HomeMy WebLinkAboutResolution 1321G- ~ resolution ~~o~v~toH,vo~ • WHEREAS, the City of Fort Worth has received a research grant from the Ford Foundation to foster innovative technology in its ,,+- storm drain program; and .~ WHEREAS, an innovative device resultant from the storm drain pro- gram and through the use of grant funds has been de- veloped; and WHEREAS, the terms of the grant prevent the issuance of a patent to an individual when grant money has been used in the de- velopment of patentable devices; and WHEREAS, a City employee has indicated through his legal counsel that the City has no rights to the invention; and WHEREAS, the area of patent law is extremely complex and it is of extraordinary importance that the City retain outside legal cour}sel with expertise in this area on an interim basis to assist the City Attorney in legal matters in- volved in this dispute; and I WHEREAS, Felsman, Bradley and Gunter are well recognized for the knowledge and expertise cF its members in the field of patent law; and • WHEREAS, Felsman, Bradley and Gunter have agreed to represent the City in assisting and consulting with the City Attorney in preparation for and seeking to obtain patent rights; and WHEREAS, it is incumbent upon the City to act in this matter; NOW, ' BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the law firm of Felsman, Bradley and Gunter be retained as outside counsel pursuant to Section 3, Chapter Vi, of the City Charter, to assist the City Attorney on an interim basis in the preparation and pursuit of patent rights; and SECTION 2.
