CITYSECRETARY
WHEREAS, the City of Fort Worth (CITY) and Dannenbaum
Engineering Corporation, (ENGINEER) made and entered into City
Secretary Contract No. 28006, (the CONTRACT) which was authorized
by M&C C-19172 on the 30th day of July, 2002 in theamount of
$721,899.76; and
WHEREAS, the CONTRACT was subsequently revised by:
Amendment Number 1 in the amount of $111,800 .52 which was
authorized by M&C C-19936 on January 20 , 2004, Amendment No.2 in
the amount of $329,406.00 which was authorized by M&C C-22535 on
November 27 , 2007 , Amendment No. 3 in the amount of $96,825 .00
which was authorized by M&C C-23578 on June 9, 2009 and Amendment
No. 4 in the amount of $60,835.00 which was authorized by M&C C-
24794 on March 22, 2011, Amendment No. 5 in the amount of
$149,012.00 which was authorized by M&C C -28110 on February 14,
2017, Amendment No. 6 in the amount of $63,751 .00 which was
administratively authorized on October 11 , 2017; and
WHEREAS, the CONTRACT involves engineering services for
the following project:
Sanitary Sewer Main 257 and 325 Middle and Upper Village Creek
Parallel Relief Alignment Study and Design; and
WHEREAS, it has become necessary to execute Amendment No.
7 to the CONTRACT to include an increased scope of work and
revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
June 12 , 2018, a copy of which is attached hereto and incorporated
herein. The cost to City for the additional design services to
be performed by Engineer totals $21,860 .00.
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall bean
amount of $1,555,389.28.

Dear Mr. Kasavich:
Dannenbaum Engineering Corporation, (Dannenbaum or ENGINEER) is pleased to provide the City of Fort Worth
(CITY) with Amendment No.7 for the Sanitary Sewer Main 257 & 325 Middle and Upper Village Creek Parallel
Relief Alignment Study contract (the PROJECT). The CITY has asked Dannenbaum to perform additional services
under this contract for:
1) Additional Tree Survey — Preparing additional tree survey within Deer Creek Park to cover alignment
adjustments made within the Park since the original contract design survey.
2) Additional TRWD Easement Parcels — Preparing additional permanent sanitary sewer and access
easements and temporary construction easement parcels created as a result of a transfer of property
ownership to Tarrant Regional Water District (TRWD)for a portion of project Parcel 11 west of IH-35W.
This property transfer occurred after the current easement parcel documents had been submitted to the
City.
3) Revised Deer Creek Park Reservation Parcels—Preparing revised permanent and temporary construction
reservation parcels within Deer Creek Park to cover alignment revisions made within the Park to reduce
impacts to existing trees and proposed Park improvements known as "Capital Improvements at Deer
Creek Park, City Project No. 100418" (Park Project).
4) Additional management and design services associated with Deer Creek Park - Additional meetings,
coordination and design revisions related to reducing impacts to existing trees and the proposed Park
Project improvements.
These services are necessary because:
1) Alignment adjustments in Deer Creek Park associated with site visits and discussions with Water
Department and Park & Recreation Department (PARD) staff required that the tree survey be extended
to additional areas within the Park.
2) Additional permanent and temporary construction easement parcels were created as a result of a transfer
of property ownership to Tarrant Regional Water District (TRWD)for a portion of project Parcel 11 west
of IH-35W. This property transfer occurred after Dannenbaum submitted the current easement parcel
documents to the City.
3) Based on meetings and discussions with Park & Recreation Department (PARD) and Water Department
staff, alignment revisions are required in Deer Creek Park to adequately protect existing trees and the
referenced Park Project improvements.
4) A portion of the Park Project's proposed playground and concrete trail improvements that encroach on a
portion of the currently proposed M-325 temporary construction easement alignment as established in
coordination with PARD in September,2012. Dannenbaum was notified on 3/28/18 that the Park Project
was going to bid on 3/29/18 and was provided the Park Project construction plans at that time. PARD with
Sanitary Sewer Main 257&325 Middle and Upper Village Creek Parallel Relief Alignment Study and Design-Amendment No.7

the Water Department's concurrence asked Dannenbaum to investigate ways to reduce impacts to trees
and the Park Project improvements. Dannenbaum's investigations resulted in meetings with various
construction contractors and PARD and Water Department staff. From these meetings, Dannenbaum
prepared design revisions to reduce Park impacts, which were then presented to and approved by PARD
and Water Department staff.
The additional services required are as follows:
1) Additional Tree Survey - Additional tree survey within Deer Creek Park to cover alignment adjustments
made within the Park since the original contract design survey, is to be performed by ANA Consultants,
LLC (ANA). This work is classified as Special Services under former Part 2-Main 325 Design Phase and
current Work Phase 51 of the contract.The scope of work is described in Attachment A.—Subconsultant's
Scope of Work. Fee=$2,960(Lump Sum).
2) Additional TRWD Easement Parcels — Add permanent sanitary sewer and access easements, and
temporary construction easement parcels created as a result of a transfer of property ownership to
Tarrant Regional Water District (TRWD) for a portion of project Parcel 11 west of IH-35W that occurred
after the current easement parcel documents had been submitted to the City. This work is to be
performed by ANA, and is classified as Special Services under former Part 2-Main 325 Design Phase and
current Work Phase 51 of the contract.The scope of work is described in Attachment A—Subconsultant's
Scope of Work. Fee=$3,200.00(Lump Sum).
3) Revised Deer Creek Park Reservation Parcels—Revise permanent and temporary construction reservation
parcels within Deer Creek Park to cover alignment revisions required to adequately protect existing trees
and referenced proposed Park Project improvements. This work is to be performed by ANA Consultants,
LLC (ANA). This work is classified as Special Services under former Part 2-Main 325 Design Phase and
current Work Phase 51 of the contract.The scope of work is described in Attachment A.—Subconsultant's
Scope of Work. Fee=$700 (Lump Sum).
4) Additional management and design services associated with Deer Creek Park — Additional meetings,
design studies,correspondence,exhibits,easement and design changes associated with reducing impacts
to existing trees and the proposed Project Park improvements within Deer Creek Park. Fee=$15,000.00
(Time &Materials).
Dannenbaum will perform/manage the work described in the items above forthis Amendment in accordance with
the original Contract.
We recommend that the City increase the budget by$21,860 for these additional services as follows:

It is proposed that fu nding for this amendment be drawn from the previously approved contract Amendment
No. 5 (dated 3/5/2017) budget for the acquisition of Easement Parcels 15PE(r01) and 15CE(r01) (Reference
Exhibit C—Amendment 5—Exhibits 4 and 5 )which are located on Deer Creek Park, property owned by the City
of Fort Worth. A cost of$123,954 was inadvertently assigned to cover acquisition costs for these two
reservation parcels and is included in the Amendment No. 5 budget (Reference Exhibit D—City Council Action
Ref No.C-28110,dated 2/14/2017).
Since the two reservation parcels are located on City property,there is no easement acquisition cost associated
with them, and the$123,954 amount is available to cover the contract budget increase for this amendment(No.
7)of$21,860, plus the previous Amendment No. 6 (dated 10/11/2017)fee of$63,751.

Attchment A—Subconsultant's Scope of Work
ADDITIONAL TREE SURVEY(DEER CREEK PARK)
Scope of Work -Field tie and show tree locations,species and trunk diameters within the noted
boundary on the attached exhibit (within the Temporary Construction and Permanent Easements),for
all trees trunk sizes 6" and larger. Deliverable shall consist of an AutoCAD design base file on Main 325
Parallel Relief Sewer project datum and using the same project symbology as provided in prior CADD
submittals.
Tree Survey Field Work- 16 hours @ $160/Hour= $2,560.00
Tree Survey Office Work-4 hours @ $100/Hour= $400.00
ADDITIONAL EASEMENT PARCEL(TRWD)
Scope of Work -Provide documents necessary for the acquisition of one (1)additional permanent
sanitary sewer easement,one (1)additional access easement and one(1)additional temporary
construction easements, located west of IH-35W owned by Tarrant Regional Water District, and
revisions to one (1) permanent sanitary sewer easement,one (1)access easement and one (1)
temporary construction easement, previously prepared for property owned by W1 & LL Luck.
Provide two (2) signed and sealed real property descriptions and maps of survey for each easement to
be acquired.
