Joint Resolution and Agreement, upon adoption of
both cities, shall be executed in several originals and shall be
• spread in full on the minutes of each city. A copy of this Joint
Resolution and Agreement shall be executed by the Mayor and
attested by the City Secretary of each city.
