Chapa, its duly authorized Assistant City Manager and Bode Cellmark Forensics, Inc. ("Vendor"), a Delaware corporation, and a subsidiary of Laboratory Corporation of America Holdings, acting by and through Mike Cariola, its duly authorized General Manager, each individually referred to herein as a "party" and collectively referred to as the"parties." WHEREAS, City and Vendor entered into an Agreement dated March 22, 2018 and identified as Fort Worth City Secretary Contract No. 50556; and WHEREAS, the Agreement is for a period of one year beginning February 1, 2018; and WHEREAS, it is the collective desire of both City and Vendor to amend the original Agreement to revise the Cost Schedule attached to the Agreement as Exhibit B in order to include additional services under the Agreement. NOW, THEREFORE, City and Vendor, acting by the through their duly authorized representatives, enter into the following agreement to amend the Agreement: 1. It is the parties' intent to revise and replace "Exhibit B — Cost Schedule" which was incorporated in the original Agreement with the Exhibit B attached to this Amendment. 2. Pricing is valid only for bulk submission of sexual assault cases(minimum batch size of 6 cases) Samples will be processed using a Y-screen approach. This does NOT include serology testing. The cost of all materials used for laboratory analyses are to be borne by Bode Cellmark. Sample analysis will be performed following Bode Cellmark's validated protocols. Bode Cellmark will be paid for each case/sample tested as long as failure to produce a DNA result is not due to an error or omission on part of the laboratory. Samples will not be consumed without permission from the authorized point of contact. "Sample"is defined as swab. Bode screens sexual assault kit body swabs for the presence of male DNA using a total human:male quantification assay.Bode proceeds with DNA testing the single most probative/male DNA positive sample and the victim's reference sample.Bode does not proceed with testing samples that are male DNA negative,inconclusive for the presence of male DNA or if the ratio of total human:male DNA would reduce the chances of obtaining a male DNA profile.
