HomeMy WebLinkAboutOrdinance 23248-06-2018 Ordinance No. 23248-06-2018 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STREET IMPROVEMENTS 2008 FUND, FROM AVAILABLE FUNDS IN THE AMOUNT OF $100,128.00, FOR FWPA NORTH BEACH CORRIDOR PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Street Improvements 2008 Fund in the amount of$100,128.00, from available funds, for the FWPA North Beach Corridor Project. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. K y r Assistartity Attorney ADOPTED AND EFFECTIVE: June 5. 2018 Ordinance No.23248-06-2018 WYA VA= FORT WORTH PUBLIC ART North Beach Corridor Public Art Project Narrative Description The North Beach Corridor will feature a series of up to twelve(12)"whimsical, kinetic"weather vane"sculptures that will be placed in the center median along a 4-mile stretch of North Beach Street, between Timberland Boulevard and Shriver Road. Each unique sculpture will have the form of a native animal, bird or reptile, and will be made from locally-sourced recycled materials. The choice of materials will have a humorous connection with the creature depicted, such as an armadillo made of truck bumpers and shovel heads. Pivoting with the direction of the wind,the sculptures will be approximately 30 feet in height, 12 feet in width, and a depth of 2.5 feet. "The number of sculptures feasible to implement within budget will be determined at the end of the Final Design phase of this Agreement. Authorize execution of a Final Design and Commission Agreement with Christopher Fennell, LLC for final design, fabrication, delivery, installation and contingencies in an amount of$793,398.00 for a series of large-scale sculptures to be located along four miles of North Beach Street, between Timberland Boulevard and Shiver Road, 76244; 2. Authorize the transfer of$100,128.00 from the Public Art-2008 CIP Programmable Project to the FWPA North Beach Corridor Project to align with approved project budget as listed in the City Council-Adopted Fort Worth Public Art Fiscal Year 2018 Annual Work Plan; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Improvements 2008 Fund in the amount of$100,128.00 in the FWPA North Beach Corridor Project. DISCUSSION: Christopher Fennell, LLC will create a series of up to twelve (12) whimsical, kinetic"weather vane" sculptures that will be placed in the center median along four miles of North Beach Street, between Timberland Boulevard and Shriver Road. On July 26, 2017, Christopher Fennell, LLC was placed under a Preliminary Design Agreement (City Secretary Contract No. 49441) in the amount of$17,480.00. Fort Worth Art Commission (FWAC)Action: On February 12, 2018, the FWAC approved the artist's preliminary design for artwork and recommended the artist be placed under a Final Design and Commission Contract. Funding for the final design and commission phases of the project has been allocated from the 2007 Critical Capital Needs Program and the 2008 Bond Program. Council Members Moon and Shingleton concur with the FWAC's recommendation to proceed with final design, fabrication, delivery, and installation of the North Beach Corridor Art Project. The project is located in COUNCIL DISTRICT 4 and 7. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds in the amount of$693,270.00 are available in the North Beach Corridor Public Art Project. Additionally, $100,128.00 in funds are available from the Programmable Pot P00071 for appropriation to the North Beach Corridor Public Art Project upon M&C approval. This appropriation will bring the total available funds for the commission phase to $793,398.00. Prior to an expenditure being incurred, the participating department has the responsibility to validate the availability of funds.
