AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE AMOUNT OF $313,268.00 IN THE WATER CAPITAL FUND, FROM AVAILABLE
FUNDS, FOR EMERGENCY WORK TO REPAIR THE PORTION OF THE SANITARY
SEWER LATERAL ON VALLEY VIEW DRIVE; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the amount
of$313,268.00 in the Water Capital Fund, from available funds, for emergency work to repair the portion of
the sanitary sewer lateral on valley view drive.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Ratify Emergency Contract with William J. Schultz, Inc. d/b/a Circle " C" Construction Company, City
Secretary No. 48977, in the Final Amount of$313,268.60 for Emergency Sanitary Sewer Repair Work
Performed on Valley View Drive and Adopt Appropriation Ordinance (COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Fund in the amount of$313,268.00 from available funds; and
2. Ratify the Emergency Agreement with William J. Schultz, Inc. d/b/a Circle C Construction Company,
City Secretary No. 48977, in the final amount of$313,269.00 for emergency work to repair the portion of
the sanitary sewer lateral (L-3792) located on Valley View Drive from mid-block to Westridge Drive. (City
Project No. 101532)
DISCUSSION:
The emergency work performed on Valley View Drive was necessary to alleviate repeated complaints of
sewage backups from some residents on the street which resulted from collapse of portions of the existing
sewer lateral (L-3792) that serves the residents. Due to the inaccessible location of the sewer underneath
some residencies, it was necessary to abandon a segment of the line by installing a new main to route
sewer flow to an existing lateral on Ridglea Drive and conduct trenchless repair on the segment of L-3792
to the west.
It was beyond the City's ability to perform repairs of this complexity. The Water Department engaged
William J. Schultz, Inc. d/b/a Circle C Construction Company for the emergency repair to the sanitary
sewer main on Valley View Drive.
The attached City Manager Memo dated March 16, 2017 approved the emergency work up to
$600,000.00. The total construction cost was $313,268.60, which is fair and reasonable for the work
performed.
Sanitary Sewer Overflows are a threat to the health and safety of the City of Fort Worth. Chapter 2, Article
I, Section 2-9 of the City's Code of Ordinances and Section 252.022 of the Local Government Code
exempts from normal bidding requirements expenditures that are necessary to preserve or protect public
health or safety of the municipality' s residents; and procurements that are necessary because of
unforeseen damage to public machinery, equipment, or property.
This project was located in COUNCIL DISTRICT 3.

This contract legally does not require City Council approval.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Water Capital Projects Fund. The Fiscal Year 2018 Water Operating Budget includes appropriations of
$29,022,689.00 for the purpose of providing Pay-As-You-Go funding for Sewer Capital Projects. After this
transfer for Fiscal Year 2018, the balance will be $7,285,559.00.
