AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
BELKNAP STREET, MARSHALL STREET AND A PORTION JUANITA
STREET, SITUATED IN THE JOHN LITTLE SURVEY, ABSTRACT NO.
958,IN THE CITY OF FORT WORTH,TARRANT COUNTY,TEXAS,AND
CONTAINING APPROXIMATELY 2,589 SQUARE FEET, 13,715 SQUARE
FEET AND 2,103 SQUARE FEET RESPECTIVELY AND AS RECORDED
IN VOLUME 388-47, PAGE 898 AND VOLUME 490, PAGE 457 OF THE
REAL PROPERTY RECORDS OF TARRANT COUNTY, TEXAS,
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
1. That portion of East Belknap Street, situated in John Little Survey, Abstract No. 958 in the
City of Fort Worth,Tarrant County,Texas,and as adjacent to Lot A of the McGinnis Tract,
an addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 388-
47, Page 898 of the Real Property Records of Tarrant County, Texas and containing 2,589
square feet of land, and as more specifically described in Exhibits A attached hereto and
incorporated herein by reference, be and the same is vacated and extinguished.
2. That Marshall Street, situated in the John Little Survey, Abstract No. 958, as shown on
Cliff Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recoded in
Volume 490, Page 457of the Real Property Records of Tarrant County, Texas, and
containing 13,715 square feet or 0.3149 acre of land and as more specifically described in
Exhibits B attached hereto and incorporated herein by reference,be and the same is vacated
and extinguished.

3. That portion of Juanita Street, situated in John Little Survey, Abstract No. 958 in the City
of Fort Worth, Tarrant County, Texas, and as shown on Cliff Addition, an addition to the
City of Fort Worth, Tarrant County, Texas, as recorded in Volume 490, Page 457 of the
Real Property Records of Tarrant County,Texas and containing 2,103 square feet or 0.0483
of an acre of land, and as more specifically described in Exhibits C attached hereto and
incorporated herein by reference, be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street right-of-way is released and shall
revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

and being a portion of EAST BELKNAP STREET(a generally recognized public right-of-way)and adjacent to Lot A
of McGinnis Tract, an addition to the City of Fort Worth, Texas, according to the plat thereof recorded In Volume
388-47, Page 898, Deed Records,Tarrant County,Texas and being more particularly described as follows:
COMMENCING at a 1" iron pipe found at the intersection of the north right-of-way line of said East Belknap Street
(100-toot wide at this point) with the east right-of-way line of Oakhurst Scenic Drive (a 100-foot wide public
right-of-way) and being the south corner of said Lot A from which a 5/8-inch Iron rod found bears North
16°07'09"West, a distance of 317.05 feet;
THENCE with said north right-of-way line of East Belknap Street and southeast line of said Lot A, North
59°30'11"east,a distance of 10.00 feet to the POINT OF BEGINNING;
THENCE continuing with said north right-of-way line of East Belknap Street and southeast line of said Lot A, the
following courses and distances:

Adopt Ordinance Vacating a Portion of Belknap Street, Marshall Street and Juanita Street to be Replatted

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Belknap Street, Marshall Street and Juanita Street
to be replatted with the adjoining property for a new multi-family development; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Kimley-Horn Associates, Inc., on behalf of Legacy Scenic, LP, has requested vacation of these portions of
Belknap Street, Marshall Street and Juanita Street to be replatted with the adjoining property for a new
multi-family development . The City Plan Commission recommended approval of this request at its
meetings on January 24, 2018 and June 27, 2018. An acceptable final plat (FS-17-163) has been
received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through plat
dedication. The City does not own any fee interest in the rights-of-way or own any property adjacent to
the rights-of-way and did not expend any City funds to purchase the right-of-way easements. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City
Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving
the fair market value or any portion thereof of purchase price of this right-of-way easement for the streets.
This project is located in COUNCIL DISTRICT 9.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds. Any assets recorded on the City's financial statements associated with this land will be
adjusted upon approval.
