TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and Freese &
Nichols, Inc. , (ENGINEER) made and entered into City Secretary
Contract No . 48498, (the CONTRACT) which was authorized by M&C
C-28046 on the 13th day of December, 2016 in the amount of
$386,311 . 00; and
WHEREAS, the CONTRACT was subsequently revised by
Amendment No. 1 in the amount of $6, 963 .00 which was
administratively authorized February 28, 2017 , Amendment No . 2
in the amount of $34,592 . 00 which was authorized by M&C C-28316
on August 1, 2017 and Amendment No. 3 which was
administratively authorized on October 25, 2017 ; and
WHEREAS, the CONTRACT involves engineering services for
the following project:
Northside IV 24-inch Water Main, along Bowman
Roberts Road from Santa Gertrudis Street to Haltom
Bailey Boswell Road.
WHEREAS, it has become necessary to execute Amendment
No. 4 to the CONTRACT to include an increased scope of work and
revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
March 13, 2018 a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer totals $165,429.00.
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall be
an amount of $636. 477 . 00

Freese and Nichols, Inc. (FNI) is providing this proposal for amendment of the Additional EMWTP

SCOPE OF SERVICES
for Amendment#4
The scope of services for Amendment 4 to the NS IV contract will include design phase engineering
services, bid phase assistance and construction phase general representation services.
In 2017, design was completed for the Northside IV 24-inch water transmission main. This scope of
work is an amendment to that design contract.
The facilities to be designed for this project will generally include improvements to the Eagle
Mountain Water Treatment Plant(EMWTP) Phase III expansion with:
• A new 3-MGD pump in the existing HSP-H-20 slot at the Eagle Mountain Water Treatment
Plant high service pump station with VFD, mechanical piping, valves, and electrical
components in the existing electrical building;
• A new 15,000-gallon hydropneumatic tank.
It is anticipated these design elements will be combined into a single procurement packages.
The detailed scope of work is described below.
BASIC SERVICES
1. Preliminary and General Items
a. Kick-off Meeting-Conduct one meeting with City to confirm the goals,schedule, and
deliverables for the project.
b. Obtain and Review City-Furnished Front-End Documents-Meet with City to resolve review
comments and revise Engineer's standard documents accordingly.
2. Design Phase Services
a. Plan Set Cover Sheet— Prepare cover sheet providing the name of the project and a
vicinity map and general project layout.
b. Civil Design and Drawings-Prepare plan,section and details for installation of the new
pump, hydropneumatic tank, and all appurtenances.
c. Electrical & Instrumentation Design and Drawings — Provide electrical and instrumentation
design to support the new pump addition.Prepare detailed electrical and instrumentation
drawings to support the one additional pump,variable frequency drive,transformers,
switchgear,and other equipment that will be put into service. Provide electrical and pump
pad plans,site plans,one-line diagrams,process and instrumentation diagrams,and SCADA
architecture diagrams.
a. HVAC Technical Memorandum–Provide an analysis of existing HVAC capacity at the
existing Electrical Building 3 to determine if improvements to HVAC are required.
d. HVAC Design and Drawings–Provide HVAC design services to support the new pump
addition.
e. General Detail Sheets — Prepare standard and general detail sheets
f. Specification Preparation — Prepare required front-end and technical specifications.
g. Prepare Preliminary Opinion of Probable Construction Cost — Create an opinion of
probable construction cost based upon the design documents including quantity take-offs
for the detailed design and input from equipment manufacturers.
h. Design Submittal-A total of five (5)sets of half size (11"x17") design documents will be

submitted to City for review.
i. Design Review Comments and Workshop-City will consolidate their submittal review
comments and provide to the Engineer.The Engineer will incorporate City's comments into
subsequent submittals or prepare a written response of disagreement.A workshop will be
conducted by Engineer with the City to review the comments.
j. Revise Design Documents— Following the Design Workshop and after receipt of City
review comments,when applicable, revise Design Documents. Update and finalize all
drawings as required.
k. Probable Construction Cost Update-The project opinion of probable construction cost will
be generated based on quantity take-off of the detailed design of all work items to be
included.
I. Issue Final Contract Documents-Submit five (5)sets of final documents(with half size
drawings).
m. TCEQ Report and Coordination–Update the engineering report and submit report and
plans to TCEQ.
3. Bid Phase Services
It is assumed that the related pump work and hydropneumatic tank work will be bid together.
a. Bid Invitation -Coordinate bid letting date,time, and place for the project with City and
prepare final Invitation to Bid.
b. Advertisement for Bid-Assist and advise City in placing the advertisements of the Invitation
to Bid.
c. Bidders List- Identify potential contractors and suppliers acceptable to City and distribute
copies of invitation to bid.
d. Bid Documents Provide an electronic set of Bid Documents for bidding purposes and
distribute the contract documents to prospective bidders via City's plan room.
e. Plan Holders List- Distribute plan holders lists of recipients of Bid Documents prior to bid
opening. Maintain a record of prospective bidders and suppliers to whom contract
documents have been issued.
f. Interpret Construction Contract Documents-Prepare and issue addenda to the Bid
Documents when required.
g. Bid Tabulation& Initial Review-Assist City during bid opening, making preliminary.
tabulation of bids, and review questionnaires and bids for completeness.
h. Bid Review- Review and evaluate the qualifications of the apparent successful bidder and
the proposed major or specialty subcontractors.The review and evaluation will include
such factors as work previously completed, proposed pump, equipment that is available for
the work, publicly available financial resources,technical experience, and responses from
references.
i. Issue Construction Contract Documents- Prepare and distribute conforming(with all
addenda posted).ten copies of the construction contract documents.These services will
include review of contractor's bonds,furnishing to the Contractor unsigned construction
contract documents, and transmitting the construction contract documents to City for
signature and distribution. Conformed drawings will also be provided in electronic format.
4. Construction Phase Services-General Representation
It is assumed that the related pump work and hydropneumatic tank work will be bid together.
a. Project Administration -Engineer will perform project administration services during the
construction phase of the project. By performing these services, Engineer shall not have
authority or responsibility to supervise, direct, or control the Contractor's work or the
Contractor's means, methods,techniques,sequences,or procedures of construction.

Engineer shall not have authority or responsibility for safety precautions and programs
incident to the Contractor's work or failure of the Contractor to comply with laws,
regulations, rules, ordinances,codes or orders applicable to the Contractor furnishing and
performing the work.Specific services to be performed by Engineer are as follows:
L Review Contractor's Insurance Certificates- Review the Contractors Insurance
certificates and forward the certificates to City acceptance by Citys legal counsel.
Engineer's review of the insurance certificates is only for the purpose of
determining if the Contractor maintains the general types and amounts of
insurance required by the contract documents and is not a legal review to
determine if the Contractor's insurance coverage complies with all applicable
requirements.
ii. Pre-construction Conference-At a date and time selected by City at a facility
provided by City, attend the pre-construction conference and assist City during the
conference.With assistance from Engineer, City shall prepare an agenda for the
conference,and prepare and distribute minutes.The pre-construction conference
shall include a discussion of the Contractor's tentative schedules, procedures for
transmittal and review of the Contractor's submittals, processing payment
applications,critical work sequencing, change orders,record documents,and the
Contractor's responsibilities for safety and first aid.
iii. Construction Schedule Review-Review and comment on the Contractor's initial
and updated construction schedule and advise City as to acceptability.
iv. Construction Sequence Review-Analyze the Contractor's construction schedule,
schedule of values, activity sequence,and construction procedures as applicable to
City's ability to keep existing facilities in operation.
b. Progress meetings—Attend periodic progress meetings(up to four)with the City to review
progress of the work and consult with the City and the Contractor concerning issues with
the work.
c. Construction site visits- Make periodic visits (up to four)to the construction site over the
construction period to observe progress of the work and consult with the City and the
Contractor concerning problems and progress of the work.
d. Submittal Review-Review drawings and other data submitted by the Contractor as
required by the construction contract documents. Engineer's review shall be for general
conformity to the construction contract documents and shall not relieve the Contractor of
any of his contractual responsibilities.Such reviews shall not extend to means, methods,
techniques,sequences, or procedures of construction, or to safety precautions and
programs incident thereto. Engineer shall maintain a log of all submittals.The log shall
include the submittal number,title, date received, review comments, date returned, date
resubmitted, etc.
e. Warrantee and Test Review- Receive and review guarantees, bonds and certificates of
inspection, and tests and approvals which are to be assembled by the Contractor in
accordance with the construction contract documents and transmit them to City.
f. Request for Information—Interpret construction contract documents when requested by
City or the Contractor.The Engineer shall maintain a log of the requests for information (RFI
log).The log will include the date of the request, a brief description, reviewer,and date of
response.
g. Change Management—Provide documentation and administer the processing of contract
modifications. Evaluate the cost and scheduling aspects of all change orders.
h. Review Contractor's Monthly Payment Requests—Review monthly estimates for the

purpose of estimating progress payments to the Contractor. City is responsible for verifying
the quantities of work which are the basis of the payment requests and that the work
complies with the Contract Documents.
i. Performance Test Review—Analyze data from performance testing of equipment by the
Contractor or supplier when the construction contract documents require the equipment to
be tested after installation.Submit conclusions to City.
j. Startup Assistance—Attend on-site equipment and system start-up and commissioning
activities for the new HSP-H-20 pump and hydropneumatic tank.These services include:
L HSP-H-20:
1. Civil/Process Engineer(x2) 4 Site Visits 4 days
2. Electrical/Controls Engineer 4 Site Visits 4 days
3. HVAC/Mechanical Engineer 1 Site Visit 1 days
ii. Hydropneumatic tank:
1. Civil/Process Engineer(x2) 3 Site Visits 3 days
2. Electrical/Controls Engineer 1 Site Visits 1 days
k. Substantial Completion Inspection—Upon substantial completion,work with City to inspect
the construction work and prepare a punch-list of those items to be completed or corrected
before final completion of the project. Submit results of the inspection to City and the
Contractor.
I. Final Inspection—Upon completion or correction of the items of work on the punch-list,
conduct a final inspection with City and Contractor to determine if the work is completed.
Provide written recommendations concerning final payment to City, including a list of
items, if any,to be completed prior to making such payment.
m. Construction Records- Upon completion of the project, revise the construction contract
drawings to conform to the construction records. Submit two copies of the prints and one
set of 3 mil wash-off black-lined Mylar reproducible. An electronic version of both
Drawings and Specifications shall be provided to City in electronic format on flash drive.
SURVEYING
2. Additional Survey at High Service Pump Station
a. Horizontal and vertical data will be based on the previous topographic survey and control
previously provided. Items included are:
L Spot elevations at the HSP-H-20 site
ii. Spot elevations at the hydropneumatic tank site
a.
ADDITIONAL SERVICES
This scope excludes:
• Corrosion engineering,
• Surge protection engineering,
• Geotechnical engineering,
• Sue,
• Extension of the metal building at the high service pump station.

RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment No. 4 to City Secretary
Contract No. 48498, an Engineering Agreement with Freese and Nichols, Inc., in the amount of
$165,429.00 for a revised contract in the amount of$636,477.00 for Northside IV 24-Inch Water
Transmission Main along Bowman Roberts Road from Santa Gertrudis Street to Haltom Bailey Boswell
Road Project. (City Project No. 100277)
DISCUSSION:
On December 13, 2016 Mayor and Council Communication (M&C C-28046) the City Council authorized
the execution of an Engineering Agreement with Freese and Nichols, Inc., in the amount of$386,311.00
for the preparation of plans and specifications for the Northside IV 24-Inch Water Transmission Main along
Bowman Roberts Road from Santa Gertrudis Street to Haltom Bailey Boswell Road Project. The
agreement was subsequently revised by three amendments as follows: Amendment No. 1 in the amount
of$6,963.00 administratively authorized February 28, 2017; Amendment No. 2 in the amount of
$34,592.00 authorized by M&C C-28316 on August 1, 2017 and Amendment No. 3 in the amount of
$43,182.00 administratively authorized October 25, 2017.
Amendment No. 4 will provide for the necessary design for a new 3 Million Gallon Pump at the Eagle
Mountain Water Treatment Plant and a new 15,000-gallon hydro pneumatic tank with all of the mechanical
piping, valves and electrical components in the existing electrical building. The proposed pump and tank
will provide for increased capacity and delivery reliability to existing and future customers in the vicinity of
the Eagle Mountain Water Treatment Plant. In addition to the amendment amount, $60,000.00 is required
for increased project management and inspection costs.
M/WBE OFFICE: A waiver of the goal for MBE/SBE subcontracting requirements was requested by the
Department and approved by the MWBE Office, in accordance with the M/WBE or BIDE Ordinance,
because the purchase of goods or services from source(s) where subcontracting or supplier opportunities
are negligible.
The project is located in COUNCIL DISTRICTS 2 and 7.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budgets, as appropriated, of
the Water/Sewer Bond 2017A Fund. The Major Mains Programmable Project P00002 includes an
appropriation of$9,874,000.00 for the Water main capital projects. After the funding of this M&C, the
amount of$9,648,571.00 of the appropriation will be available to fund future individual projects
