AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF HELMICK
AVENUE, AND ALL OF AN ALLEY, SITUATED IN THE HAYS COVINGTON SURVEY,
ABSTRACT NO. 256, IN THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS,
AND CONTAINING APPROXIMATELY 40,000 SQUARE FEET AND 8,000 SQUARE
FEET RESPECTIVELY AND AS RECORDED IN VOLUME 63, PAGE 40 OF THE REAL
PROPERTY RECORDS OF TARRANT COUNTY, TEXAS, PROVIDING FOR THE
REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
1. That a portion of Helmick venue, situated in Hays Covington Survey, Abstract No. 256 in the City
of Fort Worth, Tarrant County, Texas, as shown on Chamberlin Arlington Heights Addition, an
addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 63, Page 40 of the
Real Property Records of Tarrant County, Texas and containing 40,000 square feet of land, and
as more specifically described in Exhibits A attached hereto and incorporated herein by reference,
be and the same is vacated and extinguished.
2. That all of an alley, situated in the Hays Covington Survey, Abstract No. 256 in the City of Fort
Worth, Tarrant County, Texas, as shown on Chamberlin Arlington Heights Addition, an addition to
the City of Fort Worth, Tarrant County, Texas as recorded in Volume 63, Page 40 of the Real
Property Records of Tarrant County, Texas, and containing 8,000 square feet or 0.1837 acre of
land and as more specifically described in Exhibits B attached hereto and incorporated herein by
reference, be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street right-of-way is released and shall revert to the adjacent
owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities located in that
easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

METES AND BOUNDS DESCRIPTION
BEING a 0.9183 acre tract of land situated in the Hays Covington Survey, Abstract Number 256, Tarrant
County in the City of Fort Worth, being a portion of Helmick Avenue (80' wide) as shown on Chamberlain
Arlington Heights Addition, an addition to the City of Fort Worth according to the plat recorded in Volume
63, Page 40, Plat Records of Tarrant County, Texas; said 0.9183 acre tract of land being more particularly
described as follows:
BEGINNING at a 1/2 inch iron rod with plastic cap (illegible) found at the intersection of the northerly
right—of—way line of said Helmick Avenue and the westerly right—of—way line of Horne Street (60' wide);
THENCE South 00 degrees 06 minutes 53 seconds West, with the westerly right—of—way line of said Horne
Street, a distance of 80.00 feet to a 1/2 inch Iron rod with plastic cap (illegible) found in the southerly
right—of—way line of sold Helmick Avenue;
THENCE South 89 degrees 59 minutes 55 seconds West, departing the westerly right—of—way line of said
Horne Street and with the southerly right—of—way line of said Helmick Avenue, a distance of 500.00 feet to
a point in the easterly right—of—way line of Halloran Street (60' wide);
THENCE North 00 degrees 06 minutes 53 seconds East. departing the southerly right—of—way line of said
Helmick Avenue and with the easterly right—of—way line of said Halloran Street, a distance of 80.00 feet to
a point in the northerly right—of—way line of said Helmick Avenue;
THENCE North 89 degrees 59 minutes 55 seconds East, departing the easterly right—of—way line of said
Halloran Street and with the northerly right—of—way line of said Helmick Avenue, a distance of 500.00 feet
to the POINT OF BEGINNING;

Adopt Ordinance Vacating a Portion of Helmick Avenue and an Alley in Block 126, Chamberlin Arlington
Heights 2nd Filing Between Halloran Street and Horne Street to be Replatted with the Adjoining Property
for the New Como Community Center in Chamberlin Park (COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Helmick Avenue and an alley in Block 126
Chamberlin Arlington Heights 2nd Filing between Halloran Street and Horne Street to be replatted with the
adjoining property for the new Como Community Center in Chamberlin Park; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Dunaway Associates, on behalf of the City of Fort Worth, has requested vacation of this portion of Helmick
Avenue and the alley to be replatted with the adjoining property for a new community center in the Como
neighborhood. The City Plan Commission recommended approval of this request at its meeting on June
27, 2018. An acceptable final plat (FS-18-082) has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through plat
dedication. The City does not own any fee interest in the rights-of-way or own any property adjacent to
the rights-of-way and did not expend any City funds to purchase the right-of-way easements. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City
Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving
the fair market value or any portion thereof of purchase price of this right-of-way easement for the street
and alley.
This project is located in COUNCIL DISTRICT 3.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds. Any assets recorded on the City's financial statements associated with this land will be
adjusted upon approval.
