URGING THE TEXAS MUNICIPAL LEAGUE
TO SUPPORT LEGISLATION DURING THE 1991 LEGISLATIVE
SESSION TO PROHIBIT THE SALE OF ARMOR-PIERCING
AMMUNITION FOR OTHER THAN OFFICIAL
GOVERNMENTAL USE
WHEREAS, Chapter 46, Section 46.06 of the Texas Penal Code
does place armor-piercing ammunition in the category of
prohibited weapons; and
WHEREAS, paragraph (c) of that section, however, serves to
negate 'the impact of the prohibition by stating that "it is a
defense of prosecution under this section that the actor's
possession was pursuant to registration pursuant to the National
Firearms Act, as amended "; and
WHEREAS, the National Firearms Act allows for the sale of
armor-piercing ammunition from a licensed dealer to an
individual as long as "the licensee notes in his records,...the
name, age, and place of residence of such person..."; and
WHEREAS, armor-piercing ammunition has no useful purpose in
the hands of the general population whether registered under the
provisions of the National Firearms Act or otherwise; and
WHEREAS, armor-piercing ammunition poses a serious threat to
all human life, especially our police officers in their efforts
to combat crime and drugs;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE ~ITY OF FORT WORTH, TEXAS:
that the Fort Worth City Council recognizes the need for a
change in state law which will prohibit the sale of
armor-piercing ammunition to the general public in the state of
Texas; and '

BE IT FURTHER RESOLVED that the Fort worth city council
urges the Texas Municipal League at its 1990 Annual Conference
to pass a resolution in support of legislation to be introduced
in the Texas State Legislature to amend Chapter 46, Section
46.06 of the Texas Penal Code such that the sale of
armor-piercing ammunition by a licensed dealer to other than the
armed forces, national guard, a governmental law enforcement
agency, or penal institution be prohibited in the state of
Texas.
