HomeMy WebLinkAboutResolution 1402„" Y ___ 2, r•.-~~~" ~ : :i ',. :.. -i JOINT RESOLUTION N0. ~~ WREREAS, the City of Mansfield, a Ilome Rule City of the State of Texas, is located in Tarrant, Ellis, and Johnson Counties, Texas; and WHEREAS, the City of Fort Worth, a Home Rule City of the State of Texas, is located in Tarrant County and Denton County, Texas; and WHEREAS, said cities have heretofore entered into a Joint Resolution dated February 12, 1974, agreeing upon a mutual common boundary line and extraterritorial jurisdictional limit between the two; and WHEREAS, said cities now wish to update and amend such agreement to extend the same to define the exclusive extraterritorial jurisdiction of each city in Johnson County and to provide for necessary actions to accomplish such extension; • NOW, THEREFORE, BE IT JOINTLY RESOLVED BY THE CITY COUNCIL OF THE CITY OE MANSFIELD AND THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That a mutual common boundary line and extraterritorial jurisdictional limit between Mansfield and Fort Worth be, and the same is hereby determined, fixed, and established, and the same is hereby particularly described by metes and bounds on Exhibit "A" attached hereto and made part hereof for all purposes. SECTION 2. That each city agrees, upon execution of this agreement, that it will prepare ~' and enact such ordinances as may be necessary to accomplish the waiver of extraterritorial jurisdiction for performance consistent with the provisions hereof so that the land lying on either side of the line described in Exhibit "A° may be appropriately annexed by the city to which it is apportioned hereby. That the above described line • is reflected on that certain map attached hereto, marked Exhibit "B", and expressly incorporated herein for the purpose of illustrating and depicting the location of the hereinabove described line. SECTION 3. --,~. . ,, ` It is the intent of Fort Worth 'that all area and 'land inside'and "generally"north°°~"`^~` and east of such boundary line shall be a part of the extraterritorial jurisdiction of Mansfield, and it is the intent of Mansfield that all area and land generally south and west of such line shall be a part of the extraterritorial jurisdiction of Fort Worth. It is the intent of both parties that this agreement shall pertain only to Mansfield and Fort Worth. 1 ~~r/ ~, r SECTION 4. SECTION 5. The .parties agree to accomplish the items provided by this agreement within SECTION 6. That this Joint Resolution and agreement hereby amends in its entirety that • • This agreement shall be recognized and accepted by both cities as a contract and binding for all purposes expressed herein and shall be a formal contract apportioning the extraterritorial jurisdiction of each city as such city may be entitled to the same under state Saw. sixty (60) days of the execution of this agreement by the last of the parties to do so. certain Joint Resolution filed of record in Volume 5679 at pages 42 through 48 of the Deed Records of Tarrant County, Texas; that this Joint Resolution and agreement is hereby substituted in its entirety for the said previous Joint Resolution fixing and establishing a common boundary line and apportioning the subject extraterritorial jurisdiction; and that all subsequent actions taken by each city pursuant to or in reliance upon the previous Joint Resolution (including but not limited to annexations, disannexations, extraterritorial jurisdiction apportionment and corporate boundary adjustments) are hereby confirmed and ratified.
