That the following extraterritorial jurisdiction and corporate boundary realignment between the City of Fort Worth and the City of White Settlement, as hereby described, is in the best interests of the property owners and inhabitants of both cities and that the City of Fort Worth and the City of White Settlement will proceed with due diligence in adopting the necessary disannexation and annexation ordinances adjusting their respective ~rporate bounaaries and all other proceedings necessary to effectuate this agreement. SEX;IZCN 2. That the City of Fort Worth and the City of White Settlement do hereby covenant and agree to protect, preserve and defend the hereinafter described realignment. SD:.TICid 3. That the City of Fort Worth hereby agrees to discontinue from its corporate boundary and to release all its jurisdictional rifts it has or may have in ar~d to all territories embraced within the area sham on map D~ibit "A", attached hereto and made a part hereof, and described by mates and bounds as follows: BEIIiG a tract of land out of the J. J. Reese Survey, Abstract No. 1308, Tarrant County, Texas, being a portion of that tract known as ~_ Air Force Plant No. 4, more particularly described by metes and bounds as follows: BEGIIaIING at the southwest corner of the said Air Force Plant No. 4 tract, said corner being in the north line of Clifford Street; Tf~IiCE N 00° 26' 00" E, 8.5 feet along the west line of the Air Force Plant No. 4 tract to a point; TfB:'i~k'~ N 89° 41' 00" E, 2866.01 fast to a point; • THENCE S BB° 30' 00" E, 268.13 feet to a point in the south line of the Air Force Plant No. 4 tract, said point being in the north line of Clifford Street; THENCE S 69° 41' 00" W, 3134.12 feet to a point in the south line of the Air Force Plant No. 4 tract and the north line of Clifford Street to the Point of Beginning and containing 25999.51 square feet or 0.5854 of an acre of land. SECTION 4. That the City of White Settlement hereby agrees to annex the property disannexed and released from the extraterritorial jurisdiction of the City of Fort Worth as described herein and shown on map FSChibit "A", and the City of White Settlement agrees to assume the rights and obligations appurtenant to said property. SFXTICN 5. That these teams and conditions set forth shall beoane effective and binding upon the City of Fort Worth and the City of White Settlement by the adoption of this Joint Resolution and Agreement in regular and open City Council meetings of the City of Fort Worth and the City of White Settlement, and that this Joint Resolution and Agreement, upon adoption by both cities, shall be executed in several originals and shall be spread in full on the minutes of each city. A copy of this Joint Resolution and Agreement shall be executed by the Mayor and attested by the City Secretary of eacfi city. There is currently no EfJ agreanent with the City of White Settlem@nt. The total area being consi- dered for the disannesmtion and EfJ release is 0.5854 acres to be released by , Fort Worth. There are no current residents in the area. tion The property is located at the North rightrof-way of Clifford Street at Bomber Road and the Southwest Corner of General Dynamics. BXistinv Land Use and Physical Cfiaracteristics The site is a vacant portion of General Dynamics property. • Proposed Land Use The proposed use of the area is to widen Clifford Street for improved traffic circulation, primarily for General Dynamics euoloyees. General Dynamics is in- volved in the proposed road widening process. The reason for the disannexition and EfJ release is to keep all of the right-of-way of Clifford Street in the City of White Settlement. Planninc Department Planning staff has no objections to the proposed disanne~tion and EPJ release. Ps~rk and Recreation Department The Park and Recreation Department has reviewed the proposed disanne~mtion and has no objections to it. Water Department The Water Department has no objections to the proposed disanneamtion. • Transportation and Public works DenarUnent Transportation and Public Works supports the proposed disannexition which is intended to effectuate the widening and future maintenance of Clifford Street. _~ \~_ City Plan Q~tissiaie--11/29/89 Development Rsvlew Gt~omlttee--it/Z2/69 Staff Infaxantion Report-Page 2 Fire Department • The disannexation of the 0.5854 acres will have no adverse effect on the response and coverage by the Fire Department. Consequently, the Fire Department has no objection to_the disannexation. Police Department The apportiomient of extraterritorial jurisdiction with the City of Waite Settlement would not have an SnPact on Fort Worth police services. The area in question is in the northwest area of Fort Worth and was included in Police Reporting Area (PRA) T060 with Police Beat H118 on the first watch providing police services to this area. If it becomes necessary to annex the area at a future date, it will be included in PRA T060 again and Police Beat H116 would be able to respond to calls in this area iimiediately. Health Department If this total area (0.5854 acresl being considered for ETJ exchange is released by Fort Worth, this department does not have any objections and there would be no impact on the department's environmental health services. • City Services Department The Department of City Services foresees no problem with this request. Departrnent of Law Tae Dep~arbnent of Law has reviewed the proposed disannexation and has no objections to same. Recam~endation Staff recamiends disannexation and release of the extraterritorial jurisdiction of this area. He answered all of the questions from the Committee. The Development Review Committee reocamends APPROVAL of this request for . disannexation and release of extraterritorial jurisdiction.
