HomeMy WebLinkAboutOrdinance 23378-09-2018 Ordinance No. 23378-09-2018 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND, IN THE AMOUNT OF$2,000,000.00, CONSISTING OF$1,000,000.00 IN GRANT FUNDS UPON RECEIPT OF THE GRANT,AND$1,000,000.00 IN LAND CREDITS FOR THE CITY'S IN-KIND LOCAL MATCH FOR THE GRANT UPON RECEIPT OF THE LAND, FOR THE DEVELOPMENT OF ALLIANCE PARK PHASE II; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grant Fund in the amount of $2,000,000.00, consisting of$1,000,000.00 in grant funds upon receipt of the grant and $1,000,000.00 in land credits for the city's in-kind local match for the grant, upon the receipt of the land, for the development of Alliance Park Phase II. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Kayser Assistant City Attorney ADOPTED AND EFFECTIVE: September 11, 2018 A Resolution NO.4848-09-2017 TO CONDUCT A PUBLIC HEARING AND DESIGNATE THE ASSISTANT CITY MANAGER OVER THE PARK AND RECREATION DEPARTMENT TO ACT ON BEHALF OF THE CITY OF FORT WORTH IN COMMUNICATIONS WITH THE TEXAS PARKS & WILDLIFE DEPARTMENT FOR THE PURPOSE OF PARTICIPATING IN THE LOCAL PARK GRANT PROGRAM FOR A PROPOSED NORTH FORT WORTH PARK TO BE KNOWN AS ALLIANCE PARK; CERTIFYING THAT THE CITY OF FORT WORTH IS ELIGIBLE TO RECEIVE PROGRAM ASSISTANCE AND THAT THE CITY OF FORT WORTH'S MATCHING SHARE WILL BE READILY AVAILABLE; AND SPECIFYING THAT THE PROPOSED SITE WILL BE DEDICATED FOR PERMANENT PUBLIC PARK AND RECREATIONAL USES WHEREAS, the Recreation Grants Branch of the Texas Parks and Wildlife Department (TPWD) administers the Local Park Grant Program, which includes the Urban Outdoor Recreation Grant (Program); WHEREAS, the Program assists local units of government with the acquisition and development of public recreation areas and facilities throughout the State of Texas through matching fund reimbursement grants; WHEREAS, the City of Fort Worth (City) is applying for a $1,000,000.00 grant from the Program to assist with the development of a proposed site in north Fort Worth to be known as "Alliance Park", the approximate location of which is set forth in thee attached Exhibit A. WHEREAS,Hillwood Alliance Services, LLC will be donating land, with an appraised land value in excess of$1,000,000.00, to the City for the expansion of Alliance Park; WHEREAS, the appraised value of donated land is an acceptable match under TPWD Grant Program guidelines; WHEREAS, the Program requires a match from the City equal to the a m o u n t applied for under the grant application, for which the match will be readily available; WHEREAS, upon completion of the proposed acquisition of Alliance Park, the Program requires that the City dedicate it for Public Park and recreational purposes in perpetuity; WHEREAS, the City is fully eligible to receive assistance under the Program; and WHEREAS, the City is desirous of authorizing a representative to represent and act on its behalf in dealing with the TPWD concerning the Program: Resolution No.4848-09-2017 NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF FORT WORTH: SECTION 1: That the City hereby certifies that it is eligible to receive assistance under the Program, and that notice of the grant application has been posted according to local public hearing requirements. SECTION 2: That the City hereby certifies that the matching share for this grant application will be readily available. SECTION 3: That the City hereby authorizes and directs its Assistant City Manager over the Park and Recreation Department to act for the City in dealing with the TPWD for the purposes of the Program, and that Susan Alanis is hereby officially designated as the City representative in this regard. SECTION 4: The City hereby specifically authorizes Susan Alanis, Assistant City Manager, to make an application to the TPWD concerning the park site known as "Alliance Park" in the City of Fort Worth, Tarrant County for use as a future park site which will be dedicated for public park and recreation purposes in perpetuity upon completion of the proposed acquisition. Authorize the acceptance of a Texas Parks and Wildlife Department Urban Outdoor Recreation Grant in the amount of$1,000,000.00, for Alliance Park Phase II; 2. Authorize the use of donated land from Hillwood Properties, with an appraised value in excess of $1,000,000.00 as the local, in-kind match for this grant upon receipt of the land by the City; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$2,000,000.00, consisting of$1,000,000.00 in grant funds upon receipt of the grant, and $1,000,000.00 in land credits for the City's in-kind local match for the grant upon receipt of the land. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the acceptance of a Texas Parks and Wildlife Department (TPWD) Urban Outdoor Recreation Grant (UORG) in the amount of $1,000,000.00 for the development of the Alliance Park Phase I I project. The TPWD Recreation Grants branch administers the Local Park Grant Program, which includes the UORG, to assist local units of government with the acquisition and/or development of public recreation areas and facilities throughout the State of Texas. The Local Park Grant Program provides reimbursement grants to eligible local governments that supply matching funds. Grants are awarded by the Texas Parks and Wildlife Commission as funds are available. The Park & Recreation Department (PARD) set forth in City Resolution No. 4848-09-2017, a partnership with Hillwood Properties, to apply for the TPWD UORG, in support of the Alliance Park Phase 11 project. Hillwood Properties is donating land, valued in excess of$1,000,000.00, for use as the in-kind match in the City's application for the TPWD UORG. On March 22, 2018, the City's UORG application was approved, and the City was awarded $1,000,000.00 for use in the development of the Alliance Park Phase II project, As a condition of this grant application, the TPWD and the City of Fort Worth PARD are jointly committed to long term program compliance. This commitment includes compliance at the project site, as well as at Logname: 80ALLIANCE PARK PHASE II - GRANT FUNDS APPROPRIATION Page I of 2 park sites that were previously assisted by grant funds from the Land and Water Conservation Fund and the Texas Local Parks, Recreation and Open Space Fund. After all projects are completed and all grant funds have been reimbursed, the joint commitments to the requirements of the programs will continue. Indirect costs are not eligible under this grant. Alliance Park is location in COUNCIL DISTRICT 7. This contract will be with a governmental entity, state agency or public institution of higher education: Texas Parks and Wildlife Department. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current budget, as appropriated of the Grant Fund. This funding will be reimbursed by Texas Parks and Wildlife Department, through the process described in the grant agreement.
