MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF FORT WORTH,
CHUCK SILCOX FORT WORTH ANIMAL CARE
FOUNDATION, INC. AND
NORTH TEXAS COMMUNITY FOUNDATION
This Memorandum of Understanding ("MOU") is made and entered into by
and between North Texas Community Foundation ("Community Foundation"), a
Texas non-profit corporation, acting by and through its duly authorized representative,
Chuck Silcox Fort Worth Animal Care Foundation, Inc. ("Silcox Foundation"), a
Texas non-profit corporation, acting by and through its duly authorized representative,
and the City of Fort Worth ("City"), a Texas home-rule municipal corporation, acting
by and through its duly authorized Assistant City Manager, to document the funding,
intended use and understanding related to donations made by Community Foundation
to Silcox Foundation for the benefit of animals from City's Animal Care and Control
Center. City, Silcox Foundation and Community Foundation may be referred to
herein individually as a "Party" or collectively as the "Parties."
SECTION 1
Background and Puroose of MOU
1.1. Background.
1.1.1. Fort Worth Animal Care and Control ("FWACC") has increased its Live
Release Rate from 30% in past years to 90% in FY2017. This has
occurred due to partnerships between the City and non-profits, including
Community Foundation and Silcox Foundation.
1.1.2. Currently, most highly-adoptable pets are being adopted or transferred to
partner organizations. Certain other animals need additional training or
medical care prior to being considered highly-adoptable.
1.1.3. In addition to adoption and transfer to FWACC partners, the transport of
pets to areas in the country with limited supplies of adoptable pets
("Transport Programs") presents an opportunity to provide positive
outcomes to many of the animals impounded at FWACC.
1.1.4. Many of the Transport Programs currently working with FWACC require
that the animals to be transported be out of the shelter for a certain period
of time prior to transport.
1.1.5. Jean Walker, donor and advisor of a donor-advised fund at Community
Foundation, approached FWACC about funding a program to provide
training for dogs identified with behavioral issues to improve their

1.2. Purpose. This MOU represents the intent of the Parties to memorialize the
understanding of the Parties and their desire to improve positive outcomes for
dogs from FWACC. The parties wish to participate in a pilot program with the
intention to develop an ongoing program to be known as the "Dog Defender
Program." Community Foundation desires to partner with Silcox Foundation to
transfer dogs identified by City's FWACC center to selected boarding facilities,
training facilities and/or foster homes in order to assess the dogs' behaviors and
then transport the dogs to adoptive homes in areas where adoptable dogs are in
limited supply. The Parties acknowledge that no contractual relationship is
created between them by this MOU, but agree to work together in the true spirit
of partnership to ensure that there is a united, visible and responsive leadership
of the Dog Defender Program.
SECTION 2
Pilot Program Funding
2.1. Community Foundation.
2.1 .1. Community Foundation, at the direction of Jean Walker, will provide an
initial funding of $20,000. The initial funds will be granted to Silcox
Foundation for the purpose of furthering the purposes of this MOU as
described below.
2.2. Silcox Foundation.
2.2.1. This funding will provide boarding, training and transport for two initial
groups of ten (10) dogs. The expected boarding and training costs will
be initially budgeted at approximately $400 per dog based upon
estimates of $20 per day for 14-21 days ($280 - $420). The transport
cost will be initially budgeted $150 per dog. Therefore, initial budgeting
for this pilot program is $11,000.
2.2.2. The initial funding will also be available to immediately transport dogs,
identified by FWACC, that are currently being housed by FWACC
partners and others. These transports are intended to help long-term
dogs in non-FWACC programs find adoptive homes while potentially
creating new capacity in these programs to take additional dogs identified
for the Dog Defender Program. Initial budgeting for this task is $3,000
based upon estimates of 20 dogs at $150 transport fees.
2.2.3. Any remaining or future funds may be used to:
2.2.3.1. Extend the pilot program, or
2.2.3.2. Convert the pilot program to an on-going program, or
2.2.3.3. Provide care and treatment to Dog Defender Program dogs as
determined by FWACC to increase their opportunity for adoption

and/or transport, or
2.2.3.4. Other care and treatment of dogs identified by FWACC and
consistent with the purpose of this MOU.
2.3. City of Fort Worth
2.3.1. This MOU is not an obligation or commitment of City funds, nor a basis
for transfer of City funds. All obligations of and expenditures by each
Party are subject to their respective entity's budgetary and fiscal
processes and availability of funds pursuant to all laws, regulations, and
policies applicable thereto.
SECTION 3
Party Roles and Responsibilities
3.1. Community Foundation.
3.1 .1. The Community Foundation will provide the initial funding for the Dog
Defender Program.
3.1 .2. The Community Foundation, along with Jean Walker, will advise and
cooperate with FWACC and Silcox Foundation in the administration of
the Dog Defender Program.
3.2. City.
3.2.1. FWACC will identify dogs for the Dog Defender Program based upon
observations of behaviors and determination that training or change in
environment will likely result in the dog becoming highly-adoptable.
3.2.2. FWACC will advise and consult with Community Foundation, along with
Jean Walker, and Silcox Foundation in the selection of boarding
facilities, training facilities and foster homes.
3.2.3. FWACC will promote Dog Defender Program dogs for Transport
Programs after successful boarding, training or fostering.
3.2.4. FWACC, in consultation with other Parties, will recommend and approve
care and treatment for Dog Defender Program dogs.
3.2.5. FWACC, in consultation with other parties, will decide and control the
final disposition of Dog Defender Program dogs identified under this
MOU.
3.3. Silcox Foundation.
3.3.1. Silcox Foundation, in consultation with other parties, will select service
providers (boarding facilities, training facilities, foster homes and

veterinary providers) for Dog Defender Program dogs.
3.3.2. Silcox Foundation will communicate to service providers the roles and
responsibilities of each party; specifically, the authority under this MOU
for FWACC to approve care and treatment for Dog Defender Program
dogs and to determine final disposition of all Dog Defender Program
dogs.
3.3.3. Silcox Foundation will endeavor to ensure Dog Defender Program dogs
are available for transport upon determination that the dogs are
appropriate for a Transport Program.
