O A RESOLUTION GRANTING CONSENT TO THE CREATION OF TARRANT COUNTY `~j' FRESH WATER SUPPLY DISTRICT NO. 1 WHEREAS, in February, 1987, the City of Fort Worth received a request by certain owners of land within the boundaries attached hereto as Exhibit "A" that the City consent to creation over said boundaries of a fresh water supply district to be known as the Tarrant County Fresh Water Supply District No. 1 (the "District"); WHEREAS, the Department of Law and the Director of the Water Department met with said landowners and their representatives in February, 1987, and the Department of Law and the Water Department had no objection to the creation of the District; WHEREAS, the City Council of the City of Fort Worth in February, 1987, was aware of said landowners' request that the City consent to creation of the District and that the Department of Law and the Water Department had no objection to the creation of the District; WHEREAS, the City Council in February, 1987, believed and intended that the fact that the Department of Law and the Water Department had no objection to the creation of the District was consent on behalf of the City to allow a petition for creation of said District to be filed with the Tarrant County Commissioner's Court as required by law and to allow said Court to create the District; WHEREAS, the City Council was not aware that such consent of the City should be granted in writing by the City Council but if it had been so aware, the City Council would have granted such consent in writing in February, 1987; WHEREAS, eight of the nine members of the City Council of the City of Fort Worth holding office in February, 1987 continue to hold office as members of the City Council at this time; WHEREAS, the City Council desires to evidence in writing the City's previous consent to creation of the District and to formally evidence such consent in writing at this time., provided such consent shall be effective for all purposes as of February, 1987; t fi!! O! 108'1' ~08lH NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1 The City Council of the City of Fort Worth, Texas (the "City Council"), having been requested to give its consent to the creation of Tarrant County Fresh Water Supply District No. 1 (the "District") and the inclusion therein of the land described in the metes and bounds description attached hereto and incorporated herein for all purposes as Exhibit A and the City having previously believed that it had given consent through the actions of its Department of Law and Water Department., does hereby grant, approve, ratify and confirm said consent and confirms, ratifies and approves the actions previously taken by its officers in granting such consent and hereby adopts this resolution to evidence such consent to the creation of the District with boundaries shown on Exhibit A attached hereto effective as of February, 1987. SECTION 2 It is specifically provided that the District may provide or continue to provide water service to all residences, businesses and other users presently being provided with water service by either the District or Cibolo Companies and that the District may hereafter provide water service to any new customers requesting same within the boundaries of the District; provided, however, that prior to providing water service to any new customer (other than those presently served by the District or Cibolo Companies) within the boundaries of the City of Fort Worth, the District will provide written notice to the City of Fort Worth, to the attention of the City Manager, and the City of Fort Worth shall have a period of six (6) months after receipt of such notice to provide water service or to reach an agreement to provide water services to any such new customer. In the event the City of Fort Worth does not provide such water service or reach an agreement with such customer to provide such water service within said six month period, then the District may thereafter provide water service to said customer. ~ o~ posy wosr® SECTION 3 The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for -the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutues Annotated; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. (Redbird); THENCE in a southerly direction down the centerline of the Oakgrove-Rendon Rd. (Redbird) approximately 2,000 ft. to the intersection of Oakgrove-Rendon Rd. (Redbird) • . and the Oakgrove-Rendon Rd. centerlines to a point for corner; THENCE in an easterly direction down the centerline of the Oakgrove-Rendon Rd. apprxximately 6,450 ft. to the centerline of Tarrant Co. Rd. 1094 - and continuing across said road in the same easterly direction an additional distance of approximately 3,500 ft. to the centerline of Rendon Rd.; THENCE in a northerly direction along and with the centerline of Rendon Rd. approximately 2,200 ft. to the centerline of FM 1187, a point in line and point of reference; thence in the same northerly direction along and with the centerline of Rendon Rd. an additional distance of approximately 1,050 ft. to the intersection of the centerline of Little Rd. and a point for corner; THENCE easterly along and with the centerline of Little Rd. approximately 2,700 ft. to the intersection of the centerline of the Rendon-New Hope Rd., to a point for corner; THENCE in a northerly direction along and with the center- i~ of said Rendon-New Hope Rd. approximately 5,250 ft. to a point for corner, the NW corner of this tract and some 750 ft. more or less south of the centerline of Davis Rd.: THENCE in a westerly direction across open land and with an along a line encompassing the north line of the • platted subdivision entitled "Oak Tree" approximately 5,520 ft. to the centerline of Banks Rd. ~-- r • THENCE in a northerly direction with and along the centerline of Banks Rd. approximately 1,000 ft. to a point ,, for corner; THENCE in a westerly direction across open land approximately 900 ft. to the west ROW line of Victor St., a point for corner; THENCE in a southerly direction along and with the west ROW ine of Victor St. approximately 1,000 ft. to a point of intersection in a continuation of that line commencing approximately 750 ft. south of Davis Rd. to Banks Rd. for corner; THENCE in a westerly direction along and with this north-Tfne approximately 9,350 ft. to a point in the intersection of the east ROW line of the Forest Hills-Everman Co. Said meeting was a regular meeting of the City Council held at the time and place prescribed by the Home Rule Charter of the City of Fort Worth; each member of .the City Council was furnished in advance of such meeting with the agenda thereof in writing, which included the fact that said resolution would be introduced and considered for passage at said meeting; and said meeting was open to the public as required by iaw and public notice of the date, hour, place and purpose thereof was duly given as required by Article 6252-17, Vernon's Texas Civil Statutes, as amended.
