HomeMy WebLinkAboutOrdinance 23325-08-2018 Ordinance No. 23325-08-2018 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $88,100.28 IN THE STREET REHABILITATION FUND, FROM AVAILABLE FUNDS, FOR THE 2014 STREET LIGHTING PROGRAM YEAR 4 PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the amount of$88,100.28 in the Street Rehabilitation Fund, from available funds, for the 2014 Street Lighting Program Year 4 project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the amount of$54,753.05, from available funds in the Street Improvements Fund; 2. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the amount of$11,283.27, from available funds in the Street Improvements 2008 Fund; and 3. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the amount of$88,100.28, from available funds in the Street Rehabilitation Fund. DISCUSSION: The 2014 Bond program identified locations throughout the city to improve low light levels and safety in our residential communities. Diamond Hill area in north Fort Worth was selected as a high priority location because of the age of the street light fixtures and insufficient light levels. Additional funds are needed to deliver the original scope in Diamond Hill due to increase in costs for the fixtures across other neighborhoods that were previously completed and an expanded coverage area in Diamond Hill. The appropriation of these TPW capital project legacy funds available for street lights will cover these additional costs. The project is designed and anticipated to start construction for Phase 1 in August 2018. A portion of this project includes 2014 Bond Funds. Available resources within the General Fund will be used to provide interim financing for these expenses until debt is issued. Once debt associated with this project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official intent to reimburse, that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 21241-05-2014) and subsequent actions taken by the Mayor and City Council. This project is in COUNCIL DISTRICT 2. This M&C does not request approval of a contract with a business entity.
