AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE AMOUNT OF $2,458,110.00 IN THE WATER AND SEWER CAPITAL FUND, FROM
AVAILABLE FUNDS, FOR SANITARY SEWER REHABILITATION, CONTRACT 91, PART
1 AND WESTCLIFF PHASE 2B DRAINAGE IMPROVEMENTS; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2017-2018 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the amount
of $2,458,110.00 in the Water and Sewer Capital Fund, from available funds, for Sanitary Sewer
Rehabilitation, Contract 91, Part 1 and Westcliff Phase 2B Drainage Improvements.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 22928-09-2017 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

SUBJECT:
Authorize Execution of a Contract with William J. Schultz, Inc., d/b/a Circle C Construction Company, in the
Amount of$4,932,799.07 for Sanitary Sewer Rehabilitation Contract 91, Part 1 and Westcliff Phase 26
Drainage Improvements Located in the Westcliff and South Hills Neighborhood Association, Provide for
Project Costs and Contingencies and Adopt Appropriation Ordinance (COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water and Sewer Capital Fund in the amount of$2,458,110.00 from available funds; and
2. Authorize execution of a contract with William J. Schultz, Inc., d/b/a Circle C Construction Company,
in the amount of$4,932,799.07 for Sanitary Sewer Rehabilitation Contract 91, Part 1 (City Project
No. C01957) and Westcliff Phase 213 Drainage Improvements and provide for project costs and
contingencies (City Project No. C01669).
DISCUSSION:
This Mayor and Council Communication is to authorize a construction contract for the replacement of the
deteriorated sanitary sewer mains and the installation of storm drain lines as indicated on the following
streets, alley and easements:

As part of this project, all identified street segments (with the exception of Suffolk Drive) will be
reconstructed with asphalt after sanitary sewer and storm drain installation is completed. Repair on Suffolk
Drive will consist of full concrete panel replacement.
The project was advertised for bid on June 14, 2018 and June 18, 2018 in the Fort Worth Star-Telegram.
On July 12, 2018, the following bids were received:

In addition to the contract amount $682,804.00 (Sewer$242,626.00; Paving: $160,175.00; Storm Water:
$280,003.00) is required for project management, material testing and inspection and $246,639.00
(Sewer: $105,499.00; Paving: $42,374.00; Storm Water: $98,766.00) is provided for project contingencies.
The sanitary sewer component of this project is part of the Water Department's Sanitary Sewer Overflow
Initiative Program.
The proposed storm drain improvements are Phase 1 of a multi-phase project which will mitigate flooding
in the Westcliff North and Westcliff South drainage basins.
This project will have no impact on the Water Departments operating budget nor on the Transportation
and Public Works annual operation budget when completed. Construction is expected to start in
November, 2018 and be completed by November, 2019.
M/WBE OFFICE-William J. Schultz, Inc., d/b/a Circle C Construction Company, is in compliance with the
City's BDE Ordinance by documenting good faith effort. William J. Schultz, Inc., d/b/a Circle C
Construction Company identified several subcontracting and supplier opportunities. However, the firms

contacted in the areas identified did not respond or did not submit the lowest bids. The City's MBE goal on
this project is 25 percent. The project is located in COUNCIL DISTRICT 3.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funding is available as appropriated in the current capital budget of
the General Capital Projects Fund and the Storm Water Capital Project Bonds Fund and that upon
approval of the above recommendations and adoption of the attached appropriation ordinance funds will
be available in the current capital budget, as appropriated in the Water and Sewer Capital Fund. The
Fiscal Year 2018 Water Operating Budget includes appropriations of$29,069,236.00 for the purpose of
providing Pay-As-You-Go funding for Water Capital Projects. Due to insufficient funds remaining in the
Sewer Pay-As-You-Go allocation for 2018, Water funding is being used to fund the Sewer Construction
Cost required for this M&C. After this transfer for Fiscal Year 2018, the balance will be $771,681.00.
