HomeMy WebLinkAboutOrdinance 23312-08-2018 Ordinance No. 23312-08-2018 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $236,330.24 IN THE SPECIAL PURPOSE FUND, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE RESOURCE CONSERVATION PROGRAM PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the amount of$236,330.24 in the Special Purpose Fund, from available funds, for the purpose of funding the Resource Conservation Program project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22927-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Resource Conservation Program of the Special Purpose Fund from earned utility incentives and reimbursements from the U.S. Department of Energy to be used for final payment of City Energy Savings Performance Contract Phase 7, transfer of Oncor utility incentives to the Water and Sewer Fund, support of City Better Buildings initiatives, and implementation of future City energy conservation projects in the amount of$236,330.24; 2. Authorize final payment of the Energy Savings Performance Contract Phase 7 in the amount of $22,271.00 to Johnson Controls, Inc., (JCI), a City-contracted Energy Services Company (ESCo.); and 3. Authorize the transfer of$9,644.16 from the Resource Conservation Program project of the Special Purpose Fund to the Water and Sewer Fund for incentives received related to implementation of Phase 6- A of the Energy Savings Performance Contract (ESPC). DISCUSSION: On May 15, 2012, the City Council adopted Resolution No. 4089-05-2012 authorizing the City Manager to enter into a Community Partner Agreement with the U.S. Department of Energy for its Better Buildings Challenge (BBC) Program. The Agreement encourages local entities to join the City of Fort Worth (City) in making Fort Worth's municipal, commercial, and industrial buildings at least 20 percent more efficient by the year 2020. The Better Building public-private partnership assists the City in achieving the energy conservation goals established by City Council adoption of Resolution No. 4130-09-2012 in its effort to comply with Senate Bili 898 of the 82nd Legislative Session of 2011, as codified in Texas Health and Safety Code Chapter 388. This effort is managed by the Property Management Department as part of its Resource Conservation Program and the funds used to support this program come, in part, from utility incentives and reimbursements. Oncor Electric Delivery Company, the local transmission distribution utility, promotes energy efficiency Logname: 21 RESOURCE CONSERVATION PROGRAM INCENTIVES Page 1 of 3 through programs such as its Commercial Standard Offer Program (SOP) which offers monetary incentives to customers for their successful implementation of qualifying energy conservation measures. In City FY2008, a Resource Conservation Program project was established within the City's Special Purpose Fund to receive utility incentives secured through implementing its program projects. The City, having successfully participated in programs such as Oncor's SOP, has received incentives either directly from Oncor, or indirectly through Johnson Controls, Inc., (JCI), a City-contracted Energy Services Company, for JCI's implementation of City Energy Savings Performance Contract (ESPC) projects. On May 21, 2013, Mayor and Council Communication (M&C C-26273) approved Amendment No. 8 to the City's ESPC with JCI for Phase 7 for improvements to building mechanical and electrical systems affecting over 100 City facilities. Subsequently, in FY2015 and FY2016 respectively and as related to ESPC Phase 7, the City received and deposited into the Resource Conservation Program project lease interest totaling $31,344.43 and SOP incentives in the amount of$159,331.26. An additional $36,010.39 in funding related to utility incentives and reimbursements was received during FY2015 and FY2016. These funds were deposited as revenue into the Resource Conservation Program project of the Special Purpose Fund (25002) and are intended to be used for the final payment of the ESPC Phase 7 project in the amount of$22,271.00, as well as for the implementation of energy conservation projects in the amount of$204,415.08. On August 17, 2010, M&C C-24406 approved Amendment No. 6 to the City's ESPC with JCI for Phase 6a for improvements to building mechanical and electrical systems affecting the Village Creek Water Reclamation Facility. Subsequently, in FY2012 and as related to ESPC Phase 6-a, the City received and deposited into the Resource Conservation Program project Oncor incentives in the amount of $9,644.16. It is necessary to transfer this incentive revenue for projects completed at the Village Creek Facility to the Water and Sewer Fund. The purpose of this M&C is to obtain City Council's approval to use the available funding to authorize 1) the final payment of the completed ESPC Phase 7 project, 2) the transfer Oncor utility incentives to the Water and Sewer Fund, and 3) continued support for City Better Buildings initiatives, including future Resource Conservation Program projects. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance funds will be available in the current capital budget, as appropriated, of the Special Purpose Fund.
