AMENDMENT No.1 TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Brown and Gay Engineers, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 48705, (the CONTRACT) which was authorized by M&C C-27913 on the 13th day of September, 2016 in the amount of $810,000 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Big Fossil Creek Parallel Relief Sanitary Sewer Main 402A, Phase 2 Improvement project; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOWTHEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated August 7, 2018 a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $60, 632 . 00 . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $870, 632 . 00 . 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and ct. City Project No. 02702,Additional Fee Request Dear Mr.Norwood: Due to additional coordination as well as some new considerations during the survey and design tasks,we have identified several new scope items requiring revisions to the original Level of Effort for the following: Task 15.1 USACE Coordination: 15.1.1 Coordination with the United States Army Corps of Engineers(USACE): USACE Coordination meeting set up, data research and review, alignment update to meet USACE requirements. 15.1.2 Section 408 Permit Application Task 15.2 Additional Design survey for: 15.2.1 Area for the proposed Meter Stations falling beyond the current survey,after ground survey of the area required shifting the meter stations layout due to all the existing utilities within the project boundaries,as well as area to cover the existing athletic field on Birdville ISD property. 15.2.2 Additional Research efforts for property and easements information. 15.2.3 Staking of the easterly and northeasterly property line of Mr. Finley, property located at 6609 Midway Road and staking of the proposed easement boundaries within Mr. Finley's property 15.2.4 Staking of the proposed pipe centerline(8,000 LF). Task 15.3 Additional Easement Service for Easement Documents preparation in excess of original estimate. Task 15.4 Site clearing to reach bore locations B-10 and B-11 for Geotech. Task 15.5 TRE permit application fee(Paid by BGE). Task 15.6 TRE Contractor's Right-of-Entry(CROE)fee(Paid by BGE). Task 15.7 Additional Level A SUE. Serving.Leading.Solving.'"
