HomeMy WebLinkAboutOrdinance 23220-05-2018 ORDINANCE NO.23220-05-2018 AN ORDINANCE AMENDING CHAPTER 22 "MOTOR VEHICLES AND TRAFFIC,"ARTICLE VI "STOPPING,STANDING,PARKING,"DIVISION 1 "GENERALLY," OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (2015), AS AMENDED, BY AMENDING SECTIONS 22-191 "ESTABLISHMENT OF ZONES AND MAXIMUM PARKING TIME THEREIN; ESTABLISHMENT OF FEES," AND 22-192 "HOURS METERS TO OPERATE; INFORMATION TO BE SHOWN ON METERS" TO ESTABLISH PARKING METER TIMES, RATES, AND BOUNDARIES IN THE WEST 7TH URBAN VILLAGE CORE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL CONFLICTING ORDINANCES; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER OF THE CITY; AND PROVIDING AN EFFECTIVE DATE OF AUGUST 3,2018. WHEREAS, the City Council of the City of Fort Worth ("City Council") seeks to protect the public safety and preserve the quality of life within the City; and WHEREAS, City staff completed a parking and curb use investigation study within the West 7th Urban Village Core and found occupancy rates greater than 92% across 1,280 parking opportunities in a three week period; WHEREAS, these high parking occupancy rates have contributed to significant traffic gridlock in the West 7 1 Urban Village Core; WHEREAS, it is advisable to amend Chapter 22 of the Code of the City of Fort Worth, Texas (2015), as amended, ("City Code") to establish parking meter times, rates, and boundaries in the West 7th Urban Village Core; and WHEREAS, the City Council finds this Ordinance to be reasonable and necessary; NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS,THAT: SECTION 1. Chapter 22 "Motor Vehicles and Traffic," Article VI "Stopping, Standing and Parking," Division 1 "Generally," Sections 22-191 "Establishment of Zones and Maximum Parking Time Therein; Establishment of Fees" and 22-192 "Hours Meters to Operate; Information to be Shown on Meters" of the City Code is hereby amended to establish parking meter times, rates, and Ordinance No. Page 1 of 5 boundaries in the West 7th Urban Village Core to be and read as follows: § 22-191 ESTABLISHMENT OF ZONES AND MAXIMUM PARKING TIME THEREIN; ESTABLISHMENT OF FEES. (a) The traffic engineer is hereby authorized to designate parking meter zones upon any street or portion of street where it is determined, upon the basis of an engineering and traffic investigation,that the installation of parking meters shall be necessary to aid in the regulation,control or inspection of vehicles which are parked or operated on public streets. The parking of vehicles in such parking meter zones shall be controlled and regulated by parking meters installed and maintained by the designee of the director of the transportation and public works department and located upon the curb either adjacent to the parking space or at one or more locations within the block face. (b) A designee of the director of the transportation and public works department may designate the maximum parking time for each parking meter, basing the decision upon the investigation set forth above. The designee is hereby authorized to establish parking meter fees for any parking meter that has been placed upon any street or other property owned or controlled by the city. (c) The fees for parking shall be paid in the currency of the United States of America. The following fees are hereby established for public parking at any parking meter that is governed by this section: (1) Except for in the West 7th Urban Village Core, short-term parking fees (less than four hours) will be a rate between $0.20 and $0.25 for each ten minutes. These rates include any applicable sales tax. Short-term parking fees shall apply to a meter during time periods for which the meter has been designated for short-term parking use only. The designee of the director of transportation and public works makes this designation and establishes the rate based upon the public's need for parking availability. Short-term parking helps ensure that a space is not used for lengthy periods of time by one vehicle. (2) In the West 7th Urban Village Core, the short-term parking fees (less than four hours) will be a rate between $0.15 and $0.75 for each ten minutes. These rates include any applicable sales tax. Short-term parking fees shall apply to a meter during time periods for which the meter has been designated for short-term parking use only. The designee of the director of transportation and public works makes this designation and establishes the rate in the West 7th Urban Village Core based upon the public's need for parking availability. (3) Long-term parking fees (four hours or more): A parking rate between $0.05 and $0.125 for each ten minutes. These rates include any applicable sales tax. Long-term parking fees shall apply at meters during those periods in which they have not been designated for short-term parking use. (4) Parking rate for assigned permit spaces for mobility impaired employees: Ordinance No. _qVY Page 2 of 5 $100 per month. (d) Without limiting the options available to the designee of the director of transportation and public works, the times and days designated for short-term or long-term parking may vary. § 22-192 HOURS METERS TO OPERATE; INFORMATION TO BE SHOWN ON METERS. (a) Except within the Cultural District and the West 7th Urban Village Core, parking meters at the established rates shall regulate the parking of vehicles between the hours of 8:00 a.m. and 6:00 p.m., unless otherwise specified by sign, of any day, except Saturdays and Sundays; or when a street sign specifically prohibits parking. (1) Within the cultural district, parking meters at the established rates shall regulate the parking of vehicles between the hours of 6:00 a.m. and 10:00 p.m., unless otherwise specified by sign, of any day, including Saturdays, Sundays and holidays; or when a street sign specifically prohibits parking. (2) Within the West 71h Urban Village Core, parking meters at the established rates shall regulate the parking of vehicles between the hours of 10:00 a.m. and 10:00 p.m., unless otherwise specified by sign, of any day, including Saturdays and Sundays; or when a street sign specifically prohibits parking. (b) Except within the Cultural District, the following parking meter holidays will be observed: (1) New Year's Day—January first; (2) Martin Luther King Jr.'s Birthday—Third Monday in January; (3) Veteran's Day—November eleventh; (4) Memorial Day—Last Monday in May; (5) Independence Day—July fourth; (6) Labor Day—First Monday in September; (7) Thanksgiving Day—Fourth Thursday in November; (8) Thanksgiving Friday—Friday after the Fourth Thursday in November;and (9) Christmas Day—December twenty-fifth. (c) When a parking meter holiday falls on a Saturday and the holiday is officially observed on the preceding Friday, the parking meter holiday will be observed on Friday. When a parking meter holiday falls on a Sunday and is officially observed on the following Monday, the parking meter holiday will be observed on Monday. (d) The city council may also from time to time designate parking meter holidays or cultural district parking meter holidays for special events or activities when such action is in the best interest of the city. (e) Each parking meter shall bear thereon a legend indicating the days and hours when the requirements to deposit coins therein shall apply and the value of the coins to be deposited. (f) For purposes of this division, the CULTURAL DISTRICT shall be defined Ordinance No. Z 7fU-of'-fol"( Page 3 of 5 as the area bounded by University Drive on the east, Camp Bowie Boulevard on the north, Montgomery Street on the west, and West Freeway Service Road on the south. (g)For purposes of this division, the WEST 71H URBAN VILLAGE CORE shall be defined as the area bounded by Foch Street to the east, University Drive to the west, Lancaster Avenue to the south and West Sixth Street to the north. (h) The city manager or his or her designee may waive the parking fees for meters within the cultural district during periods of off-peak demand for parking by causing the meter(s) to be deactivated or encased. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances of the Code of the City of Fort Worth, Texas, (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the phrases,clauses,sentences, paragraphs and sections of this ordinance are severable,and,if any phrase,clause,sentence,paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction,such unconstitutionality shall not affect any of the remaining phrases, clauses,sentences,paragraphs and sections of this ordinance,since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,paragraph or section. SECTION 4. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of the Code of the City of Fort Worth, or any other ordinances of the City,that have accrued at the time of the effective date of this ordinance;and,as to such accrued violations and all pending litigation,both civil and criminal, whether pending in court or not,under such ordinances, same shall not be affected by this ordinance, but may be prosecuted until final disposition by the courts. SECTION 5. Violation of the provisions of this ordinance shall be civil offenses subject to civil penalties and fines pursuant to the procedures for administrative adjudication as set forth in Chapter 10 of this Code. Accordingly, any person, firm, or corporation who violates this ordinance related to the parking, stopping or standing of vehicles shall be fined in an amount not exceeding two Ordinance No.i j f o-6-k I Y Page 4 of 5 hundred dollars ($200.00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 6. The City Secretary of the City of Fort Worth, Texas is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Texas Local Government Code, Section 52.013. SECTION 7. All other provisions of Chapter 22 of the Code of the City of Fort Worth, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 8. After publication as required by law, this ordinance shall take effect 12:01 a.m. August 3, 2018, and it is so ordained. Adopt the attached ordinance amending Chapter 22, Sections 22-191 and 22-192 of the City Code to establish operational hours for on-street parking meters, parking meter rates, and boundaries for the West 7th Urban Village Core to be effective August 3, 2018; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Municipal Parking Fund, from available funds in the amount of$190,000.00, including $115,000.00 for a capital transfer, for installing the parking meters for the West 7th Urban Village Core and $75,000.00 for staff costs; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Municipal Parking Capital Fund, from available funds in the amount of$115,000.00 as a capital transfer from the Municipal Parking Fund. DISCUSSION: On May 8, 2018, at City Council Work Session, staff provided a briefing on the continued growth and development within the West 7th Street Urban Village Core and the resulting traffic demand and lack of on-street parking for business patrons. Numerous work sessions have occurred with area stakeholders to understand the mobility and parking issues of the area and develop actions that would be appropriate to improve conditions. The availability of on-street parking for business patrons was determined to be an important element to maintain and grow the economic vitality of the area. Based on the feedback from stakeholders, it is recommended to deploy paid, on-street parking with time restrictions in the West 7th Street Urban Village Core area so that more parking spaces are available, which allows different customers to visit the area. Staff recommends that Chapter 22, Sections 22-191 and 22-192 of the Code of the City of Fort Worth, Texas (2015), as amended, (City Code), be amended to allow installation of parking meters in the area. Staff recommends the West 7th Urban Village Core boundaries be established as the area bounded by Foch Street to the east, University Drive to the west, Lancaster Avenue to the south and West Sixth Street to the north. Staff further recommends that parking meters be installed in the West 7th Urban Village Core and operational from 10:00 a.m. to 10:00 p.m. daily. This change will provide 84 hours per week of regulated, on-street metered parking time where currently there is limited or no regulation within the high demand retail and restaurant district area. Logname: 20WEST 7TH URBAN VILLAGE CORE ON STREET PARKING RATES Page I of 3 In addition to the introduction of regular and extended metered hours to the West 7th Urban Village Core, it is also recommended that a variable rate structure should be implemented to address the supply and demand imbalance by changing parking rates in response to parking demand. Staff proposes to amend the short-term rate structure (less than four hours) for the West 7th Urban Village Core area such that the parking rate would be a variable rate between a low of$0.15 and a high $0.75 per ten minutes (i.e. from $0.90 per hour to $4.50 per hour)with the intent to establish initial rates of$1.00 per hour between 10:00 a.m. and 4:00 p.m. and $2.50 per hour between 4:00 p.m. and 10:00 p.m. throughout the week. The combination of extended-hour metered parking and the implementation of variable rate parking has been used in high demand business and entertainment districts in large cities such as Seattle, New York, San Francisco, and Boston to address the issue of excessive parking demand and a limited supply of on- street spaces. These cities now have extended hour parking and a variable rate structure with rates as low as $1.00 per hour during times of the lowest demand (less than 60% occupancy) and as high as $8.00 per hour in times of the highest demand when parking occupancy level exceed 80%. This combined strategy has led to significant improvements in the parking and traffic equation such as higher turn rates for each space, reduction in traffic congestion, improved space availability on each block face, and noted improvement in sales taxes in many of these business and entertainment districts. To accommodate on-street parking meters the West 7th Restaurant & Bar Association has negotiated a lease agreement with the Fort Worth Independent School District for use of the nearby Farrington Field parking lot, which will provide additional parking for the employees and patrons of the area. This arrangement provides an excellent alternate parking arrangement for patrons, which will offer the combination of inexpensive parking rates and longer term parking. This option will lead to overall less demand for on-street parking spaces during peak demand periods and is part of the strategy to reduce traffic circulation and congestion in this area. On December 12, 2017, (M&C G-19187) City Council approved the Five Year Municipal Parking Fund (MPF) Capital Improvement Plan (CIP) which addressed the need for expansion of metered parking into areas such as the West 7th Urban Village Core. Capital and installation costs to startup metered parking in the final quarter of Fiscal Year 2018 will be $240,000.00, of which $125,000.00 has already been appropriated through M&C G-18772. An additional $115,000.00 needs to be appropriated for installation and startup costs, and an additional $75,000.00 needs to be appropriated for parking compliance and parking service workers for the remaining Fiscal Year 2018. Staff expects that the revenue during the final quarter of Fiscal Year 2018 from the new metered parking area in the West 7th Urban Village Core will cover 90% of the $190,000.00 overage with the remaining $20,000.00 covered by surplus meter revenue from other operational areas. An improvement package has been submitted to address costs in Fiscal Year 2019 and beyond, all of which are anticipated to be covered by the resulting revenue stream. The meters within the West 7th Urban Village Core will be located within COUNCIL DISTRICT 9. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director o Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available as appropriated of the Municipal Parking Fund and the Municipal Parking Capital Fund budgets and that the Municipal Parking Fund is responsible for the collection and deposit of funds due to the City.
