The City of Fort Worth
This Memorandum of Understanding (MOU) shall exist between Tarrant County
College District (TCCD), Office of Continuing Education Workforce Services, and The
City of Fort Worth (CFW) to clarify the role and responsibilities of each party in
providing educational services to empower and promote economic self-sufficiency for
residents in Tarrant County.
A. TCCD will provide:
1. Educational and related services to residents of Tarrant County and/or
surrounding community. Services may include but not be limited to:
a. Curriculum development and class offerings in Adult Education and Literacy
(reading, writing, mathematics, and language), High School Equivalency
(HSE) preparation and English as a Second Language (ESL),
b. Skills training incorporating work-based learning components including
internships and/or externships,
c. Academic and vocational assessments, including pre-and post-assessments,
d. College preparatory advising services, and
e. Interface with other campus-based activities and services.
2. Qualified and experienced instructional and support personnel in accordance
with College policy in alignment with grant requirements.
3. Course registration, administration and evaluation.
4. A TCCD certificate of completion to each student upon successful completion of
an entire course/program of study.
5. Access to participation in a TCCD sponsored graduation and awards ceremony
for HSE graduates and ESL students completing the appropriate course work.
6. Accurate and timely reporting as required by TCCD, CFW, the Texas Higher
Education Coordinating Board, which governs state-supported institutions of
higher learning in the state, and any other government entity, party to this
agreement eholder which directly or indirectly funds these activities.

7. Where agreed to and applicable, computer hardware, basic academic skills
software, and academic computing support services for the learning center.
8. Staff assistance to CFW to form community partnerships with other agencies and
community-based organizations for support services to participants and to
pursue grant funding and other resource development activities for ongoing
continuation of services to the community.
9. An invitation to designated CFW staff to participate in staff development training
thus enhancing instructional support for the learning center.
B. CFW will provide:
1. Assistance with technical support of the learning center at space provided.
2. Staff assistance for planning and recruitment of students for programs and
services.
3. Adequate space meeting ADA requirements and access to facilities for training
and related services.
4. Staff support for case management and job placement assistance.
5. Any other support services for which CFW is able to provide that will enhance
participant support services and contribute to successful program
implementation.
6. Support services to include materials, supplies, and incentives where existing
funding permits or upon receipt of funding for such services during the period
covered by this MOU, subject to any necessary City Council approvals.
7. Input regarding training curriculum and customer satisfaction evaluation of TCCD
services.
8. Staff assistance to work with TCCD to pursue grant funding and other fund-
raising options to continue providing services at no cost to residents.
C. General Guidelines:
1. For programmatic purposes, this MOU covers the grant period of September 1,
2017 through August 31, 2019, and will be renewed annually contingent upon
funding and program outcomes.
2. Services provided may be altered or discontinued by either party due to loss or
decrease in grant funding.

3. The work schedule for employees may be increased or decreased as agreed
upon by TCCD and CFW to manage fluctuations in enrollments, and the days
and times of services may change based on demand.
4. Appropriate staff persons from TCCD, CFW, and community partners shall
regularly evaluate program offerings and outcomes.
5. Subject to the requirements of the Texas Public Information Act, all copyrighted
or licensed materials used in this training and assessment program may not be
reproduced or transmitted in any form or by any means, electronic or mechanical,
including photocopying, recording, storage in an information retrieval system or
otherwise without the prior written permission of copyright or license holder.
6. In order for TCCD to offer Continuing Education Units to students of CFW, the
College must comply with its internal policies and regulations, the rules and
guidelines of the Southern Association of Colleges and Schools Commission on
Colleges, Texas Higher Education Coordinating Board, and the State of Texas.
In the matters of curriculum and instruction, the College must be able to
demonstrate it is in control of the curriculum and the instructor with "control'
taken to mean the College must have the authority to establish the curriculum,to
approve/disapprove any instructor(s) and to cause an instructor to be removed
from the teaching and learning environment. Signature of the undersigned
indicates the agreement with and the acceptance of these requirements.
D. Termination:
Either party may, during the term of this Agreement or any extension thereof,
terminate this Agreement by giving thirty (30) days written notice of its intention to
terminate.
E. Miscellaneous Provisions:
1. This agreement shall not serve to create a principal-agent relationship,
partnership, or joint venture. Each party shall maintain control over its own
employees and agents.
2. No party waives or relinquishes any immunity or defense on behalf of itself, its
agents, trustees, officers or employees as a result of entering into this
agreement.
3. This agreement shall not benefit or obligate any person or entity who is not a
party. The parties shall cooperate fully in opposing any attempt by any third party
to claim and benefit, protection or other consideration under this agreement.

4. City actively supports the Immigration & Nationality Act (INA) which includes
provisions addressing employment eligibility, employment verification, and
nondiscrimination. TCCD shall verify the identity and employment eligibility of all
employees who perform work under the Agreement. TCCD shall complete the
Employment Eligibility Verification Form (1-9), maintain photocopies of all
supporting employment eligibility and identity documentation for all employees,
and upon request, provide City with copies of all 1-9 forms and supporting eligibility
documentation for each employee who performs work under the Agreement.
TCCD shall establish appropriate procedures and controls so that no services will
be performed by any employee who is not legally eligible to perform such services.
TCCD will provide proof of compliance if required in conjunction with a federal
audit. City shall have the right to immediately terminate the Agreement for
violations of this provision by TCCD.
5. Right to Audit. TCCD agrees that City shall, until the expiration of three (3) years
after final payment under the Agreement, have access to and the right to examine
any directly pertinent books, documents, papers and records of TCCD involving
transactions relating to the Agreement. TCCD agrees that City shall have access
during normal working hours to all necessary TCCD facilities and shall be provided
adequate and appropriate workspace in order to conduct audits in compliance with
the provisions of this section. City shall give TCCD reasonable advance notice of
intended audits.
6. No Boycott of Israel. TCCD acknowledges that in accordance with Chapter 2270
of the Texas Government Code, City is prohibited from entering into a contract with
a company for goods or services unless the contract contains a written verification
from the company that it: (1) does not boycott Israel; and (2) will not boycott Israel
during the term of the contract. The terms "boycott Israel" and "company" shall
have the meanings ascribed to those terms in Section 808.001 of the Texas
Government Code. By signing this Addendum, TCCD certifies that TCCD's
signature provides written verification to City that TCCD: (1) does not boycott
Israel, and (2) will not boycott Israel during the term of the Agreement.
7. Any notice required under this agreement must be in writing and directed to the
following persons:
