HomeMy WebLinkAboutContract 46562-A1 (2) CITY CONTRACT NO. , AMENDMENT No.3 - TO CITY SECRETARY CONTRACT No. 46562 WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 46562, (the CONTRACT) which was authorized by M&C No: C- 27256 on the 24th day of March, 2015 in the amount of $ 200, 000; and WHEREAS, the CONTRACT involves engineering services for the following project: On-Call Bicycle Engineering Design Related Services; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $30, 000 which was administratively authorized on November 22, 2016; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 2 in the amount of $6, 000 which was administratively authorized on December 11th, 2017; and WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated July 23rd, 2018, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $40,290. (See Attached Funding Breakdown Sheet, Page -3-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $276,290. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. The ENGINEER is only responsible for those professional services that can be completed within the maximum contract amount specified in the Level of Effort (Compensation). If the CITY requests the ENGINEER to provide services that exceed the maximum contract amount specified in the Level of Effort, an equitable adjustment will be made through an amendment to this AGREEMENT with appropriate CITY approval. OBJECTIVE The first objective of this project is to develop a concept plan for the East 4th Street/East 1St Street/Randol Mill Road from Sylvania Avenue to Oakland Boulevard (approximately 3 miles). The second objective of this project is to complete the TxDOT permit set for the Southwest Boulevard Bicycle Trail. TASK 1. EAST 4T" STREET/EAST IST STREET/RANDOL MILL ROAD 1.1 Data Collection and Field Verification • The CITY will provide the ENGINEER with the following documents/information: • Record drawings for projects identified (if applicable); and • CADD files for current projects identified (if applicable). Kim ey>>>Horn Page 2 • The ENGINEER will prepare for and attend a day-long field corridor evaluation to collect existing signage, striping, and signal information. • Prior to design, the ENGINEER will create base files and conduct field survey measurements. These field survey measurements will be used in Task 1.2. 1.2 Concept Design • The ENGINEER will create up to two concept layouts for the East 4th Street/East 1 I Street/Randol Mill Road from Sylvania Avenue to Oakland Boulevard (approximately 3 miles). • The concept plan will generally include: i. Proposed Cross Section 1. Sylvania Avenue to Riverside Drive 2. Riverside Drive to Beach Street 3. Beach Street to Gateway Park 4. Gateway Park to Oakland Boulevard ii. Layout evaluation of intersections 1. Sylvania Avenue 2. Riverside Drive 3. Beach Street 4. Oakland Boulevard; iii. Location of proposed sidewalk/sidepath iv. Connections to existing trail from Gateway Park to Oakland v. Connection from Lake Havasu to Oakland vi. Proposed buffer. The ENGINEER will utilize the following design guidelines: • City design standards; • AASHTO's Guide for the Development of Bicycle Facilities; • Texas Manual on Uniform Traffic Control Devices (TMUTCD); • NACTO Urban Bikeway Design Guide, and • Texas Department of Transportation standards. 1.3 Comment Responses • Following completion of the preliminary design, the ENGINEER will respond to two (2) round of comments. The ENGINEER will revise the preliminary design based on CITY comments. I - • 80111 Ft.Worth, 76102 • Kimley>>>Horn Page 3 1.4 Conceptual Level OPCC • The ENGINEER will complete a conceptual level opinion of probable construction cost (OPCC) estimate. 1.5 Meetings • The ENGINEER will prepare up to two meetings for review. • The ENGINEER will prepare and attend a public meeting to review conceptual design. 1.6 DELIVERABLES A. Roll Plot of Two Concepts B. Conceptual OPCC TASK 2. SOUTHWEST BOULEVARD 2.1 TxDOT Permitting and Coordination • This permit package will include applicable sheets for the trail along Southwest Boulevard. • ENGINEER will coordinate with TxDOT regarding design elements along the Southwest Boulevard • ENGINEER will attend up to two (2) meetings with TxDOT and CITY • ENGINEER will respond to two (2) rounds of TxDOT comments • ENGINEER will be responsible for submitting the permit package to TxDOT 2.2 Erosion Control Identification • ENGINEER will identify current Erosion Control issues that have resulted in failures. ENGINEER will facilitate discussion and documentation for TxDOT notification and conceptually propose solutions. The ENGINEER will incorporate preliminary design comments from the City and TxDOT and provide the following • Final Design Deliverables - 11" by 17" .pdf of preliminary plans 11" by 17" .pdf of final plans 11" by 17" paper copies of final plans (3) 2.4 TDLR Review • Through a Registered Accessibility Specialist (RAS) subconstultant, the ENGINEER will register the project with TDLR and have the design drawings reviewed for compliance with the Americans with Disabilities Act and the most current Texas Accessibility Standards. At the completion of construction, the RAS will perform a field inspection of the accessibility features of the proposed project 2.5 OPCC • The ENGINEER will complete an opinion of probable construction cost (OPCC) estimate. 2.6 Meetings • The ENGINEER will prepare up to two meetings for review. • The ENGINEER will prepare and attend a public meeting to review final design. 2.7 Construction Phase Services • Task Order Package. Prepare draft task order package for CITY review. An existing unit price contract will be utilized for construction. • The ENGINEER will prepare for and attend and/or conduct construction coordination meetings for the corridors listed in the Objective. It is anticipated Kim ey>))Horn Page that up to two (2) meetings will be needed. Effort for preparation and attendance at the meetings is anticipated to be two (2) hours. • The ENGINEER will conduct site visits to the corridors listed above prior to and during construction. It is anticipated that four-hours will be needed. Services not included in the existing Scope of Services—The CITY and ENGINEER agree that the following services are beyond the Scope of Services described in the tasks above. However, the ENGINEER can provide these services, if needed, upon the CITY's written request. Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. These additional services include the following: • Meetings in addition to the ones identified in the Scope of Services above. • Services related to development of the CITY's project financing and/or budget. • Services to support, prepare, document, bring, defend, or assist in litigation undertaken or defended by.the CITY. • Performance of miscellaneous and supplemental services related to the project as requested by the CITY. The ENGINEER will perform the services for a not-to-exceed amount not to exceed fee of$40,290. All permitting, application, and similar project fees will be paid directly by the client. Kimley-Horn will continue to perform On Call Bicycle Engineering Design Services as may be requested by the City during the term of this Agreement. Work under this agreement will continued be performed on a Work Authorization basis. The City will request services for each Work Authorization.
