AN ORDINANCE ESTABLISHING A PAY RATE ADJUSTMENT FOR MUNICIPAL
COURT JUDGES CHARLES T. ATKINSON, ANDREW T. BRADSHAW, RAQUEL D.
BROWN, ANN Y. COLLINS, SIMON C. GONZALEZ, CLAUDIA A. MARTINEZ,
ROBERT NEEL MCDONALD, PATRICIA L. SUMMERS, DEPUTY CHIEF JUDGE JO
ANN REYES, AND CHIEF JUDGE JAMES D. RODGERS; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, Section 30.00006 (h) of the Texas Government Code provides that the
governing body of the municipality shall determine the salary of the municipal judges;
WHEREAS, Section 10-2 of the City Code states that the Ad Hoc Municipal Court
Advisory Committee shall make recommendations to the city council on all matters relating to the
municipal court judges; and
WHEREAS, the Ad Hoc Municipal Court Advisory Committee recommended that the
Municipal Judges, Deputy Chief Judge and Chief Judge listed below receive a 7% pay rate
adjustment for Fiscal Year 2017-2018 and an additional 7% pay rate adjustment for Fiscal Year
2018-2019.
NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS,AS FOLLOWS:
SECTION 1.
That Municipal Judges Charles T. Atkinson,Andrew T. Bradshaw,Raquel D. Brown,Ann
Y. Collins, Simon C. Gonzalez, Claudia A. Martinez, Robert Neel McDonald, Patricia L.
Summers, Deputy Chief Judge Jo Ann Reyes and Chief Judge James D. Rodgers, receive a 7%
pay rate adjustment for Fiscal Year 2017-2018, with a new pay rate set at $53.21 per hour for

Fiscal Year 2017-2018 for Municipal Judges Charles T. Atkinson, Raquel D. Brown, Ann Y.
Collins and Patricia L. Summers; a new pay rate set at $55.49 per hour for Fiscal Year 2017-2018
for Municipal Judges Andrew T. Bradshaw, Simon C. Gonzalez, Claudia A. Martinez,and Robert
Neel McDonald; a new pay rate set at$57.50 per hour for Fiscal Year 2017-2018 for Deputy Chief
Judge Jo Ann Reyes;and a new pay rate set at$66.87 per hour for Fiscal Year 2017-2018 for Chief
Judge James D. Rodgers, effective April 1, 2018.
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where provisions of this ordinance are in
direct conflict with the provisions of such ordinances and Code, in which event such conflicting
provisions of such ordinances and Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable,and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the
valid judgment or final decree of a court of competent jurisdiction, such ineffectiveness or
unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs
and sections of this ordinance,since the same would have been enacted by the City Council without
the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence,
paragraph or section.

SECTION 4.
The pay adjustment provided under this ordinance shall take effect April 1, 2018.

Adopt Ordinance Establishing a Pay Rate Adjustment for Eight Municipal Court Judges, Deputy Chief
Judge and Chief Judge Effective April 1, 2018 (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance establishing a pay rate adjustment
for Eight Municipal Court Judges, Deputy Chief Judge and Chief Judge to be effective on April 1, 2018.
DISCUSSION:
Section 30.00006(h) of the Texas Government Code requires the City Council to set the salary for the
Municipal Judges. On March 6, 2018, the Ad Hoc Municipal Court Advisory Committee heard a
presentation on proposed pay raises for the Municipal Judges, Deputy Chief Judge and Chief Judge. On
March 27, 2018, City Council adopted Ordinance No. 23157-03-2018, appointing ten Municipal Court
Judges and appointing one Municipal Judge as Chief Judge and one Municipal Judge as Deputy Chief
Judge. On May 15, 2018, the Ad Hoc Municipal Court Advisory Committee heard a supplemental
presentation on judicial salaries. After discussion, the Committee voted unanimously to recommend to the
City Council a 7% percent pay rate adjustment in FY 2018, and an additional 7% pay rate adjustment in
FY 2019, for a total of a 14% pay rate adjustment over a two year period for the Municipal Judges, the
Deputy Chief Judge and the Chief Judge. The attached ordinance is for a 7% pay rate adjustment for FY
2018. A separate M &C and ordinance will be submitted in FY 2019 for any pay rate adjustment for the
2019 Fiscal Year. The new pay rate adjustment will set the FY 2018 hourly pay rate for the Deputy Chief
Judge, Chief Judge and 8 Municipal Judges as follows:
1. An hourly rate of$53.21 in FY 2018 for Municipal Judges Charles Tyler Atkinson, Raquel D. Brown,
Ann Y. Collins and Patricia L. Summers;
2. An hourly rate of$55.49 in FY 2018 for Municipal Judges Andrew T. Bradshaw, Simon C. Gonzalez,
Claudia A. Martinez, and Robert Neel McDonald,
3. An hourly rate of$57.50 in FY 2018 for Deputy Chief Judge Jo Ann Reyes; and
4. An hourly rate of$66.87 in FY 2018 for Chief Judge James Rodgers.
The pay rate adjustments are to be effective April 1, 2018. The total estimated salary cost for the
eight Municipal Court Judges for the remainder of the Fiscal Year 2018 is $30,717.68. The total estimated
salary cost for the Deputy Chief Judge position for the remainder of the Fiscal Year 2017-2018 is
$4,066.46. The total estimated salary cost for the Chief Judge position for the remainder of Fiscal Year
2017-2018 is $4,725.00, for a total estimated cost of$39,509.14.
This M&C does not request approval of a contract with a business entity.
