AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
KENNEDY STREET AND A PORTION OF TWO ALLEYS, SITUATED IN
THE MOSES A. JACKSON SURVEY, ABSTRACT NO. 862, IN THE CITY
OF FORT WORTH, TARRANT COUNTY, TEXAS, AND CONTAINING
APPROXIMATELY 10,150 SQUARE FEET AND 6,100 SQUARE FEET
RESPECTIVELY AND AS RECORDED IN VOLUME 33,PAGE 16 OF THE
REAL PROPERTY RECORDS OF TARRANT COUNTY, TEXAS,
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
1. That portion of Kennedy Street, a fifty foot wide public right of way, situated in Moses A.
Jackson Survey, Abstract No. 862 in the City of Fort Worth, Tarrant County, Texas, as
recorded in Volume 33, Page 16 of the Real Property Records of Tarrant County, Texas
and containing 10,150 square feet or 0.233 acre of land, and as more specifically described
in Exhibits A and B attached hereto and incorporated herein by reference, be and the same
is vacated and extinguished.
2. That two alleys, each twenty feet wide, situated in the Moses A. Jackson Survey, Abstract
No. 862,as recoded in Volume 33,Page 16 of the Real Property Records of Tarrant County,
Texas, and containing 6,100 square feet or 0.140 acre of land and as more specifically
described in Exhibits a and B attached hereto and incorporated herein by reference, be and
the same is vacated and extinguished.

SECTION 2.
That the fee to the land in the above-described street right-of-way is released and shall
revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

RIGHT-OF-WAY VACATION
BEING a 50 foot wide strip of land situated in the MOSES A. JACKSON SURVEY, Abstract No.
862, Fort Worth, Tarrant County, Texas, and being a portion of Kennedy Street (a 50 foot wide
public right-of-way). Said 50 foot wide strip of land being more particularly described by metes
and bounds as follows:
BEGINNING at a point lying at the Northwest corner of Lot 21, Block 5, Kennedy's Addition, to
the City of Fort Worth, Tarrant County, Texas, according to the plat recorded in Volume 33,
Page 16, of the Official Public Records of Tarrant County, Texas, and said point lying at the
intersection of the East right-of-way line of Pine Street (a 50 foot wide public right-of-way) with
the South right-of-way line of said Kennedy Street;
THENCE N 000 10' 00"W 50.00 feet, severing said Kennedy Street, to a point lying in
the North right-of-way line of said Kennedy Street and the South right-of-way line of
Interstate Highway No. 30 (a variable width public right-of-way);
THENCE N 890 50'00" E 200.04 feet, along the South right-of-way line of said
Interstate Highway No. 30 and the North right-of-way line of said Kennedy Street, to a point
lying in the West boundary line of Lot A, Block 1, Goodwill Industries Addition, to the City of

Adopt Ordinance Vacating a Portion of Kennedy Street and Two Alleys in Block 5, Kennedy's Addition to
Consolidate the Land for a Future Indoor Regional Recreation Facility and Additional Parking (COUNCIL
DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Kennedy Street and two alleys in block 5,
Kennedy's Addition to consolidate the land for a future indoor regional recreation facility and additional
parking; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Brittain and Crawford, LLC, on behalf of Fort Worth Mixed Use, Inc., has requested vacation of this portion
of Kennedy Street and the two alleys to be replatted with the adjoining property for a future indoor regional
recreation facility and additional parking. The City Plan Commission recommended approval of this
request at its meeting on December 16, 2016. An acceptable final plat (FS-16-195) has been received in
accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through plat
dedication. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007, (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of
purchase price of these right-of-way easements for the street and alleys.
This project is located in COUNCIL DISTRICT 8.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/ CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds. Any assets recorded on the City's financial statements associated with this land will be
adjusted upon approval.
