HomeMy WebLinkAboutOrdinance 23360-08-2018 Ordinance No. 23360-08-2018 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF$4,895,041.00, IN THE FISCAL YEAR 2018-2019 TOURISM PID FUND, FROM AVAILABLE FUNDS, (CONTINGENT UPON THE ADOPTION OF THE ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR SUCH FISCAL YEAR), FOR THE PURPOSE OF PROVIDING IMPROVEMENTS, SERVICES, AND MANAGEMENT OVERSIGHT FOR PUBLIC IMPROVEMENT DISTRICT 18 - TOURISM; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the amount of$4,895,041.00 in the Fiscal year 2018-2019 Tourism PID Fund, from available funds, (contingent upon the adoption of the ordinance levying special assessments for such fiscal year), for the purpose of providing improvements, services, and management oversight for Public Improvement District 18-Tourism. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance-shall be incorporated into the ordinance of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2018, and ending September 30, 2019, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: On August 29, 2017, the City Council adopted Resolution No. 4837-08-2017, establishing Public Improvement District 18 - Tourism (Tourism PID). The purpose of this benefit hearing is to receive comments from the public regarding the Fiscal Year 2018-2019 budget and nine-year service plan for the Tourism PID and the proposed assessments to be levied on each property in the Tourism PID for the 2018 tax year. Following the public hearing, it is recommended that the City Council take the following actions: (a) approve the attached budget and nine- year service plan, (b) approve the 2018 assessment roll; and (c) adopt the attached ordinances levying the proposed assessments and appropriating funds. On August 21, 2018, the City Council conducted a public hearing to receive comments on the proposed 2018-2019 fiscal year budget, nine-year service plan, and 2018 assessments for the Tourism PID (M&C W/BH-386). Notice of the August 21, 2018, benefit hearing and this hearing were published in the Fort Worth Star-Telegram and mailed to all record hotel owners/operators in the Tourism PID on August 2, 2018, in accordance with state law. In fiscal year 2018, the City entered into a contract with the Fort Worth Tourism Public Improvement District Corporation and the Fort Worth Convention and Visitors Bureau to manage the operations of the Tourism PID.
