WHEREAS, a majority of the property owners in the vicinity of the
1800 block of Canterbury Circle have requested in an open
public meeting that the City of Fort Worth permit the
existing guard rail located there to remain in place as
a permanent closure of the street; and
WHEREAS, such property owners may enhance the aesthetics of the
guard rail by installing in its place a fence, provided
such enchancement meets the design and safety requirements
of the City staff and contain a small, screened opening
for the passage of pedestrians and bicyclists;
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
That the existing guard rail located in the 1800 Block of
Canterbury Circle remain in place, thereby physically closing said
street; provided that the City of Fort Worth retain title to the
public-right-of-way in said street, retaining any and all easements
for existing and prospective utilities, and retain the right of
access at all time for the purpose of maintaining existing and
prospective utility facilities located in the street.
That if the property owners in the area seek to enhance the
aesthetics of the guard rail at their expense by installing a fence
in its place, such fence may be installed if it (i) meets the design
and safety requirements of the City staff, and (ii) contains a small,
screened opening for the passage of pedestrians and bicyclists.
In addition, the City reserves the right, at the sole discretion
of the City Council, to reopen by resolution the street to public
travel at any time by directing the removal of the guard rail or
fence, all costs and expense of removal to be borne by the
aforementioned property owners.
