HomeMy WebLinkAboutOrdinance 23260-06-2018 Ordinance No. 23260-06-2018 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL FUND LEGACY IN THE AMOUNT OF$13,143.00, FOR THE BELLAIRE DRIVE SOUTH AND ARBORLAWN PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Fund Legacy in the amount of$13,143.00, for the Bellaire Drive South and Arborlawn project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Fund Legacy in the amount of$13,143.00; and 2. Authorize the execution of the second renewal and amendment of City Secretary Contract No. 47525, the Professional Services Agreement with Shield Engineering Group, PLLC, in an amount not to exceed $594,030.00 for staff extension services in managing Transportation and Public Works and Water Department Capital Projects. DISCUSSION: On February 9, 2016, (M&C C-27617) the City Council approved a Professional Services Agreement with Shield Engineering Group, PLLC (Shield), in an amount not to exceed $291,200.00 for staff extension services in managing Transportation and Public Works (TPW) Capital Projects. The contract allowed for additional renewal periods, contingent upon City Council approval. On May 2, 2017, the City Council approved the first renewal of this contract (M&C C-28200) for an amount not to exceed $337,220.00 due to increased project management staffing needs. This Mayor and Council Communication will authorize the second renewal of the contract and add additional staff for project management services on 15-20 projects. Shield proposes to provide these services in an amount not to exceed $594,030.00. The total contract amount after this renewal will be $1,222,450.00. The Stormwater Capital Projects Fund will be used for these projects. Sewer Capital Projects Fund Legacy and 2007 Critical Capital Projects Funds will be used in addition to the Stormwater Capital Projects Fund for a project with associated sewer and street improvements. In addition to these three funds, other capital funds may also be used as service needs are identified for additional projects. M/WBE Office -A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Department and approved by the M/WBE Office, in accordance with the MWBE or BDE Ordinance, because the purchase of goods or services is from sources where subcontracting or supplier opportunities are negligible. The project is located in ALL COUNCIL DISTRICTS. The Fiscal Year 2018 Water Operating Budget includes appropriations of $29,022,689.00 for the purpose of providing pay-as-you-go funding for sewer capital projects. After this transfer for Fiscal Year 2018, the balance will be $7,598,827.00. These projects were budgeted in the Fiscal Years 2017 and 2018 Stormwater Utility Capital Fund and are included in the Fiscal Years 2017 and 2018 Stormwater Capital Improvement Program; and Funds will be available in various projects, on a project by project basis and the Department has the responsibility to validate the availability of funds.
