AN ORDINANCE ADOPTING A WATER MAIN
CAPACITY CHARGE FOR A CITY INITIATED 24-INCH
WATER MAIN N.S. IV IN BOWMAN ROBERTS ROAD
RUNNING NORTH TO HALTOM BAILEY BOSWELL
ROAD; MAKING THIS ORDINANCE CUMULATIVE OF
OTHER ORDINANCES; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; PROVIDING A SAVINGS
CLAUSE,AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, City Council adopted an ordinance amending Chapter 35 of the City
Code, "Water and Sewers" which adopted a Division 4 to Article III as "Water Main
Capacity Charges" providing for the adoption of Water Main Capacity charges when
certain criteria are met; and
WHEREAS, the City of Fort Worth is constructing a City initiated 24-inch water
main in Bowman Roberts Road running North to Haltom Bailey Boswell Road.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH,TEXAS:
SECTION 1.
The City Council finds,in accordance with Chapter 35"Water and Sewers",Article
III, Division 4, Sections 35-87 through 35-92 of the City Code, the City has initiated
construction of an approach water main in Bowman Roberts Road running North to Haltom
Bailey Boswell Road and that such City-initiated approach water main is 24-inches in
diameter. Developer, Centex, paid for 12-inch construction cost $738.300.00 along with
$110,745.00 in design fees.
SECTION 2.
The City Council further finds that the City cost for the construction of the 24"
water main N.S IV is $4,194,470.00. Centex contributed to construction cost to the City
in the amount $849,045.00 for a 12" water main. Therefore, the Water Main Capacity per
MGD shall be $395,259.80 if the plat meets the definition of "Other Development" as
defined in Section 35-88(1) of the City Code as amended. The City Council further finds
that the Water Main Capacity charge has been calculated in accordance with the
requirements of the Water Main Capacity Charge Policy.
SECTION 3.
The City Council also hereby directs the Fort Worth Water Department to review
the plats that are located in or around the boundary area as described in Exhibit "A" to
determine if the charge for reimbursement will be assessed in accordance with Section 35-
93.
SECTION 4.
This ordinance shall be cumulative of all provisions of ordinances and of the Code
of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this
ordinance are in direct conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 6.
This ordinance shall be effective upon adoption.

Gallons Per Day for a Twenty-Four Inch Water Main as Part of Phase 1 to Serve Northside IV Pressure
Plane from the Eagle Mountain Water Treatment Plant at Bowman Roberts Road and Santa Gertrudis to
W. Bailey Boswell Road Development Pursuant to Chapter 35, Article III, Division IV, Water Main Capacity
Charges, Sections 35-90 and 35-92 of the City Code (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance to establish the water main capacity charge for the 24-inch Northside
IV water main to serve the surrounding area from the Eagle Mountain Water Treatment Plant at
Bowman Roberts Road and Santa Gertrudis to W. Bailey Boswell Road, to be $395,259.80 per
million gallons per day in accordance with City Code Chapter 35, Article III, Division IV, Water Main
Capacity Charges. Sections 35-90 and 35-92; and
2. Establish the boundary area for the water main to allow the Water Department to assess a
reimbursement for the design, construction and easement costs of the project.
DISCUSSION:
The 24-inch water main in Bowman Roberts Road was installed by the City of Fort Worth. Centex Homes
paid for the construction cost of a 12-inch water main only, easement costs from 6250 W. Bailey Boswell
Road, and design costs based on its needs for its development. The remainder of the costs for the 24-inch
main were paid by the City of Fort Worth. The City paid 83.17% of the total project costs and will be
reimbursed by any future developer that meets the definition of"Other Development" pursuant to the
ordinance.
This water main meets the criteria established under the water main capacity charge policy. The total
qualified cost used to establish this water main capacity charge is $5,043,515.00. The qualified summary
costs used to establish this water main capacity charge are outlined below:

The water main capacity charge for the 24-inch water main near the Eagle Mountain Water Treatment
Plant at Bowman Roberts Road and Santa Gertrudis to W. Bailey Boswell Road in the Northside IV
pressure plane is $395,259.80 per MGD in accordance with City Code Section 35-92. This amount will be
reimbursed to the City of Fort Worth based on the additional water main capacity made available to future
development by the City, pursuant to the Water Main Capacity ordinance.
The boundary area that will be established is determined for the purpose of an assessment review. The
boundary is used as a guideline, not as a definitive boundary for the service area due to the possibility of
varying lot sizes that may be proposed. If a plat meets the definition of" Other Development" stated in the
water main capacity charge policy, then the plat will be assessed the water main capacity charge even
though the plat may be located adjacent to, within, and/or outside the boundary area.
The adoption of this charge is in accordance with Chapter 35, "Water and Sewers" , Division IV, "Water
Main Capacity Charges" .
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that the Water Department will be responsible for the administration and
collection of funds under this Ordinance.
