AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY
SITUATED IN L.J. WARWICH SURVEY, ABSTRACT NO. 1663, CITY OF
FORT WORTH, TARRANT COUNTY, TEXAS,AS SHOWN IN THE PLAT
THEREOF RECORDED IN VOLUMENT 204, PAGE 34 OF THE PLAT
RECORDS OF TARRANT COUNTY, TEXAS, CONTAINING
APPROXIMATELY 1,712 SQUARE FEET OF LAND MORE OR LESS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING
THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a twelve foot wide alley, situated the in the LJ Warwick Survey, Abstract No. 1663,
Tarrant County, Texas and being located in the Ryan and Pruit Addition, an addition to the City
of Fort Worth as recorded in Volume 204, Page 34 of the Plat Records of Tarrant County, and
containing approximately 1,721 square feet of land more or less,and as more specifically described
in Exhibit "A" attached hereto and incorporated herein by reference be and the same is vacated
and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a 0.040 Acre tract of land situated in the L. J. Warwick Survey, Abstract No. 1663, Tarrant County, Texas and being
all of a 12 foot wide Alley, Ryan and Pruit Addition, an addition in the City of Fort Worth, according to the plat thereof
recorded in Volume 204, Page 34, Plat Records, Tarrant County, Texas, and being more particularly described by metes
and bounds as follows:
COMMENCING at a 1/2 inch iron rod found for the northwest corner of a tract of land described in a deed to Juan Galvan,
recorded in Document Number D210044678, Deed Record, Tarrant County, Texas, and being the southeast intersection of
the south right-of-way line of E. Berry Street, (a variable width right-of-way, and the east right-of-way line of Jones Street, (a
60 foot right-of-way);
THENCE, N 89°05'38" E, along the north line of said Galvan tract, and the south right-of-way line of said E. Berry Street, a
distance of 124.88 feet to a mag nail found for the northeast corner of said Galvan tract, same being the northeast corner of
Lot 3, Block 22, of said Ryan and Pruit Addition, and being the northwest corner of said 12 alley, said point being the POINT
OF BEGINNING;
THENCE, N 89°05'38" E, along the north line of said 12 foot wide alley, and the south right-of-way line of said E. Berry
Street, a distance of 12.00 feet to a point for the northeast corner of said 12 foot wide alley, same being the northwest
corner of Lot 7, Block 22, of said Ryan and Pruit Addition;
THENCE, S 00°38'20" E, along the east line of said 12 foot wide alley, and along the west line of said Lot 7, Lot 6, and
Lot 5, Block 22 of said Ryan and Pruit Addition, a distance of 148.87 feet to a point for the southeast corner of said 12 foot

SUBJECT:
Adopt Ordinance Vacating an Alley in Block 22, Ryan and Pruitt Addition Near the Intersection of East
Berry Street South and Grove Street, to be Replatted with the Adjoining Property for Additional Parking for
the Existing Commercial Development (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating an alley in block 22, Ryan and Pruitt Addition near the
intersection of East Berry Street South and Grove Street, to be replatted with the adjoining property for
additional parking for the existing commercial development; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Blue Star Land Surveying, on behalf of Alaniz Real Estate Investment, LLC and Juan Galvan, has
requested vacation of this alley to be replatted with the adjoining property for additional parking for the
existing commercial development. The City Plan Commission recommended approval of this request at
its meeting on December 16, 2016. An acceptable final plat (FS-16-251) has been received in
accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through plat
dedication. The City does not own any fee interest in the right-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving the fair
market value or any portion thereof of purchase price of this right-of-way easement for the alley.
This project is located in COUNCIL DISTRICT 9.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds. Any assets recorded on the City's financial statements associated with this land will be
adjusted upon approval.
