AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
WEST 13TH STREET, SITUATED IN THE SARAH GRAY JENNINGS
SURVEY, ABSTRACT NO. 844 OF THE CITY OF FORT WORTH,
TARRANT COUNTY,TEXAS,AS REFERENCED IN THE BOOK"MAP OF
FORT WORTH TEXAS CENTENNIAL EDITION" PUBLISHED BY
BROOKS BAKER, CONTAINING APPROXIMATELY 0.004 ACRES OR
156 SQUARE FEET OF LAND MORE OR LESS; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of West 13th Street, situated in the Sarah Gray Jennings Survey, Abstract
No. 844 in the City of Fort Worth, Tarrant County, Texas, and as referenced in the book"Map of
Fort Worth Texas Centennial Edition" published by Brooks Baker in 1949, and containing 156
square feet or 0.004 acres of land more or less, and as more specifically described in Exhibits A
and B attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

VACATION OF A PORTION OF WEST 131th STREET
SARAH GRAY JENNINGS SURVEY, ABSTRACT NO. 844
CITY OF FORT WORTH, TARRANT COUNTY,TEXAS
Being a 156 square foot tract of land situated in the Sarah Gray Jennings Survey,Abstract
No. 844, City of Fort Worth, Tarrant County, Texas, and being a portion of West 13th
Street as referenced in the book"Map of Fort Worth Texas Centennial Edition"published
by Brooks Baker in 1949, said 156 square foot tract of land being more particularly
described by metes and bounds as follows:
BEGINNING at a PK nail found for the intersection of the south line of West 13th Street
with the east line of Cherry Street, said PK nail being the northwest corner of a 0.012 acre
tract of land (by deed)described as Parcel S15 conveyed to the City of Fort Worth, Texas
as recorded in Instrument No. D216288907 of the Official Public Records of Tarrant
County, Texas;
THENCE North 00 degrees 23 minutes 47 seconds West, a distance of 31.45 feet to an
"X" cut in concrete found for the intersection of the north line of said West 13th
Street with the west line of said Cherry Street, said "X" cut in concrete being
the southwest comer of a 0.064 acre tract of land(by deed)described as Parcel
S6 conveyed to the City of Fort Worth, Texas as recorded in said Instrument
No. D216288907,from which an"X"cut in concrete found for comer in the west
line of said Parcel S6 and the east line of said Cherry Street bears North 00
degrees 26 minutes 55 seconds West, a distance of 47.99 feet;
THENCE North 89 degrees 22 minutes 39 seconds East, with the north line of said West
13th Street and with the south line of said Parcel S6, a distance of 4.97 feet to
a point for the northwest corner of a 6,960 square foot portion of West 13th
Street vacated by City of Fort Worth Ordinance No.23196-05-2018,from which
a 5/8"iron rod wlcap stamped"City of Fort Worth Survey Division"found for the
southeast corner of said Parcel S6 bears North 89 degrees 22 minutes 39
seconds East, a distance of 14.82 feet, said 5/8" iron rod wlcap stamped "City
of Fort Worth Survey Division" being the southwest corner of 5,813 square foot
tract of land (by deed) described as Tract 1-92, Part 2, Rev. 1 as recorded in
Instrument No. D211138647 of said Official Public Records of Tarrant County,
Texas;
THENCE South 00 degrees 19 minutes 10 seconds East,with the west line of said 6,960
square foot portion of West 13th Street vacated by City of Fort Worth Ordinance
No. 23196-05-2018, a distance of 31.45 feet to a mag nail with bottle cap found
for the northeast corner of said Parcel S15 and the southwest corner of said
6,960 square foot portion of West 13th Street vacated by City of Fort Worth

.THENCE South 89 degrees 17 minutes 59 seconds West,with the south line of said West
13th Street and with the north line of said Parcel S15, a distance of 4.93 feet to
the POINT OF BEGINNING, and containing 156 square feet or 0.004 acres of
land, more or less.

Adopt Ordinance Vacating a Portion of West 13th Street within Downtown for the Burnett Lofts
Development (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of West 13th Street within Downtown for the Burnett
Lofts development; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Gorrondona and Associates, on behalf of Burnett Lofts FW, LLC, has requested vacation of this portion of
right-of-way to be replatted with the adjoining property for a new multi-family development in downtown to
be known as Burnett Lofts. The City Plan Commission recommended approval of this request at its
meeting on July 25, 2018. An acceptable final plat (FS-15-089) has been received in accordance with the
Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through platting
process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007, (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of this right-of-way easement for the street.
This project is located in COUNCIL DISTRICT 9.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no.material effect on
City funds. Any assets recorded on the City's financial statements associated with this land will be
adjusted upon approval.
