HomeMy WebLinkAboutContract 32411-A4 AMENDMENT NO. 4 TO AGREEMENT FOR ARCHITECTURAL DESIGN SERVICES NEIGHBORHOOD POLICE STATION AND TRAFFIC DIVISION FACILITY STATE OF TEXAS CITY SECRETARY CONTRACT 1\10.3a`tl l—A(� COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Perkins Will (Architect) made and entered into City Secretary Contract No. 32411 (The Contract) which was authorized by the City Council by M&C C-20926, the 30th day of August, 2005; and WHEREAS, further amendment is necessary to reimburse the Architect for including the design and certification documents for Leadership in Energy and Environmental Design (LEED)certification; and NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article 1.1, SECTION I—SERVICES OF THE ARCHITECT, a paragraph is added to read as follows: "Provide additional design services to include the construction administration services for the Neighborhood Policing District No. 6 and Traffic Division facility on 1100 Nashville Avenue in fort Worth, Texas. The cost of this additional service is $152,055.00. The scope of services is described more fully in the Perkins Will EMail dated October 30, 2006, subject: Nashville Police and Traffic FacilityRevised Fee Proposal with attached letter dated October 30, 2006, subject: Nashville Police Revised Fee Proposal for the New Fort Worth Nashville Police Traffic Facility, which was attached as Attachment"A"to Amendment No. 1 and made a part of this Agreement." 2. Paragraph 1 of SECTION V- COMPENSATION TO ARCHITECT, is amended as follows: "The total compensation for all of the assignments to be performed by Architect as described in CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of $832,925.00 plus up to$4,600.00 in reimbursable expenses." 3. This proposal revises our June 23, 2006 proposal to reflect a 30,050 square foot facility with a "Design To" budget of $8,000,000. SECTION 1. PROJECT DESCRIPTION The Fort Worth Police Department (FWPD) is proposing to build a new police substation facility to serve the community. This facility will be located on approximately 1.9 acres southeast of downtown Ft. Worth at the intersection of Nashville Ave. and Avenue D, near the T exas Wesleyan University Campus. At present, the site is occupied by a former two story bank building that currently houses police operations for this area. We understand that if possible, the department would like to keep this facility in operation during the design and construction of the new facility. Upon completion of the new facility, the existing building will be demolished to make room for parking requirements. The original proposal was based on a preliminary space program that was developed by the City of Fort Worth estimated at 13,040 Square Feet. After a full programming effort and Schematic Design Phase, the scope has been redefined to accommodate a three story facility of.30,050 which includes motorcycle storage on the lower level. SECTION 2. BASIC SCOPE OF SERVICES For purposes of this Proposal, Basic Services shall include those Architectural and Engineering -- services defined as such, by AIA Document B151-1997, paragraphs 2.2 through 2.6. These services include full architectural, structural, mechanical, electrical, and plumbing design services for schematic design, design development, construction documents, bidding, and construction administration. Services beyond those identified as Basic Services are considered Optional Additional Services as defined in paragraphs 3.4.1 through 3.4.20. These services are identified in this proposal as Specialty Consultants (Section 3) and Optional Additional Services (Section 4). NORTH AMERICA ! Schematic Design 6 Weeks + 4 Weeks Review 2, Design Development 6 Weeks + 4 Weeks Review 3. Construction Documents 12 Weeks + 4 Weeks Review 4. Bidding/ Negotiation 8 Weeks (TBD) 5. Construction Administration 52 Weeks (TBD) SECTION 3. SPECIALTY CONSULTANTS The Scope of Services for the proposed Fort Worth Nashville Neighborhood Police and Traffic facility requires that a number of Specialty Consultants be retained by Perkins + Will. The services of these Consultants are in addition to those for the Engineering Consultants that are inciuded in the Basic Services. The proposed Specialty Consultants are as follows: • Civil Engineering- Charles Gojer & Associates, Dallas, TX (TBD) • Topographic & Boundary Survey—Charles Gojer& Associates, Dallas, TX (Completed) • Landscape Architect - Studio Tincup, Arlington, TX • Cost Estimating— Riddle & Goodnight, Arlington, TX SECTION 4. ADDITIONAL SERVICES The following services are optional to be performed by Perkins+ Will for the proposed Fort Worth Nashville Neighborhood Police & Traffic Facility project. These expanded services are not normally included under Basic Services, but are recommended for this project. The scope for each task is defines as specifically as possible. The required fee is included in Section 5 - Proposed Compensation. In cases where the scope is unclear, or has not vet been defined, an "estimated fee" is indicated. 1. Full Programming: The City of Fort Worth elected to do a full programming effort for the New Fort Worth Nashville Neighborhood Police and Traffic facility. This effort revised the original 13,040 SF of the previous program to 26,818 SF. In addition, the programming effort included scope changes for including the SSI and the Gang unit. Although these items were not included in the final program due to budget constraints, work was done by Perkins+Will as requested by the City of Fort Worth. With these two divisions included the estimated __square footage would equal 34,416 SF. 2. LEED Support & Design - Duration: As Required This task will include the services of Perkins + Will and selected Consultants in support of achieving LEED Certification for the new facility. Per the USGBC, a third-party consultant, is required to lead the commissioning effort. Services will include: • Support/Coordination-for the third=party-commissioning consultant. • Required documentation at the end of each Phase of service. • Required documentation for LEED application • Coordination with the general contractor during construction in support of LEED . certification. • Energy modeling as required for the concepts to be tested. • LEED Additional Commissioning-AIR Engineering& Testing, Dallas, TX 4. Security Electronics & Hardware- Duration: As Needed • This Task will include the services of Charles HBE Texas to provide consulting services for the security electronics and hardware portion of the project. 5. Platting- Duration: As needed This Task will include the services of Charles Gojer& Associates to complete a Replat of the Project Property if necessary, SECTION 5. REIMBURSABLE EXPENSES Reimbursable expenses are in addition to compensation for basic and additional services and include expenses incurred by Perkins-,Will and its consultants in the interest of the project. This would include expenses inconnection with trav7; long distance communications, fees to approval authorities, and the expenses of presentation materials, reproductions, printing, plotting, postage and handling, courier and overnight services, models, artist renderings or mock-ups, and LEER related expenses. These expenses shall be reimbursed at their actual cost to Perkins-Will, Should reimbursable expenses exceed this allowance amount, Perkins+Will will get written approval from the City of Fort Worth prior to incurring additional expenses. DISCUSSION: On August 30, 2005, (M&C C-20926) the City Council authorized the City Manager to execute a Professional Services Agreement (Agreement) in the amount of $300,000.00 with Perkins and Will to design the Nashville Neighborhood Policing District No. 6 and Traffic Division facility. Funding in the amount of$332,000.00 was from the Crime Control and Prevention District (CCPD) funding. On July 31, 2007, (M&C C-22276) the City Council authorized the City Manager to execute Amendment No. 1 in the amount of $343,972.00 to the Agreement with Perkins and Will to complete the design of the Nashville Neighborhood Policing District No. 6 and Traffic Division facility. Funding in the amount of $350,000.00 was from the Critical Capital Needs Certificate of Obligation, Series 2007. On September 25, 2007, (M&C C-22404) the City Council authorized the City Manager to execute Amendment No. 2 to the Agreement in the amount of $29,000.00 with Perkins and Will to provide the design and certification documents for the City's first Leadership in Energy and Environmental Design (LEED) certification for the Nashville Neighborhood Policing District No. 6 and Traffic Division facility. Funding in the amount of$40,000.00 was from the Police Department General Fund. On March 3, 2008, an administrative Amendment No. 3 to the Agreement in the amount of$13,300.00 was executed with-Perkins-and-Will to provide additional design services for replatting and vacation of the cul- de-sac on the project site. On September 2, 2008, (M&C G-16262) the City Council approved additional funding in the amount of $12,035,000.00 from the Critical Capital Needs Certificate of Obligation, Series 2008, for construction and construction administration services. The total funding available from all sources is $12,522,000.00. On November 11, 2008, (M&C C-23182) the City Council authorized _the City Manager to execute a construction contract in the amount of $8,216,000.00 with Crossland Construction Company, Inc., to construct the Nashville Neighborhood Policing District No. 6 and Traffic Division facility. Amendment No: 4 to the Agreement will provide construction administration services during the construction phase of this Logname: 20PERKINSWILLA4 Page 1 of 2 project. The overall project cost is estimated to be: Design $860,000.00 Construction $8,216,000.00 ITS, Geotech, Demolition $1,740,000.00 Contingency, FF&E, Staff Administration $1,144,000.00 Total $11,960,000.00 Perkins and Will is in compliance with the City's M/WBE Ordinance by committing to an additional 15 percent on this Amendment No. 4. The City's goal on this Amendment No. 4 is 15 percent. The project is located in COUNCIL DISTRICT 8. The completion of the facility will add 30,074 square feet to the City's facility inventory and add approximately $10,000.00 per year in the facility maintenance and repair requirements.
