AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
AMOUNT OF $93,350.00 IN THE LAND ACQUISITION FEE PROJECT AND REDUCING
ESTIMATED RECEIPTS AND APPROPRIATIONS BY THE SAME AMOUNT IN THE
FACILITY RENOVATION PROGRAMMABLE PROJECT IN THE GENERAL CAPITAL
PROJECTS FUND TO BE USED FOR THE PAYMENT OF A ONE-TIME PUBLIC
IMPROVEMENT DISTRICT ASSESSMENT DUE IN CONNECTION WITH THE COST OF
PUBLIC IMPROVEMENTS AND ASSOCIATED CLOSING COSTS; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the amount
of$93,350.00 in the Land Acquisition Fee Project and decreased estimated receipts and appropriations by
the same amount in the Facility Renovation Programmable Project in the General Capital Projects Fund to be
used to pay for the one-time public improvement district assessment due in connection with the cost of public
improvements and associated closing costs.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Used for the Construction of Municipal Facilities and Adopt Appropriation Ordinance (COUNCIL DISTRICT
6)
RECOMMENDATION:
It is recommended that the City Council:
1. Accept the donation of approximately 12 acres of land out of the Juan Jose Albirado Survey, Abstract
No. 04, City of Fort Worth, Tarrant County, Texas, from Walton Texas, LP, and WUSF 4 Rock Creek, LP,
to be used for the construction of municipal facilities;
2. Adopt appropriation ordinance increasing estimated receipts and appropriations in the Land Acquisition
Fee project of the General Capital Projects Fund in the amount of$93,350.00 and reduce the
appropriation in the Facility Renovation programmable project of the General Capital Projects Fund in the
same amount;
3. Authorize the payment of assessments due in connection with the cost of public improvements in an
amount not to exceed $90,350.00;
4. Authorize the payment of closing costs up to an amount up to $3,000.00; and
5. Authorize the execution and recording of the appropriate instruments conveying the land to the City.
DISCUSSION:
The purpose of this Mayor and Council Communication is to accept the donation of approximately 12
acres of land from Walton Texas, LP, and WUSF 4 Rock Creek, LP, (collectively, "Walton") for the
purposes of constructing future public safety or other municipal facilities in Southwest Fort
Worth. Walton, the developer of approximately 1,775 acres in Southwest Fort Worth, has offered to
donate land located at the southeast corner of future Brewer Road and Stewart Feltz Road necessary to
accommodate future municipal facilities to serve residents and businesses in Southwest Fort
Worth. Construction of Brewer Road is scheduled to begin this year.
The land will be conveyed to the City with the condition that should the City decide not to use the property
for municipal facilities, it will revert back to Walton or their successors. The retained reversion rights will
terminate and expire after 25 years from the date which the City receives ownership of the property.
The land is in Public Improvement District No. 17 (Rock Creek Ranch) and is subject to assessments

totaling approximately $90,350.00, which are due in connection with the cost of public improvements that
benefit the property. In connection with the donation, the City is being asked to assume liability for the
assessments on the land, which staff proposes prepaying at the time of closing using funding in the
General Capital Projects Fund to be transferred from the Facility Renovation programmable project to the
Land Acquisition Fee project, as indicated in the attached appropriation ordinance. An additional
$3,000.00 is also being appropriated to pay closing costs.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that, upon approval of the attached appropriation ordinance, funds will be
available in the Land Acquisition Fee project of the General Capital Projects Fund to pay for the one-time
public improvement district assessment due in connection with the cost of public improvements and
associated closing costs up to $3,000.00. Prior to an expenditure being incurred, the participating
department has the responsibility to validate the availability of funds. Pursuant to an appraisal completed
by Integra Realty Resources in March 2018, the land within the Rock Creek Public Improvement District is
valued at$31,842.00 per acre. Thus, the value of the 12 acre donation is estimated at$382,104.00.
